STIPULATION AND SETTLEMENT AGREEMENT
WEST COAST REGIONAL WATER SUPPLY AUTHORITY ("AUTHORITY"), CITY
OF ST. PETERSBURG ("ST. PETERSBURG"), PINELLAS COUNTY, PASCO COUNTY,
HILLSBOROUGH COUNTY and the SOUTHWEST FLORIDA WATER MANAGEMENT
DISTRICT ("DISTRICT"), by and through their undersigned counsel, hereby voluntarily agree
and stipulate to settle the subject cases as follows:
1. On August 18, 1992, ST. PETERSBURG filed an application to renew its existing
water use permit for the South Pasco wellfield. Also, on August 18, 1992, the AUTHORITY
and ST. PETERSBURG filed applications to renew existing water use permits for the Section 21
and Cosme-Odessa wellfields.
2. On May 19, 1994, the AUTHORITY filed an application to renew an existing
water use permit for the Northwest Hillsborough Regional wellfield.
3. On February 7, 1995, the DISTRICT issued a Notice of Proposed Agency Action
and subsequently, Petitioners filed petitions challenging the proposed agency action.
4. The cases were consolidated, a formal administrative hearing was conducted and
on May 29, 1997, the Administrative Law Judge entered a Recommended Order.
5. The parties hereto have reached agreement regarding the issues in these cases and
agree to the DISTRICT issuing a consolidated water use permit that includes the South Pasco,
Section 21, Cosme-Odessa and Northwest Hillsborough Regional wellfields as well as other
wellfields owned or operated by the AUTHORITY in the form attached as Exhibit A.
6. The AUTHORITY, ST. PETERSBURG, PINELLAS COUNTY, PASCO
COUNTY and HILLSBOROUGH COUNTY acknowledge and agree to waive any and all
objections to the provisions of the consolidated water use permit dealing with the-South Pasco,
Section 21, Cosme-Odessa and Northwest Hillsborough Regional wellfields as shown on Exhibit
A.
7. By execution of this Stipulation And Settlement Agreement the AUTHORITY,
ST. PETERSBURG, PINELLAS COUNTY, PASCO COUNTY and HILLSBOROUGH
COUNTY withdraw all of their petitions filed in the above styled cases.
8. This Stipulation And Settlement Agreement shall not become final and effective
until the District Governing Board has approved it and entered a Final Order in a form consistent
with Exhibit B. Within thirty (30) days after entry of the Final Order, the DISTRICT shall issue
a consolidated water use permit consistent with the permit attached as Exhibit A, provided there
are no petitions filed challenging the consolidated water use permit as it relates to the other
wellfields.
10, 9'. Upon approval of the Final Order in a form consistent with Exhibit B by the
District Governing Board and issuance of the consolidated water use permit, the parties hereto
agree not to challenge the Final Order or the permit in any forum.
IN WITNESS WHEREOF, the parties have duly executed this Stipulation And
Settlement Agreement as of the shown below.
