Re eipt is acknowledged of your letter of November 12, 1976,
co cerning the transfer of District owned lands into other
Wa er Management Districts.
We can transfer the lands from the District, which are being
puz into another Water Management District, by one deed which
wo ld include all of the lands by individual description, or
we can deed them in individual deeds parcel by parcel. This
wo ld be a matter for decision by the Governing Boards of the
So thwest Florida Water Management District and the District
to which the land is being transferred.
I also would call to your attention that these transfers must
be by quitclaim deed, because, under S373.099, the District is
nct allowed to transfer any property by warranty deed.

Dear Mr. Gibbons:
In regard to the proposed transfers, the question arose as to
whether we are to transfer the District owned lands individually
parcel by parcel or in some other less cumbersome way.
We were contacted by Herb Webb, Attorney for the St. Johns Water
Management District, who asked whether we would transfer by Warranty
Deed or Quit Claim Deed and our response was that the District would
probably transfer by Quit Claim Deed, but this needs clarification
also.
Please advise if we should transfer each parcel individually and if .
this should be done by Warranty Deed or Quit Claim Deed.
