1 A bill to be entitled
2 An act relating to water and wastewater utility
3 rates; amending s. 367.081, F.S.; prohibiting
4 the Florida Public Service Commission from
5 including in a utility customer's rates or
6 charges certain expenses or returns on
7 investments related to certain property;
8 providing an effective date.
10 Be It Enacted by the Legislature of the State of Florida:
12 Section 1. Paragraph (a) of subsection (2) of section
13 367.081, Florida Statutes, is amended to read:
14 367.081 Rates; procedure for fixing and changing.--
15 (2)(a) The commission shall, either upon request or
16 upon its own motion, fix rates that which are just,
17 reasonable, compensatory, and not unfairly discriminatory. In
18 every rate-fixina such proceeding, the commission shall
19 consider the value and quality of the service and the cost of
20 providing the service, which mug shall include, but ji not be
21 limited to, debt interest; the requirements of the utility for
22 working capital; maintenance, depreciation, tax, and operating
23 expenses incurred in the operation of all property used and
24 useful in the public service; and a fair return on the
25 investment of the utility in property used and useful in the
26 public service. The commission mv not include in a customer's
27 rates or charges any oneratina expenses incurred in the
28 operation of any nrooerty that is mart of a water or
29 wastewater system that is not interconnected with a system
30 providing utility service to that customer or a return on
31 investment in property that is part of a water or wastewater

1 system that is not interconnected with the vsystm providing
2 utility service to that customer. notwithstanding any common
3 ownership of the non-interconnected system. However, the
4 commission Ml shall not allow the inclusion of
5 contributions-in-aid-of-construction in the rate base of any
6 utility during a rate proceeding; and accumulated depreciation
7 on such contributions-in-aid-of-construction May shall not be
8 used to reduce the rate base, nor may shall depreciation on
9 such contributed assets be considered a cost of providing
10 utility service. The commission shall also consider the
11 investment of the utility in land acquired or facilities
12 constructed or to be constructed in the public interest within
13 a reasonable time in the future, not to exceed, unless
14 extended by the commission, 24 months from the end of the
15 historical test period used to set final rates.
16 Section 2. This act shall take effect July 1, 1996.
Prohibits the Florida Public Service Comission from
20 including in a water or wastewater utility customer's
rates or charges any operating expenses incurred in the
21 operation of, or a return on investment in, property that
is part of a water or wastewater system that Is not
22 interconnected with the system providing utility service
to the customer.
