A By July 1.1998 the Permittee hall prepare and submit to the District
1) A phse I watr facilities plan (Phas I Plan) which, upon construction, sha
provide no tles tan 38 MGD annual average quantity of newwater supply
capacity by December 31. 2002.
2) A phase 11 water facitlet plan "Phae II Plan) which, upon conetucton, shall
prove no lea than an additional 47 MOD annual average quantity of new wat
supply capacity by Decemer 31, 2007, for a total of 85 MGD.
3) At a minimum, these Phase I Plan and Phase II Plan shall IdentLthe following:
a) Proposed soure of water
b) Estimated quality of water to be produced from each proposed source
c) When the proposed source shall be in operation
d) Estimated cost of const cting the water supply facities associated with
each proposed source
a) The expected funding sources Including how much and when District
funding puruant to the Partnership Plan shall be required
) Allocation of water to Cntral System pumpage reduction
B. The Permittee shall keep the Regulation Depa nt director advised of the Perm 's
planning and progress toward completion of the Phase I Plan and Phase II Plan. By April
1, 198, the Athority shall meat with the Regulation Deparment Director, and other
District staff members, at a place desslnated by the Regulation Department Director, to
discus the detail of the Perftte's July 1, 1998 Phae I Plan and Phse II Plan
submittals, at which time the Permittee shal provide the Regulation Department Director
with a current draft of the aubmtals. The Parmitee shlfurnish the Regulation
Department Direator with an original and 11 copies of th Phase I Plan and Phase II
Plane, In final form, aa soon a they are avalabi.
C. Within ninety (90) days of receipt of the Phase I Plan and Phase II Plan, the Distrct shall
provide In writing to the Permittee a flsting of the water supply facilltie for which the
District wil provide funding, the amount of ending and the tear under which said funds
will be made available to the Permittee; provided, nevertheless, tht both the commitment
to fund and the amount of funding shai be subject to Issuance of all necasary
govemmental permits and approvals In acordance with the following ubparagraph.
The parties acmowledge that the actual cost of funding a particular project will be
unknown unt such time as a Water Use Permit and any and al other govemmental
permits and approvals are obtained.
E. By December 31, 1998 the Permitte shall have filed all permit application for new water
supply source identified in the Phase I Plan and Phase II Plan. Within 90 days of the
Regulation Department Director' recpt from the Permttee of written evidence of the
issuance of al necessary peoms and approvals by all appropriate govemmntal
authorities for a partular proet (or within 60 days of the Distriot's isuance of a Water
Uee Permit whoee such i require, te District shall advise the Permttee in writing of th I
amount of funds that will be made available for such project.
F. The Permniee shall keep the Regulation Department Director Informed of the progress of
implementation of any and al projects for development of new water supply sources, and
shall furnish the Regulation Department Director such information as is necessary and
appropriate toward this end. In addition, the PernteL shall provide such additional
Information, and take such other steps to keep the Regulation Department Director
Informed of progress. as may be required by the term of the Disticts written


commitment for finding.
H. Any modifIation of the PermitWe's Pha I Plan or Phase II Plan hall require the written
approval of the Distrit which approval shall not be unreasobly withheld
