U .T , Board declines reviewing city's boatlift codes BY BETH FEINSTEIN-BARTL Waterfront News Writer Members of Fort Lauderdale's marine advisory board declined a request made earlier this summer to review and suggest possible changes to existing codes that regulate installing boatlifts at waterfront homes. Board members voted 6-4 against taking further action on the matter, which limits how far the lifts can extend into a waterway. If the board had decided to move forward, city commissioners would have had final approval over any revisions. The issue could be raised again, but Norbert McLaughlin, a marine advisory board member, doesn't expect it to be anytime in the near future. "It could return, if there is more interest in the commu- nity," said McLaughlin, who favors a review. "It's dead in the water right now." The request to revisit the city's current code was made in June by John Terrill, marine advisory board chairman. He cited present restrictions forcing some property owners to take out their docks if they want to be granted a permit for the device. "Based on what I've seen, it's not a fair playing field con- ceming homeowners who want to install boat lifts," Terrill said. 'I think the evidence is clear that Fort Lauderdale has more restrictive boatlift rules than any other municipality in South Florida, and we're the yachting capital of the world." Terrill isn't the first board member to raise concerns. In Swim School New class is geared to people with disabilities. Please see accompanying story on page 3. 2000, the marine advisory board asked Fort Lauderdale City Commissioners to hire a consultant to review boatlift codes. Their request was denied due to lack of funds. A study by city staffers was conducted instead, with a recommendation that the codes should be rewritten. But the report didn't specify whether the rules should be loosened or tightened. Since then, nothing has been done. After years of no action, Terrill said he felt the matter deserved to be reconsidered. One of the main points that proponents of a review would like to discuss is whether a boat on a lift is the same as a boat in the water. Under the existing rules, boatlifts can extend out either 10 percent of the width of the waterway, or 20 feet - whichever is less. He never dreamed that, years later, his artwork. would hang inside the facility. "It's a really cool place," said Kelly, who attended middle school while living in the neighboring community of Longboat Key. "To me, it's an honor to have my sculptures there." Kelly, who now resides in Hollywood, donated a dozen of his whimsical, papier-mach6 sea creatures in late May to Mote. The private, nonprofit research organization focuses on marine science and is world renowned for its studies of sharks, skates and rays. Kelly's works include a seven-foot-long dolphin, a six- foot-long manta ray and 10 sharks ranging from four to nine feet in length. The sculptures are on permanent display inside the facility's aquarium, which is open year-round to the pub- lic on Mote's 10.5-acre campus. David Niebuhr, vice president of the education division at Mote, said Kelly's sculptures have proved to be crowd pleasers. "DiVitto Kelly has been a great friend of our lab," Niebuhr said. "His sculptures introduce people to the world of marine life in new and exciting ways." Kelly's sea creatures are like nothing anyone will ever see swimming in the ocean. "I thought I would be a little different and just go crazy with the colors," said Kelly, who credits Florida's tropical cli- mate as his inspiration. Kelly said he approached officials at the research labo- ratory about donating some of his works after conducting several art classes there. He held a papier-mach6 workshop for children when he dropped off the works. Kelly returned to the campus on June 25 to donate another sculpture, an 11-foot-long shark. Rather than give the facility a finished piece, this time around the fish was paint- ed by dozens of children, Kelly said. "I was very impressed," he said. "They did a terrific job." Kelly, a native of Cincinnati, Ohio, has been doing papi- er-mfch6 marine sculptures for 10 years. Along with Mote, n tropical sea life he has donated his works to other places including the International Game Fish Association & Fishing Hall of Fane Museum in Dania Beach and libraries in Key West, Captiva Island, Key Largo and Islamorada. Kelly crafted his first sculpture while working at an art gallery owned by his mother-in-law in Stirling, NJ. "The gallery sold different art supplies and I began to experiment with a papier-mach6 mix," Kelly said. "I made this little shark and thought it was kind of neat." Kelly began making more sculptures using papier- mich6 when he and his wife, Andrea, moved to South Florida in 1996. Two years later, Kelly had his first exhibit at a local library, which led to more shows and teaching work- shops to children around the state. He's since sold several of his pieces, ranging from $75 to $500. His wife, Andrea Kelly, is also an artist and an art teacher at the Little Flower Catholic School in Hollywood. Andrea Kelly specializes in mixed media, papier-mach6 and watercolors. The couple's works are on display at the Ansu Gallery, owned by Kelly's mother-in-law, Susana Lopez. The gallery relocated in 2002 from New Jersey to downtown Hollywood. Kelly's creations aren't limited to marine life. His other sculptures have included three Florida panthers, a giant slice of key lime pie and a strawberry frosted pop tart. But sharks remain his favorite subject. If that isn't worth staying up all night for, what is? A newcomer to the busy sched- ule of southeast Florida tournament fishing is being organized around the notion that its rewards; are irre- sistible, even if the cash prizes can't compare with those posted by big- Arnold Markowitz bucks billfish contests. Thus the Dusk to Dawn Swordfish Tournament, scheduled for Aug. 26-28 at the Westrec Hall of Fame Marina in Fort Lauderdale. It is sponsored by A Child Is Missing, the non-profit alert program with a mass calling system able to place 1,000 phone calls a minute in an area where a missing child or eld- erly person was last reported seen. ACIM will receive $200 from each fishing team's $500 entry fee. After expenses, the rest of that money will be put in the prize pool $10,000 if there are 50 entries with 50 per- cent awarded for the heaviest fish, 30 percent for the next heaviest and 20 percent for the third. The tournament director is Kaytee Moran, community relations director for A Child Is Missing. She has been involved in sailing regattas, but is producing her first fish- ing tournament. That can be a daunting job, fraught with big and little things that can go wrong, but Moran has been dazzled by offers of cooperation and the generosity of commercial sponsors, eager to sign on and pitch in with goods and serv- ices, facilities and favors. "I'm so overwhelmed with the things that have been donated, that I thought I would have to pay for out of my own pocket," Moran said in mid-July. "I'll go into a tackle store to ask for help and someone else will be there and tell me he wants to help too. "We'll have a big silent auction. So many cool gifts have been donated. In late July, there was a list of 15 supporting sponsors including big names like West Marine, Bertram Yachts, Allied Marine Group, Pompanette (the marine accessories manufacturer), Marlin magazine and the Maroone auto sales chain. Maroone is offering a $20,000 bonus prize to any con- testant who catches a swordfish bigger than the Florida state record, 612 pounds, 12 ounces. Other than the Hall of Fame marina where the tourna- ment will have its headquarters, event hosts are the Bahia Cabana beach resort and marina where a kickoff party, the silent auction and a swordfishing seminar will be held, and the Swimming Hall of Fame for the tournament breakfast, raffles and presentation of awards. The new competition's best human asset may be the biggest and best-known fisherman in the territory - Bouncer Smith, the charter captain and offshore guru whose involvement confers instant credibility and stature. Smith, one of two widely recognized local experts on swordfishing (Capt. Rick Peeples is the other), will give the Friday evening seminar. Swordfishing is a specialized sport, typically using deep-sunk squid for bait and illuminating it with submersion lights that emit a green glow sort of a 'go' signal to the fish. They are nearly always caught in the middle of the night when proper people are either home in bed or carous- ing in after-hours gin joints. Fishing from dusk to dawn can strain human endurance, even on a weekend, so it is important to be comfortable and so, as tournaments go, the rules of this one are not tight fitting. There are no authorized hook styles, no bait restrictions, no limits on the breaking strength of lines and leaders, as long as they aren't in the water any sooner than 8 p.m. on Saturday night and are out of the water by 5 a.m. Sunday. The only limitation for the fish is that they have to be at least 55 inches long to qualify for weighing. Moran is planning a release category and issuing cameras to teams that prefer to release the fish they catch, even though releases will qualify only for trophies, not for cash prizes. She purposely kept the format informal rather than adopt one with a lot of strict rules too intense. 'Some of the guys call it 'jungle rules,' Moran said. "I don't care how many people are on a boat. It doesn't matter what size the hooks are or what kind of bait you use - whatever works, whatever you're comfortable with. "It's a fund-raiser. I want people to come and fish for a good cause. He will outfish you, that's what. In this case, that's good. The Waterfront News led Doug Reaney, a non-fisherman, to expect a great day's fishing on the freshwater canals of Miami-Dade County, and it's nice to say he got it thanks to guide Alan Zaremba. Last winter Reaney filled out a reader survey ques- tionnaire for the Waterfront News, entered it in a prize drawing and won a day on the water with the fishing writer. That is I. We finally got together in mid-July. In the picture, he's the one in the big hat. Zaremba saw an upside: Reaney wouldn't have glued-down ways of his own, cherished as if he had invented them. He would listen to advice and follow it. Zaremba picked him up at home on a Sunday. Driving south, he explained the value and challenge of fishing with artificial lures no live bait and had Reaney's dormant skills pretty well figured out by the time we met at Antonio Maceo Park's launch ramp on Northwest Seventh Street in Miami. On the guide's bass boat, we headed south down a canal alongside the Palmetto Expressway, made a couple of turns and motored into Hidden Lake, which is aptly named because it's hard to find. Zaremba shut down his big engine and engaged his quiet electric trolling motor. We were going to fish the shoreline at close range, almost a standing broad jump to the rocky embankments. Peacocks nest there in cave-like hidey holes. There's also some cement block rubble from long-ago bulkhead construction, another fish favorite in bedding season. We found them pretty steadily too, hiding under the outfall pipes of swimming pools. "They're either bedding or guarding their young," Zaremba told us. The fish wouldn't rise to the surface to bite a lure, but they would attack if it were bounced close to the nest. It wasn't a time for long casting, sight unseen. We'd see the fish, show them our lures and provoke them to pounce... Zaremba set Doug up with a short, stout Falcon spin- ning rod and a Quantum reel spooled'with a line of braid- ed microfilament. Then he taught him the easily-learned pitching cast, perfect for close-range fishing and narrow waters: you let line out about halfway down the length of the rod, point at your target, swing the lure once or twice like a pendulum and then flip it softly forward. After all, who among the ranks of pleasure boaters doesn't dream of setting off on open water, free to travel wherever they please? But it's that very freedom that tends to get in the way of the dream. Those who actually attempt to sail whenever and wherever they want face challenges, for even boats are subject to public and private restrictions on their comings and goings, except possibly on the high seas. The right of where to moor or anchor once reaching a desired location is increasingly being debated as cities with ocean access try to manage their water- front and sub-surface bottoms. Such cities are citing concerns about sanitation, environment, safety, econom- ics and aesthetics, leading many to begin regulating offshore anchorage within their jurisdictions. Many recreational boaters don't believe municipalities have the authority to regulate a boater's "right to anchor." As romantic as this notion may be, it is not totally accurate. In the case law I've reviewed, the courts recognize that within the limits of their territories, states generally have concurrent jurisdiction with the federal government on the waterways. Does this mean that municipalities can control anchorage in offshore areas under their jurisdiction? Well, first we'd have to look at what state statutes have to say on the matter. In Florida, the statutory chapter that governs navigation in the state, Section 327.60(2), states: "Nothing contained in the provisions of this section shall be construed to pro- hibit local governmental authorities from the enactment or enforcement of regula- tions which prohibit or restrict the moor- ing or anchoring of floating structures or live-aboard vessels within their jurisdic- tions. However, local governmental authorities are prohibited from regulating the anchorage of non-live-aboard vessels engaged in the exercise of rights of navi- gation." "A-ha!" the adventurous boater might exclaim, "So, who exactly fits within the description of 'floating struc- tures' and 'liveaboards?"' Well, the state is referring to struc- tures that basically stay in one place and have no means of propulsion. And, under the statute, a liveaboard vessel is any ves- sel used solely as a residence, or any ves- sel represented as a place of business, a professional or other commercial enter- prise, or a legal residence. "A-ha!," that same adventurous boater might exclaim, "So if I bring my boat down to an offshore basin, anchor there, and don't use it as a place of busi- ness; and if I sail away every few months or years, and have a legal residence somewhere else, a city shouldn't be able to tell me where to anchor, and I should be able to stay there for a good, long time, right?" Well, romantic friends, this observa- tion may or may not be the eventual interpretation. It may be premature to view these state statutes as a slam-dunk for the right to anchor. Not to mention that if a vessel stays in one place for a rather long time, might it not be taking up room and infringing on the rights of another vessel that actu- ally is in transit? A vessel that just requires anchorage for a few days as it takes on provisions for the next leg of its voyage? So far, case law does not seem to be very informative on the anchorage issue. However, in light of the recent Supreme Court's ruling on eminent domain, which puts the economic needs of the community ahead of the indi- vidual's property rights, I would not be too certain to safe- ly say when or where anyone might have the right to anchor in the future. HAWKINS \Waterfront News Writer The Jack Nelson Swim School at the Fort Lauderdale Aquatic Complex is starting its first water program for peo- ple with disabilities. Its goal is to improve their physical and emotional health. "We're excited about this because we know what swim- ming will do in building self confidence and new skills for those with physical challenges," said Dan Vawter, Nelson's marketing director and head swim instructor. "And we know from working in the past with persons of special needs that once they gain skills in the physical area, they will grow in other areas such as communication skills." Samantha Marcum, Nelson's community outreach coor- dinator and one of a dozen swim coaches who works out daily with seniors and kids as young as three months old, explained how a 77-year-old grandmother has become a reg- ular swimmer after suffering a paralyzing stroke. "She's gained new confidence in regaining some of her motor skills by using water as part of a physical therapy pro- gram," she said. The school's new Aquabilities class will reach out to people of all ages with disabilities of all kinds. Classes begin Aug. 15 as part of an expanding program under the school's new agreement with the City of Fort Lauderdale. Earlier this year, the city awarded a bid to Nelson to continue as the Fort Lauderdale Aquatic Complex's official swimming school. "We're thrilled to continue to offer comprehensive aquatic instruction to people of all ages and abilities on a year-round basis," said Mary Nelson Jackson, school director and daughter of the school's founder. Jack Nelson began coaching swimmers 50 years ago at the former Casino Pool on Fort Lauderdale Beach after gain- ing fame as an Olympic games swimming champion and three-time world record holder. Later, he coached college teams as well as teams for the Olympic, World and Pan American Games. He's the only person in U.S. swimming who has been both an Olympic swimmer and Olympic coach. When the city built the Aquatics Complex 30 years ago, Jack Nelson established his swimming school at the center and has been expanding it ever since. Last year, the school taught more than 8,000 people how to swim. On average, it costs $100 to $150 to take one of the swimming classes. Jack Nelson, who lives in Fort Lauderdale, officially retired from coaching last November, leaving his daughter, Mary, to take over the school's management. He is still involved but spends more time enjoying his six children and 14 grandchildren. "When I came to Fort Lauderdale in 1950, I started out as a beach lifeguard and worked my way up," said Jack Nelson. He recalled seeing the Fort Lauderdale Swim Team working out at the old Casino pool and "got hooked" on help- ing others swim better. "I feel very fortunate to have had so many people help me along the way and was glad to share whatever skills I had in helping to coach others," he said. "With water playing such a part of so many families in the Fort Lauderdale area, we wgnt to help promote water safety for everyone," she said. The Baby & Me classes for mothers and their tod- dlers fills up fast, Vawter said. The classes are limited to only eight moms and their kids to allow for more person- al attention. Vawter said Nelson's motto of "Access To Success is Thru the Mind" continues to be the driving philosophy behind all the school's swim programs. "All of our staff always offers a positive approach so we make each class fun and exciting so people want to learn and enjoy the process." The school has taught several generations of local resi- dents, like Marilyn Carlisle, who took classes as a youth and now has her two sons, ages 5 and 8, in the program. "My boys are both in advanced classes now and are into competitive swimming and doing well," said Carlisle. She credits Nelson's "caring.instructors" and their personal atten- tion with making the difference in helping her two sons become better swimmers. The city's police force, which requires officers to be cer- tified in swimming at least 50 yards with their clothes on, has also seen a number of its members go through the school. "We realize that this area offers water everywhere for swimming and we believe that water safety is most important," said 'aj\M ter, noting that the school works with yacht clubs and groups in developing specialized swimming programs. As part of its new agreement with the city, the school will create more water safety programs including a South Florida Water Safety Day in which the school will net- work with others in promoting community education on the subject. Later, Doug and Alan would laugh about how often Doug forgot that. Soon he was remembering most of the time. "That's pretty good," Zaremba said after a few pitch- es. "You're picking it up faster than some of them do." Each of us had a lure in the water all Rat-L-Traps, a good peacock lure with one set of hooks near the front and a spinner at the tail. Zaremba hooked up first and swapped rods with Reaney, who reeled in a small peacock without difficulty. Reaney's pitching technique improved from accept- able to fairly good to consistently accurate. Zaremba and I admired his ability, to put his lure right where Zaremba said to put it. "It's all just geometry," Doug said with a laugh. Better yet, he started hooking fish himself and kept Alan busy unhooking them. He went through a stretch of about seven catches before a fish threw the hooks and got away prematurely. "Over there," Zaremba would say. "No, a little more to the left. There. Good shot. Try it again." "Good, good," Zaremba said each time Doug tried, tried again. "Good, good. Slow it down. Pop it around. Pop, pop, pop. Pop it. Pop. Pop." At last the fish listened and took a pop at Doug's lure. He set the hook. He stood up. He played it and landed it. Zaremba weighed it. "Two and-a-quarter pounds," he announced. A Florida fisheries website reports the all-tackle state record is three and-a-half- pounds. He only lost three hooked fish all day, didn't let those bother him and showed us the confidence of a much more seasoned fisherman. "It was a matter of re-learning what's required," he told us. "There are certain things, when you learn them as a kid, that you never forget but there are techniques you don't remember or know, like keeping the rod pointed to where you want to go. Forgetting to open the bail when I cast that's the most embarrassing." Zaremba said he shouldn't be einbarrassed. "You get in a hurry and you forget. That's something you do when you're in a hurry. CI 0 M Aft From grizzlies to glaciers, Alaskan river run is wild BY ARNOLD MARKOWITZ Waterfront News Writer Scenes from a 132-mile run down the Tatshenshini and Alsek rivers: Dalton Post, Yukon We're getting ready to launch five rubber rafts on one of Planet Earth's most spectacular and remote wild river runs, the Tatshenshini and Alsek, when five of our bunch on their way to the john meet a grizzly bear crossing the trail, left to right. It was 100 to 150 feet ahead, by a hurried guess. A big one. "He stopped and looked at us. He seemed curious," said Roberto Kohen. "We ran, of course." Our camp kit includes several cans of bear-repellent pepper spray. The labels say to snap off the orange safety clip and aim at the bear's face. Wait 'til he's so close you can't miss and make absolutely sure the bear is downwind of you. Now zap, let him have it, right up the nose. Cruel, yes, but it's you or the bear. Alsek Lake, Alaska Here are icebergs. If your boat hits one, you'll be okay. You're on a rubber raft, not the Titanic. The lake is nearly surrounded by glaciers, breaking off bergs. If you're right there at the wrong time and one hits your raft, you probably won't be okay. Little bergs break off big ones, which get soft and crumbly with age, like Gorgonzola. "One almost hit you," Lucas Coleon told me excited- ly as our 15 adventurers secured our rafts to a rocky beach. "It broke off just as you passed it. Didn't you see it?" Nope. Campsites are sur- rounded by river, mountain and glacier vistas that are to understate the case mighty nigh stupefying. That vision embodies a Tat-Alsek phenomenon called S.O.S., for sensory overload syndrome. Just when you think you're getting used to zebra-striped mountainsides drizzled with marshmallow snow, to glaciers that seem to have formed a herd, to endless pointy peaks and ridges resembling sharks' teeth afloat on clouds, to bald eagles as common as pigeons are back in the city ... well, then you float around a bend to the left and behold a vision of nature so intense, you can't stand it. Average people are stricken wordless. The eloquent are likely to mumble, "Oh, wow. Geez. Holy (pick a short word)." It's a sight--felt lucky to see once in a lifetime. Now I've seen it twice. Tatshenshini-Alsek is just one element of the largest collection of contiguous national parks and protected wilderness areas in the world, 24,196,063 acres in Canada and the U.S. It looks even bigger from the river. The river itself is a challenge, though not a whitewa- ter classic with technical rapids that can toss and spin a raft-full of people as a pizza chef whirls his dough. The challenge is its powerful flow, typically 100,000 cubic feet per second in summer and occasionally much more when a glacier far up a tributary cracks open and spits out a hid- den lake. Glacial silt colors the water a monochromatic gray- brown, making currents hard to read. Wind ripples the sur- face, imitating shoals on deep water. It's big, a mile wide in some places. There is one section of important rapids, a canyon run that you hit on the first day. Depending on water level and flow speed, the rapids can give you anything from a bumpy ride to a hazardous one with turbulence rated up to class four on a scale of one to six. Occasionally, rafts are tipped over and people are forced to swim. No, not us. The river zigzags past cliff walls, requiring upper- body power and good timing by the oarsmen. One of our people, Philip Cook, has a new inflatable kayak, the wrong boat for this river. The rapids flip him out and he loses his paddle about 20 minutes after launching. Rick Cava, oarsman on one of the rafts, grabs him. Rick has troubles of his own. His raft leaks air. His tent leaks rain. The raft leak, in a pressure relief valve with a frazzled gasket, softens the self-bailing floor, letting water in, not out. This makes the raft harder to control. Every time we stop, we pump. Rick leaps from his oar seat, grabbing at a branch and at Lucas. We holler again. They release the tree just in time, snatching at hand-grabs on the raft to avoid falling overboard. A little way downstream, we find a better campsite and try to remember what else we omitted from the pre- launch safety meeting. There are two ways to run the Tat-Alsek: with a com- mercial outfitter (15 companies are authorized by Canadian and U.S. park services) and our way do-it- yourself. Your choice will be determined by your group's size, experience, organizational skill and the time you can spare to prepare. It will be influenced by whether you're able to pay a lot or a little. I checked out three long-established commercial oper- ations. Based on their listed prices for 2005, you should figure on spending about $3,500 a person for an eight to 10-day river trip. That does not include airplane and ferry fares to staging sites in Alaska or Yukon. Spending that much money, you won't have to work. You may want to wield a paddle, if only to stay warm. Five other members of their family are with us this time. I became part of their network of extreme outdoor partners the first time they ran the Tat-Alsek. We rendezvous in Juneau and ride the fast ferry Fairweather up the Lynn Canal to Haines. If you ever took an Alaska cruise to Skagway, you passed Haines on the way. There we rented our rafts, field kitchen and other gear from Nels Niemi, an independent outfitter. We bought food at the IGA market and a salmon store. The cost, not counting our already-paid plane and ferry fares: $780 per person, or 22.2 percent of what a commercial outfitter would have charged us. I suspected a mistake. I reminded Rob, who did the accounting, that for eight of us back in '98, the same trip cost $935 each. No mistake, though. "I'm surprised as well," he said. "I guess it's an example of economies of scale." It makes me eager to go back and do it again.
