RE: Chamber's Proposed Positions on State Water Policy
I appreciate being afforded the opportunity to review the
Chamber's proposed positions on state water policy. The
following comments are provided in response to the draft
distributed on January 6, 1997. I will be attending the meeting
of one of the committees established pursuant to the Governor's
Executive Order and will be unable to attend the Chamber's
meeting on Thursday, January 9, 1997.
Except for position 6 dealing with the duration of permits,
I generally support the proposed positions. With respect to the
duration of water permits, I have no problem with long term
permits as long as the water withdrawal is in an area where the
supply exceeds the demands. However, in those areas where the
demands exceed the supply, long duration permits will result in
Florida utilizing a prior appropriation approach to water
allocation rather than the current reasonable-beneficial use
standard. This change has numerous and complex ramifications.
Long term permits will afford the existing entities benefits
not previously available or envisioned under current law. Long
term permits will reduce growth and development in many areas of
the State.
There are numerous problems associated with position 6 as
proposed and I would strongly recommend deleting this proposed
position. In my opinion, there is a serious difference of
opinion within the Florida business community on this issue. At
a minimum, further discussion and refinement is needed on this
position.
