Re: Junk car removal from District properties

Dear Bob:

Receipt is acknowledged of your letter of June 1, 1972, con-
cerning the above matter.

At the present time, the Southwest Florida Water Management District
still has sovereign immunity. This means that the District is not
liable for negligence of its officers or employees, nor in this
instance, would the District be responsible for the negligence of
some one with whom it entered into a contract, unless the contract
specifically made the District liable or the District assumed some
of the liability of the salvage dealer.

Therefore, it is my opinion that you can go ahead and make arrange-
ments with a salvage dealer to do the work, as long as you do not
assume responsibility for any of his actions or negligence.
