Dredge and Fill/Wetlands
Problem: Dredge and fill activities are subject to
contradictory standards and diverse agency jurisdictional
DER, DNR, WMDs, RPCs and local governments consider, permit
or make recommendations that impact wetlands use.
DER issues dredge and fill permits in waters of the state
and jurisdictional wetlands. WMDs issue surface water
management permits and consider isolated wetlands. RPC
issue recommendations for wetlands use in DRI projects.
DNR considers impacts on vegetation and submerged grasses
when deciding to lease or allow the use of sovereign
submerged lands, and in doing so conducts its own
Conflicts arise in three areas: 1) jurisdiction,
2) standards for approval and 3) mitigation requirements.

Mitigation of Dredge and Fill
Henderson Wetlands Protection
Act of 1984
Move the Henderson Wetlands Protection Act from Chapter 403
to Chapter 373 and provide the WMDs with usekrizve-
statutory authority to administer dredge and fil wetlands
