3 A bill to be entitled
4 An act relating to the preservation and restoration of state-
5 owned water bodies; providing for the establishment of a pro-
6. gram within the Department of Environmental Regulation to
7 assist in the preservation and restoration of state-owned

8 water bodies funded by appropriations from general revenue,
9 unused funds from the Pollution Recovery Fund and available
13 federal monies; establishing criteria for consideration for
11 determining funding priorities; providing for positions within

12 the department; providing for funding; providing for liberal
13 construction; providing for an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Sections 403.166(1), 403.166(2), 403.166(3) (a), (b),
Aa and (c) are hereby created as follows:

9 403.166(1) This act shall be known as the Lake Preservation and
23 Restoration Act of 1977.

2; 403.166(2) The department shall establish a program to assist the.
_: preservation and restoration of state-cmed water bodies, said proolra~'. to

23 be funded from! general revenue, funds available from 403.165(2), and avjil-
able federal monies.
|_ 403.165(3) Funds for the preservation or restoration of specific

26 state-o-;:ed water bodies shall be allocated only after considneritioi of
27 the folloi.nb criteria:

2' (a) Whether the sources of pollution .that have caused tihe
29 need for restoration or preservation have been fully abated;

1 (b) 9hcther the county or counties within which the water
2 body is lo ated has pr have adopted ordinances which would prevent the con-

4 preservation and the other water bodies within the county or counties.
5 (c) Whether the water body is or may be used for public
6. drinking water supplies, pr public recreational purposes.
