YoU will recall that, several months ago, the question
ar:se concerning prosecution for trespassing on State
pr: erty, and we gave you an opinion on the same. I am
enc osing a copy of the opinion, together with our letter
to you of December 5, 1973. It is my opinion that this
wil also be applicable in the present situation.

u will recall that you advised me that the law enforcement
Sficers patrolling the Lower Hillsborough Reservoir had told
u that when they find people on the property, they cannot
osecute them for trespassing because it is State property
d they cannot get a conviction for trespassing on publicly
SId land.

am enclosing herewith a memorandum prepared by Mike Ford of
Sr firm, concerning the same, together with copies of the
Statutes and cases supporting the same. As you will see, the
Statutes specifically prohibit trespassing on State land.

estions or wish to discuss it, please let me hear from you.
