dant Defendant was fined 20s or 14 days.
DISTURBING THK I'RACK,
Owney Deuglas and Rebecca Connel were
charged by L U Hinds with the above offence
at George Street on the 2tth of last month.
Mr Gaston Johnson defended. After the
heating of evidence ; the defendants being
well-known chambers, were sentenced to 1
months imprisonment with hard labour,
Hubert Francis was fined £1 ot 14 days
for having incited the above prisoner to

A BANDSMAN CHARGED WUH ASSAULT
Hiiory Ilill was charged on remand by
Sergt. Major Lewesy (I) with being drunk and
disorderly and (2) with assaulting a woman
whom, it was alleged, he had wrongfully
arrested.
Mr J Ainsley l.assalle who appeared for the
defence, intimated to His Worship that after ,
carefnl consideration of the circumstances of 1
the case he had decided to enter a plea of
guilty on b ihalf of his client. He was aware
of his Worship’s aversion to the commission
of su h offences by persons in the position
of his client; but it seemed that the latte?
who was in liquor at the time, was under the
impression that the woman assaulted, was in
some way connected with him, and had
wrongfully arrested her. No one regretted
the occurrence more than his client now did,
having realised the gravity of his offence. He
would mention on his behalf that he had
previously been of good character and had
held a post in the Police Band for sometime.
The girl who had been assaulted did act
think seriously of the assault ; and he hoped
that these facts would be taken into consi consideration
deration consideration by His Worship in mitigatics cf
whatever penalty he intended tc inflict. Ilia
Wore’jp said that it was simply for him to
decide whether the defendant was guilty or
r.t>; on the charges preferred. Any other
p-nalty that he had made himself liable to,
could be dealt with in th- proper quartet,
Ile would fine the defendant £l on the charge
ot assault, 10s for being drunk and dls dlsuier’y
uier’y dlsuier’y ; and probably, in consideration of
the [ilea of guilty entered by defendant, the
other quarter whose duty it might be to deal
further with the matter, might take a merciful
view' of it.

The charge of burglary was dismissed;
and the fl J P , directed one of wound wounding

Then came a period of trouble On
several occasions Domingo was far too
ill and weak to give evidence;

the ingenuity oi three swo n Spanish

But when examined, his evidence ap appeared

iu it suggestive of the truth after all
ol the original charge of burglary.
Eventually, after many adjournments
from various difficulties, Modeste was
committed for trial sometime in the

though prim* facia one for n
Grand Jury, was assuredly one upon
which very few juries would have c n nvioted

allowed Modeste out on comparatively
low bail Early in -November, the old
man Domingo, (who, tho ugh entirely
cored of hia wounds, was still too ill
and weak to leave tho Hospital), was
reported to be dyiug ; and tbe 8.J.P.,
was summoned to take the depositions.
The man improved however and
nothing was done On Wednesday
afternoon Domingo died At the Hospi Hospital

both Drs Perez and Bead not directly
due to the assault. And the Attorney
General having now taken the only
course open to laim on the evidence
there is for the 'present an end of the
matter, The ixellection arises, that
here again, as in the Vega deGusru deGusrueara
eara deGusrueara case, is a mysterious critr.e. of
violence committed in a lonely dis district,

Cross examine IbyMr / goslini : He did
not always craze these words “el the
Colonial Bank ' in promissory notes ; but in
any one where they were cancelled, it was
• done before M r Vignales signed it. He had
no particular reason lor crazing them in this
case; but he remembered the transaction
took place at the Railway fetation, and he
was asked by Mr Vignales to cancel those
words in or Li to prevent the nute being dis discounted
counted discounted at the Bank He had ottered the
plaintitf JI3U in full settlement of the note,
but he had been refused. He had « the same to Vignales ; nor had he eer
actually tendered the money to i aser.
This closed the case for the plaintiff.
lor the defence ;
U Yipu les swore most positively that when
he endorsed the note the erazurc was not
in existence ; there was absolutely no reason
why he should have wished to prevent the
note going to the Colonial Bank, lie had
had several there, and had always taken them
up, He entirely denied having had any such
conversation with the defendant Laughlin at
the Railway Station as the Utter alleged ;
and he never asked turn to cancel the words.
Cross examined ny Mr icazar : He would
certainly have noticed, and probably objected
had tho note borne the erazatc in question
when iie signed it.
fins closed the case tor the defence,
Mr i. gi.sum said he based his case upon
the alteration of the phase oi payment oi the
note, which he was instructed had been, (as
his client ha i sworn), made since the endnr endnrsation
sation endnrsation iie did not wish to impeach sot one
moment t..c credibility oi Jrrascr when he
swore It ex -led on the note at the time he
received it ; but he did question the credibility
of Laughim, who, according to his instruc instruction.,
tion., instruction., must ii ive made the alteration between
the time of obtaining Vignales endorsement
and the time ot handing it to Fraser, if this
was ivhat had occurred, then he submitted
on the authority otseciiou 64 oi the English
livlis of Exchange Act, and the Work of
Chalmers thereon (pages 312—31—5) that
the alteration was one which rendered the
note void as against the endorser.
Mr Justice Baynes came to ihe conclusion
>hat, judging from the ink and the stroke of
the pen, it seemed the etasure had been made
at the same time as the signature of Laughlin,
Be that as it may, he must find against
Vignales as endorser oi the note. It seemed
to be a very hard case ; one of those were a
man suffered for serving his friend ; but on
the note judgment must lie for the plaintiff

SECRETS WRESTED
from nature. Kature places most
valuable things where they are
hard to get at. She concealed
the Kimberly diamonds in solid
rock. Petroleum, now used all
over the world for heating and
lighting and many other pur purposes,
poses, purposes, was discovered hundreds
of feet under the surface of the
soil. Ages went by before men
found, and were able to mine,
coal in sufficient quantities to
take the place of wood as fuel;
and electricity as an available
help to us in living, is barely
more than half a century old.
Among the wonders which pa patient
tient patient and hard-working mod modem
em modem science has introduced to
the world, is the reconstruction
of that graßd healing agent,
cod liver oil, in the form of
WAMPOLE’S PREPARATION.
The reader is aware that for cen centuries
turies centuries the usefulness of this drug
has been impaired, and in many
cases nullified by its nauseating
taste and smell. In this effective
remedy these formidable objec objections
tions objections are entirely done away with.
Palatable as honey, it contains
the nutritive and curative prop properties
erties properties of Pure Cod Liver Oil, ex extracted
tracted extracted by us from fresh cod
livers, combined with the Com Compound
pound Compound Syrup of Hypophosphites
and the" Extracts of Malt and
Wild Cherry. It m a healer,
body-builder and strength-maker
beyond rivalry or comparison.
By means of it diseases are cured
which have hitherto been justly
regarded as hopeless. In Fevers,
Scrofula, Rheumatism, Influenza,
La Grippe, Lung Diseases, all
wasting ailments, etc., this rem remedy
edy remedy is successful after tho old
style modes of treatment have
been appealed to in vain. Both
the poople and advanced phy physicians
sicians physicians have welcomed it as the
solution of a long standing prob problem
lem problem in the art of medicine. Ef Effective
fective Effective from the first dose. “You
cannot he disappointed in it.”
Sold by chemists everywhere.

THEGAZETTE
i’OBT-OF.Si’AIN
fcATOKDAY, Btu DEOR. 1900
In our issue of Thursday last we
vailed attention to the serious drain
on the population of this colony
eenwd by the exoesaive mortality
among children order 10 year* of age.
In concluding our remark* we pro promised
mised promised to return to the subject
in order to answer «o far, as we
oould, the very important ques question
tion question at to whether the causes of such
excessive mortality some of which
we mentioned, were or were not
prevcutable. As explained in those

remarks, the causes of the high
death rate especially among the
children of our working classes
are so intimately connected with
the every day life and work of
that large section of our population
that any remedial measures must
begin from the very foundation (so to
speak) of their social, moral and ma material
terial material condition. Here, as in all other
countries, it is in the earliar stages of
life shut the mortality is greatest.
The local annual death rate under
one year may be taken as between
180 and 11)0 per 1000, that; is to
say that out of every 100 children
born in any one year, 18 or 10 die
within the first twelve months of
their existence. Now, this is fully
50 per cent more than die at the
same age —period in England, where whereas
as whereas we have already shown the risks to
infant life are far greater, the seasons
far more trying and the expense for
food clothes and shelter much greater
Again if the infant mortality among
the general population be compared
with that among the East Indian or
Coolie population it will be found
that the former is between 40 and
50 por greater than the latter.
In regard to the general quesden
of infant mortality it may perhaps be
well before expressing our own oph ion
',o quote that of one cf the few Wes
India. Officials who h ve take i she

After mentioning that these h d

infant mortality for the year, he
continues thus “ Nothing will ma materially
terially materially lessen the number ol these
doaths but a change in the moral coi
difion of Ihe people. * * t» a
A a improvement in the dwellings of
our labouring population must precede
any hope of moral improvement, for
where marriuge is ignored and men,
women and children are crowded
togother in one small room for all
domestic purposes day and night, the
possibility of any moral sentiment
existing among those who live in this
manner is precluded, aDd children
growing updn each circumstances can cannot
not cannot possibly have any sense of shame
or decency so that the evils ol the
existing system are perpetuate*). The
chances therefore of materially
lessoning the inlant death rate seem
very remote 1”
While we admit that Ihcro are
many and great difficulties in the
way of the alracst revolniionary
changes that must bo made in order
to afleot any material or permanent
redaction in the infant mortality
of this colony, wo are unwilling to
believe that such a result ig an impos impossibility,

One 'veiling towards the end of
March last an old man of the name of
Domingo Estabano, ili tt “ Cabra,”
whose ago has been estimated, as
neas ly us can bo, at not less than 90
years, was the victim of a most serious
and determined assault in his little

was employed as the watchman on a

afternoon of the following day that
some travellers, passing by, called out

There he was placed under the care
