RE: Interlocutory Appeals of Orders Of Taking
Effective March 1, 1978, the new Florida Rules of Appellate
Procedure will permit interlocutor appeals to be taken from
circuit court orders determining "the right to immediate
possession of property". See Rule 9.130(a)(3)(C)(ii),
Fla. R. App. P.
According to the comments of the 1977 Advisory Committee
and Courts' Commentary this subsection is intended to apply
whether the property involved is real or personal and will
apply to such cases as condemnation suits where a condemnor
is permitted to take possession and title to real property
in advance of final judgment.
