At Bow-street, Mr Benjamin Greene Lake,
a solicitor, ot Lincoln’s Inn, Chairman
of the Disciplinary Committee of the In Incorporated
corporated Incorporated Law Society, was brought before
Sir Franklin Lushington charged with having,
“on the 7th of July, 1898, being then the
trustee of certain property, to wit, the sum oi
£5OO, for the use and benefit of certain per persons,
sons, persons, appropriated that sum to his own use
and benefit, with intent to defraud ; and on
November 25, 1899, being then an attorney,
and being entrusted for sale custody with two
bankers’ deposit notes for ,£l,lOO and ,4 1,000
respectively, did unlawfully, and with intent
to defraud, appropriate the same to his own
use.” Mr. Horace Avory, instructed by Air.
Williamson, of the Treasury, prosecutec ; Mr,

Before Sir Francis Lushington, at Bow Bowstreet,
street, Bowstreet, Benjamin Greene Lake, toliaitor, was
further charged with having, in conjunction
with his deceased partner, George Edward
Lake, misappropriated moneys entrusted to
them as trustees and attorneys. The defen defendant

dock.—Mr Horace Avory, on behalf of the
Public Prosecutor, having given the business
career of the accused, said that a petition in
bankruptcy was presented against him in May
this year, and he was adjudicated a bank
rupt on July 14. A statement of the affairs re
Lake and Lake filed by defendant in the
Court of Bankruptcy showed liabilities to
unsecured creditors amounting in the aggre aggregate
gate aggregate to £205,277, and, on defendant’s own
estimate of the assets, there was
A DEFICIENCY OF £173,722.
These liabilities have been analysed, and
they show the following results : £21,209
represents the money received by the firm of
Lake and Lake, and belonging to various
estate of which the late George Edward Lake
was trustee ; £11,858 belonged to estates of
which defendant himself was trustee; and
£2,720 belonged to estates of which defen defendant
dant defendant and his late cousin were joint trustees.
In addition to these sums, there were laige
amounts entrusted to Messrs Lake and Lake
by personal and general clients of the firm.
The charges at present formulated against de defendant,

are these ; First, that, being a trustee undet

account ; and, secondly, that, in November,

with two banker’s deposit notes for the sums

to trustees of a Mr Hopkins, he appropriated
the same to his own use. Counsel then pro proceeded
ceeded proceeded to read a letter addressed early in the
present year to Mrs Hopkins, a lady with a
beneficiary interest in the trust, which letter
might be taken as foreshadowing the defence
to be offered to this prosecution, and the effect
of which was that the late Mr George Lake,
defendant’s cousin and partner, was respon responsible
sible responsible for the deficiencies which had been dis disclosed

to put upon the dead man the whole blame of
transactions of which it was impossible to be believe

Once upon a time the disclosure
of such n state of all'airs would have
been sharply criticized in Council
and the probable consequences of the
delay fully and firmly impressed on
the Government. But nous uvoni

tho above statement revealed
what was either nothing more
nor less thin a thaineful and seuous
neglect on tho part of the Agent
General, in so far at least as tho
interest of this colony are concerned
or a total want of efficiency in the
official arrangement* of our Agency
in luJia, yet it did not elicit one single
word of protest from the unofficial
side of the Council Table. It has been
suggested to us, that as the Plsnters
had just received from the Secretary
of State a special " sop” in the shape
of his consent to the transfer of the
Immigration Pensions from the Immi Immigration
gration Immigration Fund to General Revenue,
they thought it prudent to rest
content with the damaging admissions
that had been officially made, and
push the matter no further. We are,
however, inclined to think that the

silence of those most directly interes interested
ted interested was due to Hie conviction that
nothing they could say or do would
have any effect whatever. For, hud

th# proposals ol' the Secretary of
State to amalgamate the Trinidad
Agency with that of Mauritius,
