9 Section 13. Section 373.042. Florida Statutr., is amended to read:
10 373.042 Minimum Plows and Levels.--
11 (1) Within each section, or the water management district as a whole, the
12 department or the governing board shall establish the following:
13 (a) Minimum flow for all surface watrcourses in the area. The minimum
14 flow for a given watercourse shall be the limit at which further withdrawals would be
15 significantly harmful to the water resources roecology of the area.
16 (b) Minimum water level. The minimum water level shall be the level of
17 groundwater in an aquifer and the level of surface water at which further withdrawals
18 would be significantly harmful to the water resources of the area.

(2) By July 1, 1996, the Southwest Florida Water Management District shall
amend and submit to the department for review and approval its priority list for the
establishment of minimum flows and levels and delineating the order in which the
governing board shall establish the minimum flows and levels for surface watercourses.

challenging the establishment of the minimum flows or levels, the report of the independent
scientific peer review is admissible u evidence in the final hearing, and the administrative

time limit for rendering a ie flnal order shall not be extended except by agreement of all
the parties. To the extent that the parties agree to the findings of the peer review pant,
they may stipulate that those findings be incorporated as findings of fact in the final order.

17 development solution can be implemented, the department or governing board may
18 implement interim measures and remedial actions to alleviate any immediate and suthsrtntial
19 harm to the affected surface watercourse, aquifer or surface water' provided, however
20 any interim measure or remedial action that would cause the loss or reduction of an
21 existing permitted or other legal use shall not he implemented until such time as the
22 department or governing board providea the affected user with an alternative water supply
23 or otherwise fully compensates the user for that loss or reduction.
