Oil and Gas

Problem: Seismic testing, well drilling and gas
exploration and production regulation by DNR overlaps with
Henderson Wetlands Act jurisdiction in DER wetlands.


A duplication of permitting for oil and gas drilling and
seismic activities occurs for wetlands areas and waters of
the State. Both DER and DNR require permits for the same
activity though DNR does so as a part of the resource
management role.

DNR regulatory authority covers all seismic and drilling
activity whether or not on sovereign lands and relates to
the management and location of nonrenewable resources.

Proposed Solution:

Retain the oil and gas program in DNR. In wetland areas
applicable permits will be required from the WMDs.
