RE: APPLICABILITY OF STATE PURCHASING LAW TO SWFWMD




I have attached a copy of the Attorney General's Opinion

076-185, in which the Attorney General was of the opinion that the

State Purchasing Act did not apply to the Florida State Fair Authority.

The basis of the Attorney General's opinion was that the State Purchasing

Act, as evidenced by its title, applies only to agencies within the

executive branch of State Government. To be within the executive

e branch of government an agency would have to be assigned there by

Chapter 20 of the Florida Statutes. The Florida State Fair Authority

was not assigned within the executive branch nor is the SOUTHWEST

FLORIDA WATER MANAGEMENT DISTRICT so assigned.

Furthermore, on a common sense basis if the Florida State Fair

Authority which runs the State wide Fair is not within the executive

branch of government then, a fortiori, the SOUTHWEST FLORIDA WATER

MANAGEMENT DISTRICT with its regional jurisdiction, should not be

deemed part of the executive branch of State Government.

Therefore, in my opinion the State Purchasing Act would not

apply to the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT.
