Dear Ms. Morgan:
Your letter of June 3, 1974 inquiring as to the filing of the above
referenced Agreement pursuant to the Interlocal Cooperation Act of
1969 is acknowledged.
Please be advised that the particular Agreement in question was not
entered into pursuant to FS 163.01 163.03 and was prior to the
effective date of said statute.
After a legal investigation by our Staff Attorney, of the law, it is
his opinion that our Agreement was entered into pursuant to Section
4 of Chapter 61-691 which created the Southwest Florida Water Manage-
ment District and permitted this particular Agreement between us.
Accordingly, the District believes.the particular Agreement with your
Authority does not have to be filed pursuant to the Interlocal Coopera-
tion Act of 1969.
