Bishop v Rolston â–  This was an action for
the recovery of /,'f ! amount due upon a
piomissory note dated 1893. Mr E Mates.se
Smith appealed tor the plaintiff : and Mi il
M lies for the defence, The defendant ad
milted his signatures to the note ; but he
claimed it had been obtained by fraud upon
an uncompleted transaction. And the denied
having in 1890 made a part payment by
means of a barrel of Hour. In de(mice, the
man said that he was an adjacent propiictor
to one ilackct in Tobago ; and Mr Blakely
the barrister came to him and said that he
had instructions from Backet *to prosecute
him for encroachment, but would compromise
the case for four guineas. On this, defendant
gave a promi&sisory note for the amount ;
and was about to stamp it when he was
advised by Mr 4 gard the solicitor not to do
so. A -d lie did not. Defendant admitted
signing the note, but swore he had never
stamped it, or ciosssd the stamped in flic
way which now appeared on the note. Mr
Maiesse Smith said, in reply to the judge
that he was afraid be could not bring further
ot the payment in 1890, (where the statute
ol limitations was proposed to be barred) ;
but he would asked to be afforded the oppor opportunity
