DECREE No. 1.

Havana, January 2nd, 1908.

The proceedings instituted upon the application
for pardon submitted by Vicente Domine in favor
of his son Angel Domine, accused of the homicide
of Alberto Duany, which occurred in Havana the
morning of the 9th of May, 1904, having been
examined, and
Whereas: It appears from the petition, the
respective cause and other documents that the crime
was committed without malice or premeditation, and
that the accused and the victim had been good
friends up to that time, that the relatives of said
deceased do not appear as parties in the cause and
that at the time of the deed the accused was but
19 years of age, of 'good family and prospects of
entering upon a laudable occupation.
Whereas: His Grace the Bishop of Havana,
Senator Ricardo Dolz, Mr. Pablo Desvernine and
Mr. Antonio S. de Bustamante, Professors of the
accused, and Mr. Leopoldo Berriel, Rector of the
University, .distinctly favor the pardon.
Whereas: The bail deposited by Vicente Domine
to guarantee the appearance of his son at his trial,
was forfeited, by reason of the accused Angel Do-







mine having been declared a fugitive by reason of
said cause.
On the recommendation of the Acting Head of
the Department of Justice,

I RESOLVE:

To grant a total pardon 'to
Angel Domine y Poey,
declaring extinguished the penal action -pending
against him in cause No. 431, 1904, from the Cen-
tral Court, leaving in force the forfeiture of the
bail given to secure the attendance of the accused
Angel Domine at his trial.

DECRETO N.0 1.

Habana, Enero 2 de 1908.

Visto el expedience formado a virtud de la soli-
citud de indulto presentada por Don Vicente Domi-
ne en favor de su 'hisjo Angel Domine, aeusado del
delito de homieidio de Alberto Duany, ocurrido en
la Habana, en la mafiana del 9 de Mayo de 1904.
Resultan-do: que de la solicitud, de la causa
respeeliva y de otros documents aparecen que el
delito fu4 cometido sin malicia ni premeditaci6n, y
que el acusado y la victim habian sido buenus
amigos hasta entonces, que los familiares del inter-
feeto no se muestran parte en la causa y al oeurrir
el hecho solo tenia 19 afios de edad, sienda :d1 buena
familiar y condiciones para emprender una ocupa-
ci6n meritoria.
'Resultando: que se interesan en el indulto ex-
presamente el Elustrisimo Sr. Obispo de la Habana,
el Senador Sr. Ricardo Dolz, el Sr. Pablo Desver-
nine y el Sr. Antonio S. -de Bustamanile, Profeso-
,res del aeusado y el Sr. Leopoldo Berriel, Rector de
la Universidad.
Resultando: que la fianza prestada por Don Vi-
eente Domine para garantir la comparecencia de sa
hijo el dia del juicio oral de la causa, fu6 decomi-







sada por haber sido declarado pr6fugo el referido
Angel Domine con motivo de dieha causa.
A propuesta del. Jefe interino del Departamento
de Justicia,
RESUELVO:

Indultar totahnente A
Angel Domine y Poey,
declarando extinguida la aeci6n penal pendiente
contra el mismo en la causa niimero 431 de 1904
del Juzgado del Centro dejando subsistente el deco-
miso de la fianza prestada para garantir la compa-
rieencia del acusado Angel Domine.

as provided by law for promotions in the Artillery
Corps, and by virtue of the authority vested in
me as Provisional Governor of Cuba, I hereby

RESOLVE :

To promote to the grade of Captain of the
Artillery Corps:
1st Lieutenant Enrique Quifiones y Rojas,
1st Lieutenant Juan Cruz y Bustillos.
To promote to the grade of First Lieutenant
of the Artillery Corps:
2nd Lieutenant Jos6 Maria Lezama y Rodda,
2nd Lieutenant Ernesto N. Tabio y Espinosa,

DECREE No. 4.
Havana, January 3rd, 1908.

Whereas, the important work of repair per-
formed by the Department of Public Works on the
building occupied by the Audieneia, the office of
the Fiscal and other judicial offices of Santa Clara
having been completed, it is necessary to provide
that Audiencia with new furniture, in accordance
with the requirements of its modern installation;
Whereas, the said Audiencia has no library
containing the works of reference necessary for the
disposal of the business of that Court and that of
the other judicial offices jointly installed therewith;
Whereas, the Presiding Judge of the Audien-
cia of Santa Clara requests an appropriation of
$3,472 for furniture and another of $2,000 for
books, both for the use of that Auidiencia;
Therefore, by virtue of the powers vested in
me, and upon the recommendation of the Acting
Head of the Department of Justice,

I RESOLVE:

To grant an appropriation of $3,472 for fur-
niture and another of $2,000 for the purchase of
books, payable out of the surplus funds of the








Treasury, both for the use of the Audiencia of
Santa Clara; which appropriations shall be dis-
bursed by the Presiding Judge of said Court, with
the concurrence of the Department of Justice,
without being subject to the formalities of an
advertisement for bids, inasmuch as a large part of
said effects are to be purchased abroad.

Habana, Enero 3 de 1908.

Por cuanto, terminadas las importantes obras
de.reparaci6n que ha realizado el Departamento de
Obras iPiblicas en el edificio que ocupan la Au-
diencia, Fiscalia y demas oficinas judiceiales de
Santa Clara, es necesario dotar A esa Audiencia de
un nuevo mobiliario de acuerdo .con las exigencias
de su modern. .instalaci6n.
Por euanto, la citada Audiencia carece de una
biblioteea con las obras de consulta indispensables
para el despacho de los asuntos de ese Tribunal y
de las demis oficinas judiciales conjuntamente ins-
taladas.
Por cuanto, el Presidente de la Audiencia de
Santa Clara solicita la concesi6n dte un cr6dito de
$3,472 para muebles y $2,000 para libros, ambos
con destino A esa Audiencia.
Por tanto, en uso de las facultades que me es-
tan cr~feridas, y a propuesta del Jefe interino del
Deparramento de Justicia,

RESUELVO:

Coneeder, con cargo A los sobrantes del Teso-
ro, un er6dito de $3,472 para mobiliario y otro de








$2,000 para la adquisici6n de libros con destino am-
bos A la Audiencia de Santa Clara, ecyos cr6ditos
distribuiri el Presidente de la mi.-ma, de acuerdo
con el Departamento de Justicia, sin sujeci6n a las
formalidades de subasta, dado que una gran parte
de diehos efeetos ha de adquirirse en el extranjero.

On the recommendation of the Acting Head
of the Department of Justice,

I RESOLVE:

Art. I. To approve the application for transfer
of M\r. George Hayworth, a tenographer in the
Of-fice of the Supervisor of the Department of Sta-
te an.! Justice, with Mr. .James Archie Brophy,
a stenographer in the Advisory Commission, such
transfer to date from January 1, 1908.
Art. II. That beginning January 1, 1908, the
following employees of the Advisory Commission
shall receive the salaries indicated:
1. Mr. Juan de Dios Romero, Chief Clerk, two
2. Mir. iSam Houston .Carr, Translator, two
hundred and fifty dollars ($250) per month.
3. M1r. Marcelo IP. Delgado, Translator, one
hundred and sixty six dollars and sixty six cents

Gabriel Roman, Eduardo Cacho Negrete, Pericles
Series, Juan Led6n, John H. Haynes, Pearl Saphro-

each one hundred and sixty six dollars and sixty
six cents ($166.66) per month.
5. Miss Hortensia Xiques, Typewriter, one
hundred and twenty dollars ($120) per month.
6. Mr. Manuel Medina, Mimeographist, sixty
dollars ($60) per month.
7. Messrs. Pablo Ramos and Jose de los Re-
yes, inside messengers, sixty dollars ($60) per
month.
8. Messrs. Guillermo de las Cuevas and Anibal
Quesada, outside messengers, thirty dollars ($30)
each per month.
Art. III. That Messrs. Antonio J. Arazoza,
Juan B. Vermay and Eduardo Col6n, of the Depart-
ment of the Treasury, and Luds Carmona, of the
Department of Government, who have rendered to
the sub-committees on Provincial Law, Miunicipal
Law, and the Laws of Municipal Accounting and
Taxation, important and high grade services of
a special and technical character in the preparation
of projects of legislation with which these sub-com-
mittees were charged, utilizing to this end time
outside of their regular employment, and without
interference with the same, be each remunerated
for said services in the sum of one thousand two
hundred dollars ($1,200) as recommended by said
Advisory Commission.
Art. IV. That the funds necessary to meet the
requirements of this Decree be taken from the
appropriation for the payment of the salaries of
the clerks and employees of the Advisory Com-
mission, in accordance- with the provisions of Ar-
ticle 1 of Decree No. 909 of August 31, 1907.

pense diehos servieies con la suma de mil 'doscien-
tos .pesos ($1.200) segfin lo propone la citada
,Comisi6n 'Consultiva.
Art. IV. Que los fondos necesarios para los
fines de este Deereto, se salisfarin de la asignaci6n
para -pago de sueldos de los oficiales y empleados de
la Comisi6n. de acuer'do con el articulo 1. del De-
ereto nfimero 909 de Agosto 31 de 1907.

Jose Flores Reina y Castillo,
remitting the unexecuted portion of the penalty
imposed upon him by the Audiencia of Santa Cla-
ra, April 3, 1907, in cause No. 392, 1906, of the
Court of said City, taking into consideration the
circumstances attending the commission of the
offense.

1906 del Juzgado de dieha ciudad, teniendo en
cuenta las eireunstaneias que concurrieron en la
eomisi6n del delito.

Having examined the antecedents on file in the
Direction and Inspection of Registration and No-
tarial Offices, and
Whereas: According to the provisions of art.
2 of Orden 112, series of 1900, the creation of
Notarial offices is authorized in every Municipal
District when in the judgment of the Secretary of
Justice the public service requires it, provided the
total number thereof does not exceed one for every
five thousand inhabitants.
Whereas: The increase in the population of the
Municipal District of Holguin, and the interests
of the public service call for the creation of two
additional notarial offices in said District,
On the recommendation of the Acting Head of
the Department of Justice,
I RESOLVE:
To create two notarial offices to be located in
the City of Holguin, appointing Messrs. Manuel
Rodriguez y Fuentes and Francisco Grave de Pe-
ralta y Casanova thereto.

Vistos los antecedentes que existen en la Di-
recei6n A Inspecci6n de los Registros y del Notaria-
do; y
'Considerando: que segfin lo dispuesto en el
art. 2.0 de la Orden 112, de la series de 1900, la
creaei6n de Notarias en cada TUrmino Municipal
estA autorizada cuando A juicio del Secretario de
Justicia lo exija el servicio pfiblico, siempre que el
nfimero total no exceda de una por cada cinco mil
habitantes.
Considerando: que el aumento de la poblaci6n
del Termino Municipal de Holguin y los intereses
del servicio pfiblico aconsejan la creaci6n de dos
nuevas Notarias en dicho Termino.
A propuesta del Jefe interino del Departamen-
to de Justicia,
RESUELVO:
Crear dos Notarias con residencia en la ciudad
de Holguin, nombrando para servirlas a los Sres.
Manuel Rodriguez y Fuentes y Francisco Grave de
Peralta y Casanova.

Upon the recommendation of the Acting Secre-
tary of Finance, and by virtue of the powers vested
in me, I, 'Charles E. Magoon, Provisional 'Governor
of Cuba, do hereby

RESOLVE:

That c e ,m of ($4,450.52) Four thousand
four hundred and fifty dollars and fifty two cents,
be and is hepely appropriated, from any money in
the Treasury not otherwise appropriated, for the
eonetruction of two lodges and installation of
three scales recently purchased by the Custom Hou-
se of Havana, and which shall be located at the
places previously assigned therefore, in acorjance
with the estimate presented by the Department of
Public Works.

in-vestido, Yo, Charles E. Magoon, Gobernador Pro-
visional de Cuba,

RESUELVO:

Consignar como por el present se. eonsigna la
cantidad de cuatro nmil cuatrocientos cineuenta pe-
sos y cincuenta y dos centavos ($4,450.52), para la
construeei6n de dos casillas 4 instalaci6n de tres
bAseulas adquiridas recientemente por la Aduana
de este puerto, y que se coloearAn en los lugares de-
signados al efecto, de acuerdo con el proyeeto pre-
sentado por el Departamento de Obras Puiblicas,
debiendo pagarse dicha cantidad de cualquier fon-
do del Tesoro que no est6 afecto A otras obliga-
eiones.

6th of the Budget in force for Repairs, Extension
and Improvement of State Buildings is nearly
exhausted, and an additional appropriation is
needed to attend to new works necessary in State
Buildings,
On recommendation of the Acting Secretary
of Public Works, .

I HAVE RESOLVED:

'To appropriate and do hereby appropriate the
sum of one hundred thousand dollars ($100,000.00),
or so much of it as may be needed, from any funds
in the Treasury not otherwise appropriated, for
Repairs, Extension and Improvement of State
Buildings and which shall be placed at the disposal
of the Department of Public Works.

tender A nuevas obras necesarias en edificios del
Estado.

HE RESUELTO:"

Conceder y por el present concedo un cr6dito
de cien mil pesos ($100,000.00), 6 la parte que de
61 sea necesaria, de los fondos que haya en Tesore-
ria no afectos A otras obligaciones, para reparacio-
nes, ampliaciones y mejoras de edificios del Esta-
do, y que se pondrA a disposici6n del Dtepartamento
de Obras Pfiblicas.

DECREE No. 13.
Havana, January 6th, 1908.

Whereas the people of Cuba agree with substan-
tial unanimity that the present Penal Code and Code
of Criminal Procedure, both of which were put in
force at an early date when Cuba was a dependency
of Spain, should be reformed and modernized or re-
placed by codes particularly adapted to the present
and prospective needs of the Island;
Whereas the Advisory Commission appointed by
Decree No. 284 of 1906 will be fully occupied for
some time to come with most important laws now un-
der revision, among which is an organic judiciary
law, and with others equally important still to be sub-
mitted to that body for consideration;
Whereas the close relationship existing between
an organic judiciary law and the codes referred to
above renders a simultaneous revision of the organic
law and of such codes advisable;
Whereas the valuable services being rendered by
the Advisory Commission now in existence suggest
the employment of a similar agency for additional
tasks of like nature; and
Whereas the nature of the codes to be revised
demands an intimate and practical knowledge of law
in general and of criminal law and procedure in par-
ticular;
Terefore, availing myself of the powers vested
in me,








I DECREE:


That a Commission to be composed of Messrs.
Antonio Govin y Torres. Presiding Judge of the Cri-
minal Chamber of the Supreme Court; Jose I. Tra-
vieso y L6pez, Fiscal of said Court; Arturo Hevia y
Diaz, Associate Justice of the Audiencia of Havana;
Drs. Jos6 A. GonzAlez Lanuza, Ricardo Dolz y Aran-
go and Jos6 A. del Cueto y Pazos, Professors in the
National University, and Mr. Manuel Landa y Gon-
zalez, Acting Head of the Department of Justice,
submit a report to the Government regarding the re-
forms, amendments or substitutions urgently neces-
sary in the Penal Code and in the Law of Criminal
Procedure in force; it being understood that ,this Com-
mission shall not receive any salary or compensation
whatsoever for its work from the State, inasmuch as
the gentlemen mentioned receive such salaries by
virtue of their official positions; and the Commission
shall meet in the offices of the Department of Justice
and elect its President and Secretary.
When the 'Commission shall have concluded
its labors wilh respect to either of the projects
submitted to its consideration, it shall prepare a
report transmitting its plan and the project of law,
presenting it to the Department of Justice for sub-
mission to the Congress of the Republic of Cuba as
soon as it shall legally reassemble, but if it should
conclude either of said projects before the Provision-
al Administration of the government of the Republic
shall have concluded its services, them the projects
and reports shall be submitted to the Provisional
Governor, in order that he may exercise the legisla-
tive powers vested in him as the benefits and urgency
of the measures proposed may counsel or require.

DECRETO N.0 13.
Habana, 6 de Enero de 1908.

Por euanto, el pueblo en general de Cuba, con-
viene sustancialmente en que el actual C6digo Penal
y la Ley de Enjuiciamiento Criminal puestos en vi-
gor en 6poca muy antigua, cuando Cuba era una de-
pendencia de Espafia, deben ser reformados y modi-
ficados 6 sustituidos por C6digos especialmente adap-
tados h las necesidades presents y en perspective de
esta Isla;
Por cuanto, la Comisi6n Consultiva nombrada
por Decreto nfimero 284 de 1906, continuarA comple-
tamente ocupada por algfin tiempo en leyes de la ma-
yor trascendencia, actualmente en revision, entire las
cuales se halla la Ley OrgAnica Judicial y otras de
igual importancia que tambi6n serAn sometidas h la
consideraci6n de ese Cuerpo;
Por cuanto, la estrecha relaci6n que existe entire
una Ley Organica Judicial y los C6digos referidos, in-
dica la conveniencia de una revision simultAnea de
dicha Ley y los citados C6digos;
Por cuanto, los valiosos servicios que esta pres-
tando la actual Comisi6n Consultiva sugieren el em-
pleo de un organismo igual para trabajos adicionales
de la misma indole; y
Por cuanto, la naturaleza de los C6digos que han
de revisarse, demanda un conocimiento intimo y pre-
tico de la Ley en general y particularmente del C6-
digo Penal y de la Ley de Enjuiciamiento Criminal.








Por tanto, en uso 'de las faeultades que me estin
conferidas,
DECRETO

Que una Comisi6n que formarin los sefiores An-
tonio Govin y Torres, Presidente de la Sala de lo Cri-
minal del Tribunal Supremo; Jos6 I. Travieso y L6-
pez, Fiscal de dicho Tribunal; Arturo Hevia y Diaz,
Magistrado de la Audiencia de la Habana; los doc-
tores Jos6 A. Gonzklez Lanuza, Ricardo Dolz y Aran-
go y Jos6 A. del Cueto y Pazos, Catedraticos de la
Universidad Nacional, y el senior Manuel Landa y
Gonzalez, Jefe interino del Departamento de Justicia,
informed al Gobierno sobre las reforms, modificacio-
nes 6 sustituciones que se necesiten con urgencia en
el C6digo Penal y en la Ley de Enjuiciamiento Cri-
minal vigentes; entendi6ndose que esta Comisi6n no
disfrutarA por sus funciones, sueldo ni retribuci6n de
ninguna clase, por parte del Estado, puesto que los
tienen asignados los sefiores mencionados por los car-
gos oficiales que desempefian; debiendo reunirse en
la Oficina del Departamento de Justicia, y eligiendo
el President y el Secretario de aqu'lla.
Cuando la Comisi6n haya concluido sus trabajos
respect A alguno de los proyecetos que A su conside-
raci6n se somete, debera redactar un informed trans-
mitiendo su plan y el proyecto de Ley, y presentarlo
al Departamento de Justicia para que lo someta al
Congress de la Repfiblica de Cuba tan pronto come
el Congress se reuna ,de nuevo legalmente, pero si
concluyere alguno de dichos proyectos antes que la
Administraci6n Provisional del Gobierno de la Repfi-
blica haya terminado sus servicios, entonces los pro-
yeetos 6 informes serAn sometidos al Gobernador Pro-
visional, para que ejerza la facultad legislative que
corresponde segfin los beneficios y urgeneia que las
medidas propuestas puedan aconsejarlo 6 exigirlo.

DECREE NO. 14.
Havana, January 6th, 1908.

By virtue of the powers vested in me, and as
Provisional Governor,

I RESOLVE:

1.-That there shall be, in addition to the pres-
ent personnel thereof, in the Rural Guard of the
Armed Forces of Cuba a First Lieutenant and As-
sistant Surgeon, with the same pay and allowances
as now provided for by law for the First Lieutenant
and Assistant Surgeon of the Artillery Corps, Armed
Forces of Cuba.
2.-That Jose Navarro is hereby appointed First
Lieutenant and Assisitant Surgeon of the Rural
Guard, Armed Forces of Cuba, with rank and pay
from the late of this Decree.

Habana, 6 de Enero de 1908.

En uso de las facultades que me estin conferi-
das como Gobernador Provisional de Cuba,

RESUELVO:

1.-Que ademis del personal existente en la
actualidad, haya en la Guardia Rural de las Fuer-
zas Armadas de Cuba una plaza de Primer Teniente
Medico Auxiliar con el mismo haber y asignaciones
de que de acuerdo con la ley disfruta el Primer Te-
niente Medico Auxiliar del Cuerpo de Artilleria,
Fuerzas Armadas de Cuba.
2.-Queda por el present nombrado el senior
Jos6 Navarro para dicha plaza de Primer Teniente
M6dico Auxiliar de la Guardia Rural, Fuerzas Ar-
madas, con grade y haberes como tal a partir de la
fecha de este Deereto.

Whereas: the reasons which appear in said pro-
ceedings, as stated below, justify the extension of
clemency,
On the recommendation of the Acting Head of
the Department of Justice,

I RESOLVE:

To grant a total pardon to
Antonio Peldez y Guardado,
Indalecio Arana y Sabal,
Manuel Cabanas y Rivas,
Antonio Ugarte y Sarria, and
Lucas L6pez Seoanes,
remitting the unexecuted portion of the penalties
imposed upon them by the Audiencia of Matanzas,
October 19, 1907, in cause No. 149, 1906, of the court
of said City, including the accessory penalties, tak-







ing into consideration the circumstances attending
the commission of the offense.

las penas que les impuso la Audiencia de Matanzas en
19 de Octubre de 1907 en causa No. 149, 1906, del
Juzgado de dicha ciudad, ineluyendo las accesorias








impuestas, teniendo en cuenta 'las circunstanceias que
concurrieron en la comisi6n del delito.

In view of the necessity of re-distributing the
prisoners in the cAreeles of the Republic, in order 'to
avoid crowding in some of them and to utilize the
space available in others, and to improve the
hygienic condition,
On the recommendation of the Acting Secretary
of 'Government,

I HEREBY RESOLVE:

1st.-That the Department of Government is
authorized for the present to fix from time to time
the number of prisoners which each eircel is to contain,
and to transfer prisoners from one to another. The
expenses of transfer will be paid from Section 3rd of
the General Budget, from the article entitled Gastos

3rd-In view of the fact that many eArceles are
not provided with beds, bed clothing and clothing
for prisoners, the sum of $50,000 is hereby appro-
priated from any available balances in the Putblic
Treasury, the Secretary of Government being
authorized to buy and distribute these supplies in
the manner he deems necessary.
4th-'The sum of $5,000 is also appropriated
from any available balances in the Public Treasury,
to provide the necessary cleaning material for the
cerce'les, this credit to be employed exclusively in
the purchase of paint, white-wash, brushes, pearline,
brooms, buckets, paint brushes and polishing cloth.

En vista de la necesidad que hay de hacer una
distribuci6n de press en las chrceles de la Repfbli-
ca, en forma que evite la aglomeraci6n en algunas de
ellas, utilizando el mayor espacio disponible en otras,
y con el objeto, ademins, de mejorar la condici6n hi-
gienica de Ulas mismas,
A propuesta del Secretario interino de Goberna-
ci6n,
RESUELVO:

1.~-Por el present queda autorizada la Secre-
taria de Gobernaci6n para fijar, cu'ando lo estime
convenient, el nfimero de press que deba contener
cada clrcel, disponiendo lbs traslados de aquellos de
unas A otras.-Los gastos de estas traslaciones se pa-
garAn con cargo al epigrafe "Gastos adicionales de
los Establecimientos Penales, 1908.-Conducci6n de
press y penados."-Seeci6n 3.a de los Presupuestos
generals.
2.o-Por consecuencia de los cambios que habrdn
de ocurrir, con motivo de do dispuesto en este De-
creto, en los gastos asignados a las chrceles por con-
cepto de "Material" y "Subsistencia", los presu-
puestos de las mismas quedan modificados en la forma

3.-En atenci6n que muchas earceles se en-
cuentran desprovistas de camas, ropas de cama y
equipos para press, se concede por el present para
esta atenci6n, un cr6dito de cineuenta mil pesos
($50,000) con cargo A los sobrantes disponibles del
Tesoro Pfiblico; quedando la Secretaria de Goberna-
ci6n autorizada para comprar y distribuir dichos
efectos en la forma que estime necesaria.
4.-Se concede asimismo un cr4dito de cinco
mill pesos ($5,000) con cargo A fondos disponibles
del Tesoro Pfiblico, para tender A la limpieza de las
careles que la necesiten, cuyo credito se emplearA
exclusivamente en pintura, leehada, cepillos, perlina,
escobas, cubos, brochas y frazadas.

DECREE No. 21.
Havana, January 6th, 1908.

Upon the recommendation of the Acting Secre-
tary of Public Instruction and by virtue of the pow-
ers vested in me as Prcvisional Governor of Cuba,

I HEREBY RESOLVE:

That Article 2 Decree No. 1320, dated December
31, 1907, and published in the Official Gazette on
January 2, 1908, is amended to read as follows:
"Article 2.-The examination of each candidate
shall last not less than two days, as follows:
First day. Oral examination, not to exceed one
hour in duration, as to the candidate's ability to de-
termine the physical properties of drugs, chemicals
and pharmaceutical preparations, used in the practice
of medicine, the purity of the same and familiarity
with the apparatus, instruments and utensils used in
the practice of pharmacy.
Upon finishing this examination, the candidate
shall answer in writing five questions of a practical
nature with reference to prescriptions, being al-
lowed two hours for the written examination.
Second day. Examination by the Board as to
the candidate's ability to make up preparations ac-
cording to the Spanish Pharmacopea, Seventh Edi-








tion, 1905; to recognize drugs or chemical products
in ordinary use, as presented to him; and to fill four
medical prescriptions with explanation of the steps
taken. This part of the examination will be oral and
practical, and for the same the candidate may be al-
lowed the amount of time deemed necessary by the
Board. Not less than four members of the Board
will be present at all meetings".

Habana, 6 de Enero de 1908.

A propuesta del Secretario interino de Instruc-
ci6n Pfiblica, y en uso de las facultades que me estin
conferidas como Gobernador Provisional de Cuba,,

RESUELVO:

Que el Articulo 2 del Decreto n6mero 1.320, de
fecha 31 de Diciembre de 1907 y publicado en la GA-
CETA OFICIAL del 2 de Enero de 1908, se entienda re-
dactado como sigue:
"Articulo 2. Los exAmenes de cada aspirante no
duraran menos de dos dias, en la forma siguiente:
Primer dia. Examen oral por el Tribunal, que
no excederA de una hora de dnraci6n, respect A la ha-
bilidad del aspirante para determinar las propieda-
des fisicas de las drogas, products quimicos y pre-
parados farmae6uticos que se emplean en medicine;
la pureza de los mismos y su familiarizaci6n con los
aiparatos, instruments y utensilios que se usan en el
ejercieio de la farmacia.
Terminado este ejericio, el aspirante contestarA
por escrito cinco preguntas de naturaleza prAetica
sobre las recetas y prescripeiones, concedi6ndosele dos
horas para el ejercieio escrito.
Segundo dia. Examen por el Tribunal respect








A la habilidad del aspirante para hacer preparados, de
acuerdo co. la Farmacopea Espafiola, S6ptima Edi-
ei6n de 1905; para conocer las drogas y products
quimicos de uso ordinario que le sean presentados, y
para la preparaci6n de cuatro formulas 6 recetas, ex-
plicando las distintas manipulaciones. Esta parte
del examen sera oral y prcetica, y para ello se conce-
dera al examinando el tiempo que el Tribunal consi-
dere necesario. Cuatro miembros del Tribunal de
ExAmenes, por l1o menos, tendran que concurrir A to-
dos los ejercieios".

Havana, January 8th, 1908.

Whereas: the Aldvisory Commission has recom-
mended the promulgation of a Decree ,providing that
sentences imposed prior to 'lhe year 1899 for political
offenses shall not be cause of 'disqualification for
discharge of public office, nor for considering accused
persons as second offenders in the 'Court of Justice;
Whereas what is proposed as aforesaid has been
observed in practice in t'he majority of cases, and
should properly have the sanction of law;
In aecoridanee with the recommendation of the
Advisory Commission, I, .Charles E. 'Magoon, by
virtue of the powers vested in me as Provisional
Governor of Cuba,

RESOLVE:

I. That there shall not be considered as cause
for disqualification for discharge of public office
sentences imposed prior to the year 1899 for political
offenses, or imlpose.d in cases in which the persons
convicted were pardoned as a consequence of the
Agreements and Treaties of Peace made in the
years 1878, 1898 and 1899 and which concluded
the Wars of Inidependence.
II. That the said sentences of conviction shall







not be considered in the Courts of Justiee as giving
rise to the aggravating circumstance of being a second
offender in case of the prosecution of persons so
convicted.

Por eiuanto la Comisi6n Consultiva ha propuesto
la promulgaci6i de un iDeereto disponiendo que las
sentencias impuestas eon anterioridad al afio de
1899 por delitos politicos no sean causa de inhabili-
taci6n para el desempefio de cargos pilblicos, ni para
la apreciaei6n de reincidencia por los Tribunales de
Justieia;
Por euanto lo antes propuesto ha venido obser-
vAndose en ila prictica en la mayor parte .de los
casos, y es convenient 'que tenga la sanci6n legal;
De acuerdo con lo propuesto por la Comisi6n
Consultiva. yo, Chal1es E. Magoon, en uso de las
facultades de que eatoy- investido como Gobernador
Provisional de Cuba,

RESUELVO:

I. Que no sean consideradas como causa de
inhabidita.ei6n para el desemipefio de cargo piiblieos
las sen~encias impuestas con anterioridad al afio de
1899 por delitos politicos, 6 en causes en las cuales
los eonideniados fueron indultaidos oomo consecuencia
de los Convenios y los Tratados de Paz celebrados
en los afios de 1878, 1898 y 1899, que pusieron ter-
mino '- las guerras de Independeneia.







II. Que dicehas sentencias 'condenatorias tam-
,poeo puedan servir A los Tribunales de Justicia para
apreciar, en su caso, la agravante de reincildencia.

DECREE No. 26.
Havana, January 7th, 1908.

Having examined the records of proceedings
instituted ipor the purpose of legalizing the telepho-
ne system of the Fire Department of Surgidero de
Bataban6; and
Whereas: in accordance with the statement
furnished by the above mentioned fire Department
to the Director Generall of Commnunications and
transcribed by the latter in a communication dated
September 22. 1907, the aforesaid system consists
of twenty two sets of apparatus. eight of which are
owned by that Department and the remainder to
the private establishments and offices wherein they
are installed, some of -which are at such a short
.distance from, fire headquarters as to be almost
contiguous thereto: and
Whereas: although the system was established
with the object of furnishing a fire alarm service,
according to a report submitted by the Municipal
Mayor of Bataban6, the Fire Department receives
a small 'remuneration from the proprietors of the
houses having telephones for their private use as
well as to give fire alarms when necessary; and
Whereas: in order to render the service for
which 'Ihe establishment of the system ,was intended,
the bunching of stations or apparatus in certain








streets of the town is unnecessary, nor is it neces-
sary to put them up in the vicinity of the head-
quarters of the Department; and
Whereas: the use of said apparatus in private
natters as well as receiving sums of money for the
use of same would deprive the system of the peculiar
nature which justified its installation and which
should be taken into consideration in permitting
it to continue in operation;
Upon the recommendation of the Alcting Seere-
tary of Government,

I HEREBY RESOLVE:

,To declare legalized the telephone system belong-
ing to the Fire Department at Surgidero de Bata-
ban6, on condition that all stations or apparatus
existing within 300 meters of Fire Headquarters
as well as those not owned by the Department be
abolished; that ino charge be made or sums of money
received for the use of those remaining or may in
future be installed; that the use thereof shall be
limited to Ifire alarms and, lastly, that the above
mentioned Fire Department strictly and promptly
complies with all the orders issued by the Govern-
ment with respect to the system whether they tend
to modify the entire system or part thereof or its
complete abolishment.

DECRETO N.0 26.
Habana, 7 de *Enero de 1908.

Visto el extpediente instruido para la legaliza-
ci6n de la Red Telef6nica dell 'Cuerpo de Bomberos
del Surgidero de Bataban6; y
Resultando: que conforme A la relaci6n sumi-
nistrada por dicho Cuerpo a la Direeei6n General
de Comuniceaciones y reproducida por &sta A la Se-
cretaria de iGobernaci6n con escrito de 23 'de Sep-
tiembre de 1907, la mencionada Red consta de vein-
tid6s alparaitos, ocho de los euales ,perteneeen A
aiquel Cuerpo y los .restantes a los estableeimientos
y oficinas particulares en que se encuentran insta-
tlados, estando various de elilos a tan corta distancia
del Cuartel de Bomberos que casi quedan inme-
diatos;
Resultando: que aunque la Red se estableci6
para el servicio de alarmas de incendio, el Cuerpo
de Bomberos, por lo que expresa un informe del
AIealde Miuneipal de Bataban6, pereibe una m6dica
retribuei6n de los duefios de las casas en que estin
situados los aparatos y que los usan para asuntos
particullares ademis de dar avisos en los easos de in-
cendio;
Considerando: que para la iprestaci6n del servi-
cio que fu6 causa del estab'leci-miento de la Red, no
es necesaria la aglomeraci6n de estaciones 6 apara-









tos en determinadas calles del pueblo, ni es precise
colocarlos en las inmediaciones del Cuartel de Bom-
beros;
'Considerando: que el empleo .de dichos apara-
tos en asuntos particulares, asi como 0l percibo de
cantidades por el uso de los mismos, quitarian A la
Red el especial earecter que justifica su instailarci6n
y que ha de tenerse en cuenta para permitir que
continfie funcionando;
A propuesta ,del Secretario interino de Gober-
nacio6n,
HE RESUELTO:

Declarar legalizada la Red Telef,6nica del Cuer-
po de Bomberos Idel .Surgidero de Bataban6, A con-
dici&n de que se supriman todas las estaeiones 6
aparatos situados A menos ide 300 metros del Cuar-
tel de Bomberos 6 de otros aparatos, asi como los
que no sean propiedad de dieho Cuerpo; que no se
cobren ni admitan cantidades por el uso de los que
queden instalados 6 se instalen en lo sucesivo; que
ese uso se limited 4 dar avisos en .caso de incendio y,
por fiultimo, que el repetido Cuerpo cumpla exacta
y prontamente cuantas 6rdenes se dicten por el Go-
bierno respect A la Red, ya tiendan A procurar
que se modifque en todo 16 en parte, ya tiendan A
su complete supresi6n.

munications to convert the 'Post Office at Palos, in
the Province of Havana, into a Local Office of
Communications, assigning thereto a Chief and a
Messenger at a yearly salary of six hundred dol-
"airs ($600.00) aand one hundred and twenty dol-
lars ($120.00), 'respectively; to be paid out of
the allotment at present -made to the position of
Postmaster at that point, and three hundred and
sixty dollars ($360.00) to be 1aken from the surplus
funds existing in the Department under the head-
ing of Personnel.

caciones la Administraci6n de 'COrreos de Palos,
Provincia de la Habana, dotindola con una plaza
de Jefe y otra de Mensajero, cuyos sueldos anua-
les serAn de seiseientos pesos ($600.00) y ciento
veinte pesos ($120.00) respectivamente, y se abo-
narAn con el imported de lo asignado actualmente al
cargo de Administrador de Correos de aquel ipunto,
mins trescientos sesenta pesos ($360.00) que se toma-
rAn de los sobrantes que resulten por eoncepto de
Personal en el Departamento.

DECREE No. 28.
Havana, January 8th, 1908.

Whereas the Ayuntamiento of Havana on motion
dated November 9, 1907, and made by the Mayor,
President of the same, resolved on the 12th of the
same month to prepare a special budget showing as
receipts the sums to be collected during the present
fiscal tear as uncollected from previous budgets, and
the advances of $360,836.17 and $26.931.68, to b-.
made by the State, and as expenditures in the first
place, the payment of $541,251.25 which the Ayunta-
miiento 'has ,agreed to pay as the price of reversion
to the City of Havana of the concession held by
Messrs. Bautista & Martinez to supply water to the
wards of Vedado and 'Carmelo; and also the salaries
of 100 third class watchmen and 100 City guards to
be added to the Municipal Police force, the equip-
ment of these men and 50 'horses for the same:
Whereas by Decree of November 23, amplified
by Decree of November 25, this Government ap-
proved and-authorized the preparation of the special
budget for the present fiscal year which had been
resolved upon the Ayuntamiento of Havana, and
authorized a loan of $26,931.68 to cover the deficit
which might result in the expenses of the police force,
the money loaned to be applied only in ease the Mayor
of Havana should deem it necessary and to be deliv-







ered in six equal amounts from the 31st of January,
1908, to August 30 of the same year; and the Ayun-
tamiento to make return of the same in the next fiscal
year of 1908-1909; and to make return of the
$360,836.17 advanced for the payment of the two-
thirds part of the reversion to that municipality of
the concession now held by Messrs. Bautista & Mar-
tinez, in ten equal installments during the years
1909-1910 to 1918-1919, both inclusive;
Whereas by Decree of the 20th of December,
1907, published in the Official Gazette of the 21st,
the Ayuntamiento of Havana was authorized to pay
the third part of the price of the concession for the
supplying of water to the wards of Vedado and Car-
melo with funds to be furnished by the Municipality
immediately after the signing of said Decree, and
without ,prejudice to subsequent steps for the ap-
proval of the special budget for the present fiscal
year;
Whereas the Treasurer of the Ayuntamieaito of
Havana has prepared the draft of said special budget
resolved upon at the session of said Ayuntamiento
held on the 12th of November, 1907;
Whereas according to said resolution the Ayun-
tamiento aforesaid is to reimburse the State during
the next fiscal year of 1908-1909 the sums advanced,
in case the Mayor of Havana should deem such ad-
vances necessary, for the payment- of the salaries to
be due by reason of the increase in the police force;
and in ten years beginning with 1909-1910 and ending
1918-1919, the sum advanced to pay one-third of the
price of the reversion of the concession held by
Messrs. Bautista & Martinez for the supplying of
water to the wards of Vedado and Carmelo; and
whereas Article 4 of the Royal Decree of January 1,
1883, made extensive to Cuba by Royal Order of
July 31, 1884, provides, in order that Ayuntamiento
may burden more than one budget with payments
arising out of a contract, that the time and amounts







fixed for such payments shall be previously approved
by the Municipal Board; and whereas the Municipal
Board of Havana was twice summoned to convene,
first on December 20 and again on December 27, to
report upon the special budget of the present fiscal
year and has been unable to meet for want of a
quorum;
Whereas as was declared by Decree of December
20th, 1907, the acquisition of the concession for sup-
plying water to the wards of Vedado and Carmelo is
a matter of imperative necessity for the city and it is
desirable that it be terminated as soon as may be,
without waiting for the proceedings for the approval
of the special budget, and such acquisition once effec-
ted it is indispensable that the Ayuntamiento shall
incur the expenses of collecting the revenue there-
from, emplVoying the necessary personnel;
Whereas the increase in the police force approved
by the Supervisor of same is also urgent and such
increase should be made immediately without waiting
for the proceedings incident to the budget, especially
when this delay is caused by the negligence of the
Municipal Board which, though twice summoned to
meet, has failed to do so by reason of lack of a legal
(fuirmn;
By virtue of the powers vested in me as
Provisional Governor of Cuba,

I RESOLVE:

1.-To revoke in this special case of the Spe-
cial Budget of the present fiscal year of 1907-
1908, Article 4 of the Royal Decree of January
4. 1883, made applicable to this Island by Royal
Order of July 31, 1884.
2.-To confirm the authorizations granted to
the Municipality of Havana by my Decree No.
1259 of December 20th, 1907, published in the
Official Gazette of the 21st of the same month.








3.-To authorize the Ayuntamiento of Havana
to incur the expenses and employ the personnel
necessary to collect the revenue arising out of the
supplying of water to Vedado and Carmelo and
fix and -pay the salaries of such personnel, without
prejudice to the approval of the special budget
and before such approval becomes effective.
4.-With the same reservation and without
waiting for the proceedings yet pending incident
to said budget, to authorize the Ayuntamiento to
make the increase of the 200 men in the police
force of the city, to pay the salaries of the in-
creased personnel and to acquire the equipment
and horses provided for in the special Budget, no
bids being ne-essary for this purpose in view of
the urgency of the case.
The Acting Secretaries of the Departments of
Government and the Treasury are hereby charged
with the execution of the present Decree.

Por cuanto el Ayuntamiento de la Habana A
mioci6n del Alca'Ide Presiderte del mismo, feeha
nueve de Noviembre de 1907, acord6 en doee del
propio mes former un Presupuesto extraordinario
en que figuraran en concerto de ingresos las sumas
que como results -de presupuestos anteriores debe-
rAn recaudarse en el actual ejereicio, y los antici-
pos ide $360,836.17 y de $26.931.68 que el Esta-
do deberia hacerle; y como gastos, en primer t&r-
mino, el pago de $541.251.25 que el mismo Ayun-
tamiento ha convenido en pagar como !precio de
la reversion A la Ciudad de ila Habana de la con-
cesi,6n que disfrntan los Sres. Bautista y Martinez
para abasteeer de agua a- los barrios del Vedado y
Carmelo; y el haber de 100 vigilantes de tereera
y 100 guardias urbanos con que ha -de aumentarse
el Cuerpo de 'Policia Municipal, el equipo de esa
fuerza y cineuenta caballos para la misma.
Por cuanto por Deereto de veinte y tres del
citado. Noviembre aclarado por el de veinte y cin-
co del mismo mes, este Gobierno aprob6 y autoriz6
la formaci6n del Presupuesto extraordinario para
el present ejercieio acordado por el Ayuntamiento
de la Habana y autoriz6 el prestamo de $26,931.68
para cubrir el d6fieit que result en los gastos de







la fuerza de Policia, 'debiendo apli-arse el dinero
asi prestado s6lo en el caso de que el Alcalde de
la ,Ciudad de ]a Habana lo estime necesario, y rea-
lizarse el prestamo en seis entregas iguales desde
treinta y uno de Enero de mil novecientos ocho a
t'reinta de Junio del :propio ailo; y el Ayuntamien-
to de la HIabana realizar la devoluci6n en el pr6-
ximo ejereicio de 1908 A 1909 y dela de los $360,836.17
que se le anticipan ,para el ,pago 'de las dos terce-
ras parted de la reversion al mismo, de la conce-
si6n que disfrutan los Sres. Bautista y Martinez,
en diez plazos iguales en los afios de 1909 a 1910
A 1918 'A 1919. ambos inelusives.
Por enanto por Deereto de veinte de Diciem-
bre de 1907 publicado en la GACETA del veinte y
uno, se autoriz6 al Ayuntamiento de la Habana
pars pagar 'la terlera parte del preeio de la eon-
cesi6n del abasto de agua A los barrios del Veda-
do y Carmelo que ha -de satisfacerse con fondos
Munieipales inrnediatamente despu6s de firmado ese
De2reto. y sin perjuirio de los tramites posteriores
para la aproba.i6n del presupuesto extraordinario
dell corriente ejereicio.
Por cuanto el Tesorero del Ayuntamiento de
la Habana ha formado el .proyeeto de ese presu-
puesto extraordinario a-ordado en la sesi6n del
meneionado Ayuntamiento, celebrada el 'doce de No-
viembre de 1907.
Por euanto segfn ese a'uerdo el Ayuntamiento
eitado ha de reintegrar al Estado en el pr6ximo
eje'reicio de 1908 A 1909 lo que le anticipe, raso de
estimarse neeesario por el Alcalde de la Ciudad,
para el pago de los haberes del aumento que se ha
a.ordado introduneir en el 'Cuerpo de Policia; y en
diez afios. eomenzando en el de 1909 A 1910 y ter-
minanjo en el de 1918 A 1919. la-suma que se le
anticipe para satisfacer la tereera parte del prelio
de la reversi6n de la coneesi6n que disfrutan los
Sres. Bautista y Ma.rtinez para abastecer de agua







A los barrios del Veduado y Ca:rmelo. y que el ar-
ticulo 4. del Real Decreto de 4 de Enero de 1883
hecho extensive a esta Isla por la R. 0. de 31 de
Julio de 1884 exije para que los Ayuntamientos
puedan gravar mfs de un presupuesto con pagos
procedentes de un contrato que la 6poca y canti-
dades en que se fijan esos pagos sean aprobados
previamente por ia Junta Municipal, y que convo-
cada la de la Habana por dos ve-es en los dias 20
y 27 de Diciembre para informar sobre el Presu-
puesto extraordinario del actual ejercieio no ha po-
dido reunirse por falta de quorum.
Por cuanto segfin se declar6 en el Decreto de
20 te Diciembre de 1907 la adquisici6n en la con-
eesi6n del abastecimiento de agua de los barrios del
Vedado y Carmelo es asunto de suma importaneia
para la Ciudad y es convenient que quede con-
cluida A la mayor brevedad sin esperar el cumrpli-
miento de los tr.imites para la aproba-i6n del pre-
supuesto extraordinario, y que realizada esa adqui-
siei6n es indispensable que el Ayuntamiento realice
los gastos que exije la recaudaei6n 'de los pro-
ductos de la misma empleando en ese trabajo el
personal ad-hoc.
Por cuanto es tambi6n de verdadera urgencia
la organization del aumento acordado por el Ayun-
tamiento al Cuerpo de Policia que ha sido aprobado
por la Supervisi6n del Cuerpo, y que no debe retar-
darse esa organizaci6n por los tramites del presu-
puesto, maxime euando la demora que 6sta sufre
se debe A la negligencia de la Junta Municipal que
citada por dos veces no se ha reunido por falta del
quorum legal.
En virtud de las faeultades de que estoy inves-
tido como Gobernador Provisional de Cuba,

RESUELVO:
1.--Derogar por esta vez y para el solo caso
del Presupuesto extraordinario del actual ejereicio







de 1907 h 1908 el articulo 4. del R. D. de euatro
de Enero de 1883 aplicado k esta Isla por R. 0. de
31 de Julio de 1894.
2.-.onfirmar las autorizaciones concedidas
al Municipio de la Habana por mi Decreto nime-
ro 1259, de 20 de Diciembre de 1907, publicado en
la GACETA de 21 del propio mes.
3.--Autorizar al Ayuntamiento de la Habana
para realizar los gastos y emplear el personal ne-
cesario para la recaudaci6n de los products del
abastecimiento de agua del Vedado y Carmelo y fijar
y satisfacer los haberes de ese personal sin perjui-
cio de la aprobaci6n del presupuesto extraordinario,
y antes ;de que 6sta reeaiga.
4.-OPara que con la misma reserve y sin que
sea necesario esperar los trAmites ain no cumplidos
de ese Presupuesto aumente las doscientas plazas
acorda-das del Cuerpo de Policia de la Ciudad, pa-
gue los haberes del personal aumentado y adquiera
los equipos y caballos, cuya adquisici6n se include
en el Presupuesto ex'traordinario, prescindiendo pa-
ra estas adquisieiones de toda subasta, dada la ur-
geneia del caso.
Los Seeretarios interinos de los Departamentos
de Gobernaei6n y Hacienda quedan encargados de
la ejecuci6n del present Decreto.

Whereas the amounts heretofore appropriated
toward the construction of the roads from Vifiales
to Esperanza, Pinar del Rio to Luis Lazo, Luis
Lazo to Guane and Cabafias to Bahia Honda in
Pinar del Rio Province. are about to be exhausted.
On the recommendation of the Acting Seere-
tary of Public Works,

I HAVE RESOLVED:

To appropriate the sum of two hundred and seven-

mril seiseientos pesos ($272,600.00), para eontinuar
la eonstrueei6n de diehas Carreteras, que se distri-
buirn segain las necesidades de cada una, A condi-

Havana, January 10th, 1908.


Whereas: The Advisory Commission includes
in the project of the Judiciary Organic Law the
creation of a 'Correctional Court in the City of
Santiago de Cuba;
Whereas: The Presiding Judge of the Audien-
cia of Oriente has repeatedly requested and stated
the urgent need of such a creation, upon the
-ground of the large amount of work which the
Judge of Examination is required to do, which
Judge discharges the functions of a Correctional
Judge also;
Therefore, in accordance with the recommenda-
tion of the Acting Head of the Department of
Justice,
I RESOLVE:

To create in the 'City of Santiago de 'Cuba,
Province of Oriente, a Correctional Court of the
second class, with the following personnel and
salaries:








,One Judge. $ 2,500
One Secretary. ,, 1,200
One 'Clerk. ...,, 720
One Copyist. ...,, 480
One Bailiff. ,, 300
One Conserje and cleaner. ,, 240

This Court shall take cognizance of the mat-
ters of which the Judge of Examination is now
taking cognizance as a Correctional Judge, and the
archives, books and other documents relating
thereto shall be transferred to it.

Por (nanto. la Comisi6n Consultiva include en
el Proyecto de Ley Org.inica del Poder Judicial
la creaci6n de un Juzgado Correccional en la 'Ciu-
dad de Santiago de Cuba;
Por cuanto. el Presidente de la Audieneia de
Oriente ha solicitado constantemente, y con ca-
ricter urgente, la referida creaci6n, fundAndose pa-
ra ell en el cimulo de atenciones que pesan sobre
el Juiz de Instrueci6n de aquella 'Ciudad, quien A
la vez tiene A su cargo las funciones correccionales.
Por tanto, de acuerdo con la recomendaci6n
del Jefe interino del Departamento de Justicia.


RESUELVO :

Crear en la ciudad de Santiago de Cuba, Pro-
vincia de Oriente, un Juzgado Correccional de se-
gunda clase, con el personal y asignaciones anua-
les siguientes:

against him in cause No. 508. 1906. instituted
against 'him in the Eastern Court of Examination,
taking into consideration that his co-defendants
were totally pardoned by Decrees Nos. 1146 and
1193 of 1907.

declarando extinguida la aeei6n penal pendiente
en la causa que se le sigue en el Juzgado de Ins-
trucci6n del Este con el nwmero 508-906, teniendo
en cuenta que sus comipafieros de causa fueron in-
dultados totalmente por Decretos nimeros 1146 y
1193 de 1907.

Clara en 21 de Junio de 1903 en la causa nimero
51 del propio afio del Juzgado ide ,Sagua la Grande,
teniendo en cuenta las eircunstaneias que eoncurrie-
ron en la comisi6n del delito.
