RE: Water Management Legislation
SB 1274

Dear Don:

Yesterday, I met with Sonny Vergara and several of the
lawyers in our office to review the recent legislation.
This will require the District doing several things and
perhaps it would b~ appr6ptiate to list these with more
details to follow.

1. We need maps showing the revised District
boundaries. There should be a series of
these base maps of different scales. It
would be helpful to have at least one on
a smaller scale showing the new boundaries
of all the districts.

.2. We need to seek approval from the Corps of
Engineers for the transfer of the Oklaiaha
project to the St. Johns District and the
release of further liability after December 31,

3. We need deeds of conveyance, bills of sale and an
inventory of all property transferred to
St. Johns.

4. We need to seek an amendment to the Manasota
Basin Board members' commissions effective
December 31, 1976 so there commissions will
then cover them as members of the Manisota
Basin of the Southwest Florida Water
Management District.

5. We need to do the same thing for the Oklawaha
Basin Board members.

6. We need to follow up with the Governor's
office to be sure that they immediately
designate the tenth member to serve on our
board. He would be from the 6th District
and must reside in the Manasota Basin.

7. We need to follow up on the Governor's
office about designating one of our
current board members who resides in the
Oklawaha Basin and will become an ex officio
member of the St. Johns District.

8. We will need to amend the commissions of
those two respective members so it will
cover them after December 31, 1976 when
they cease being members of their present
boards but will continue as additional
members of the new boards.

9. We need a series of basin maps showing the
revised basin boundaries, together with
the county lines, main roads, etc. I
believe this can best be done by updating
our map series B from file 11-10-1, 12-10-1,
13-10-27, 14-10-1, 15-10-1, 16-10-1,
17-10-1, 18-10-1, 19-10-1, and 20-10-2. In
light of recent discussions, I ame ure some
of these can be combined. For instance,
the Wacassasa Basin and the Withlacoochee
Basin can appropriately be combined, and
the Crystal-Homosassa Basin and the
Pithlachascotee Basin can be combined.
In addition, the Peace Basin should be
modified to include the additional area
being transferred to it from the Ridge Basin.

10. We need to immediately initiate a study of
fees being charged for permit applications
in view of the new law which requires that
we charge a fee to cover the cost of

We are now in a position to consider changing our
rules relating to processing of permits where
no objection has been received so we can disp nse
with the hearing requirements.

11. In setting the mileage for next year the
resolutions should clearly show that the
mileage is not being imposed for the
first 4 days of calendar year 1977.

12. We will be required to furnish budgets and a
detailed list of expenditures to each of
the counties within the District, etc. and
to get post-audit and performance audits
done. I am not sure whether the management
letter from Ernst & Ernst is sufficient to
cover the "performance audit" requirement.

13. We need an agreement with St. Johns
pursuant to Section 17 of the bill.

We will continue to research these matters but I believe
the above list outlines most of the major items that
need to be done, some of them immediately. We especially
need the basin and district maps, not only for our own
use, but I have also promised a set to Jane Love for her
to use in making appointments.
