Classifieds O 0 Commentary w Event Calendar u- Galley - Tide Tables - Efforts stepped up to inform foreign vessels of USCG law Enforcement now enacted on 96-hour ANOA By BETH FEINSTEIN-BARTL Waterfront News Writer Local marine industry leaders are working on educating boat owners about a ruling being enforced by the U.S. Coast Guard, requiring that certain types of vessels entering American waters from a foreign port give a 96-Hour Advance Notice of Arrival. The regulation affects foreign-flagged commercial and recreational vessels and U.S.-flagged commercial vessels. United States-flagged recreational boats are exempt, said Susan Engle, president of EnviroCare Inc., a consulting firm in Fort Lauderdale working with the U.S. Coast Guard and the Marine Industries Association of South Florida to dis- seminate information on the 96-hour ANOA requirements. Although the regulation is not new, the U.S. Coast Guard has recently begun enforcing the law in conjunction with increased security requirements established by the Homeland Security Regulations, Engle said. Engle estimates that 95 percent of mega-yachts coming to South Florida ports are foreign-flagged, but she doesn't view the ruling as affecting tourism or the area's marine industry. Because much of the mega-yacht business is seasonal, the association is focusing on getting out information before the boats arrive here in the winter, she said. Already, there have been requests from yacht brokers and yacht management companies for assistance in forward- ing information on the ANOA regulations to their clients, Engle said. Marine industry officials are relieved that U.S.-flagged recreation boat owners aren't included in the regulation. "It would have been cumbersome on the U.S. Coast Guard to monitor that," Engle said. "And it would have been inconve- nient for local boaters." U.S. Coast Guard Capt. Jim Watson said U.S.-flagged recreational vessels were excluded because those boats were considered to be "the least concern from a risk perspective." "We try to balance the inconvenience on the public, plus the level of effort it might take on the part of the gov- ernment, and compare that to the benefits to reducing risks," Watson said." rJi1 =If^FI Judge upholds Everglades rule on phosphorous measurement By CORALIE CARLSON Associated Press Writer MIAMI (AP) An administrative law judge in late June upheld technical rules for how to measure phosphorous in the Everglades, a key part of overseeing the cleanup of the massive ecosystem required by a 1992 court agreement. The rules which spell out how much phosphorus is acceptable in the Everglades and how to measure it - must next be approved by the U.S. Environmental Protection Agency. Judge David Maloney upheld the 215-page rule that was adopted last year by a state commission, rejecting chal- lenges by Miccosukee Indians and an environmental group. Coincidentally, the tribe sued the EPA in federal court that same day, alleging the-federal agency acted improperly when it failed to review Florida's 2003 Everglades Forever Act when it became law, said Dexter Lehtinen, attorney for the Miccosukees. The EPA decided to wait until the state had approved the rules needed to apply the law, he said. The EPA did not return messages left after hours. The rules upheld give key directions to carry out the $8.4 billion, 30-year restoration projects, including a provi- sion that sets the acceptable amount of phosphorous in the Everglades at 10 parts per billion, about one-sixth of what it is in some bottled drinking waters. "Today's ruling by the administrative law judge upholds the first numeric phosphorus water quality standard for theEverglades," Gov. Jeb Bush said in a statement. "The stringent, science-based standard combined with the com- prehensive cleanup plan already underway will restore water quality throughout the famed River of Grass." Others disagree with the 10 parts per billion level. Several environmental groups and the Miccosukees say the number is too low; U.S. Sugar representatives think the number is too high. "There were parts we clearly disagreed with, but I think on balance it's another step forward in trying to restore the Everglades," said Robert Coker, senior vice president of public affairs for U.S. Sugar. Despite initial objections-to the rules, Audubon of Florida and several other environmental groups dropped their challenges in November after coming to an agreement with state environment officials, said Charles Lee, director of advocacy for Audubon of Florida. The rules also determine how to account for variability in different parts of the Everglades and how to calculate for natural changes in measurements caused by taking readings at different times. "The reaction has been unbelievable," said Russ Gagliano, who is organizing a series of car shows this sum- mer on Hollywood Beach's oceanfront Broadwalk. "Most of these guys are used to showing off their cars in parking lots." The non-competitive shows, called Cruise Night on the Broadwalk, are open to anyone with a car or truck dated prior to 1974. There is no charge to display the vehicle, said Gagliano,- curator of the Fort Lauderdale Antique Car Museum at 1527 SW First Ave. in Fort Lauderdale. Some 60 owners attended the first show on June 11. Entries included antique, vintage, hot rods, kustom, muscle and race cars such as a.1951 Merkury Kustom, a 1956 Buick Convertible, a 1970 Chevelle, a 1972 Nova Pro Street and a 1940 Willys with Supercharger, Gagliano said. There will be two more shows, from 7 to 10 p.m. on July 9 and Aug. 13. Around 100 vehicles are expected to be displayed at the event on July 9, Gagliano said. A competition with trophies will be held on Aug. 29 at the Hollywood Beach Community Redevelopment' Agency's annual clam bake. Broadwalk FridayFest series, said Judy Erickson, marketing and events manager for the Hollywood Beach CRA. The cars are displayed along the Broadwalk, in the bicy- cle lanes between Michigan and Indiana streets. The evening's festivities include live music at the Hollywood Beach Theater bandshell, at Johnson Street and the Broadwalk. The Dave Camp Band, a New Orleans jazz and blues outfit, will entertain the crowds on July 9. The Five Boroughs, a 50s band, will perform on Aug. 13. Both nights will also feature 50s music duo, Bruce Wynn and Frank Lynch, playing at Garfield Street and the Broadwalk. A disc jockey, Dr. Detroit, will spin tunes at Indiana Street and the Broadwalk. Organizers were pleased that Cruise Night has gotten off to'a good start. "The people displaying the cars loved the oceanfront ambiance," Erickson said. "It's a very social, very fun evening for everyone." On a national level, he may never overtake good old Smoky the Bear, but he's way past icons in the ilk of, say, the San Diego Chicken. His modest beginnings trace back to a school ecology club project that inspired Jennifer Sevin, a Miami Beach High student disturbed by trash floating in a canal across from the school. Pretty soon, Sevin was taking her anti-pollution message to elementary schools in Miami Beach. Next she began pro- ducing pamphlets subsidized by the U.S. Coast Guard. Her publisher -who also happens to be her mom - educational publisher Elaine Sevin thought something was missing. "I need a cartoon character," she said. Jennifer Sevin's brother, Scott, came through and sketched a Florida game fish dressed in a police cap and badge. Officer Snook was bor in 1993-94. Ten years later, the character is still swimming strong. His crusade against water pollution has been adopted and sponsored by corporations and government agencies, most notably the U.S. Coast Guard, which also sends Jennifer and Elaine Sevin around the country to train marine safety officers in pollution control issues and public outreach. They estimate they've taught 2,000 Coast Guard people and that their school presentations reach 66,000 kids. So even if youidon't know Officer Snook, chances are good that he's traveled in the book bags of your school- age children, stirring up support for clean water, both fresh and salty. Here he is, leading a circle of sign-bearing sea creatures, "shark, octopus, turtle, seahorse, dolphin, snapper, gull" in an anti-pollution demonstration. Over there, "battling the Pollution Monster, scourge of the environment, personification of villainy. At the bottom of a bay, Officer Snook examines a very sick crab near an indus- trial outfall and bursts into doggerel: "Dangerous chemicals often leak; our underwater hospitals grow by the week." For something that began so modestly, Officer Snook's fast growth seems remarkable. Help Officer Snook" Stop Water Pollution Officer Snook, hatched 11 years ago as a Miami Beach schoolgirl's ecology club project, is still swimming strong as a partner of pollution. Soon after a new federal anti-pollution law required the Coast Guard to start a public outreach program, mother and daughter brought Officer Snook to Cmdr. Matt "M.S." Dillon's office in Miami. "They wanted us to support it and to fund some of their publications that could be handed out at education sessions, boat shows and more," Dillon remembers. 'This sort of fit into that mandate and it seemed like a reasonable thing to do. It filled the bill'.' Another kid might have wrapped it up right there, added it to her college applications, and gone on to other interests. Jennifer Sevin didn't. The high school senior spent part of each Friday giving Officer Snook presenta- tions at elementary schools. Her dedication didn't surprise her mother. "She'd bring home frogs. We'd have hundreds of frogs in the house. When she saw drying puddles with tadpoles in them, she'd run a hose from our house to the gutter so the tad- poles wouldn't die." The Sevins' partnership with the Coast Guard was so successful that soon they were invited to give water pollution training talks to Coast Guard reserves. Jennifer spoke while Elaine flipped slides. "They saw how good she was," said Dillon who's now retired from the Coast Guard and serves on the board of direc- tors for Youth Environmental Programs Inc., Sevin's nonprof- it outfit. "They needed someone to train the trainers, and they picked her to do it." Why send a 17-year old kid with no credentials around the country to train 300 marine safety officers? "Have you met Jennifer? That answers you right back," says Dillon. "Her intensity is pretty significant. I think it's fair to say that had a lot to do with it." Indeed, at boat shows where Officer Snook has a booth, it's hard to just grab a pamphlet and slip away. Jennifer Sevin hooks you, nets you, lands you. Released, you leave vowing to never spit in the ocean again. Those are pleasant encounters. "Sevin is charming and enthusiastic, passionate about pollution though not visibly zealous but you wouldn't want her to see you dropping trash out on the parking lot," Dillon said. Officer Snook changed Jennifer's direction in life. In high school she had planned to teach disabled children, but once a student at Florida International University, she switched to environmental science instead. Last year she earned a master's degree in zoology at North Carolina State. She now works fulltime in Washington D.C. as education and training coordinator for the Smithsonian-.Institution's National Zoo. Though she lives a long distance from Officer Snook's headquarters, her involvement hasn't diminished much. I Keep rod and reel handy when traveling local roads By ARNOLD MARKOWITZ Waterfront News Writer If you're stuck in traffic, go fishing. Why not, as long as you're not getting anywhere any- way? You know those canals and ponds you pass almost every day? Take a closer look next time you're backed up on the Palmetto Expressway or Route 836 in Miami- Dade, 1-595 or Flamingo Road in Broward, 1-95 and U.S. 1 just about everywhere. What's that you see on theater's surface? Splash rings. Who makes those? Largemouth bass. Butterfly pea- cock. Grass carp, a feistier fighter than you'd suppose. All sorts of exotics Mayan cichlids, red Midas, blue tilapia, jaguar guapote, you name it. "Koi, too," said Tony Fowler, a new friend I fished with near Miami International Airport. Ahoy who? "Koi'too," Tony repeated, spelling it and impressing me with his command of Asian languages. "I swear." So what if you only fish saltwater? Don't be a snob. There are snook, even tarpon Tony showed me photos of his catches in the lakes near the airport, and some swim from there into the Tamiami Canal network. Much of that runs alongside the Tamiami Trail, and branch canals zigzag through off-trail residential neighborhoods. So what if you're on your way to work or school when you pass by? It wouldn't be proper to play hooky. Instead, wake up and be on your way an hour earlier than usual or tarry on the way home. Unless you're strictly an offshore troller, you proba- bly have the rods and reels you'll need. Casting or spin- ning, anything from ultralight to medium heavy action, will do if it fits in your car. A flyrod's nice in places where there's room for a backcast. If you're fastidious, add a fish-grabbing glove and a longnose hook remover. Bait's not needed, just a few artificial lures. Remember you're doing this to ease into the workday in a good frame of mind or break the tension of a busy day aggravated by rush-hour traffic, not to catch a trophy or feed the family. One of my best experiences of this type took place in June at the Cutler Drain canal, behind The Falls shopping File photo Waterfront News fishing columnist Arnold Markowitz always keeps his fishing equipment handy for opportune moments. center in Miami-Dade. Nothing had gone well with that day's work until I blew it off and tossed a plug toward a splash ring halfway across the water. I hooked a little grass carp. Close to my feet, a small butterfly peacock watched the catch and the release, like a front-row spectator. I flipped the lure past the fish, quick-reeled it in and the fish bit. Then I caught another grass carp. Next I noticed some shady palms downstream, walked over there, tossed the lure and caught a largemouth bass. In scarcely 20 minutes, a lousy day became a good one. I've never seen tarpon or snook in that canal, but it drains into Biscayne Bay so I wouldn't be surprised to hear of them there. Fishing most casually, I've hooked tar- pon as far inland in Miami-Dade as Krome Avenue (Southwest 177th Avenue), and at the Pine Island Ridge apartments west of University Drive in Davie. I've seen hefty ones rolling at the surface where a branch of the Tamiami canal runs wide beside the Palmetto, just south of Route 836. You can pull over there, near the exit ramp, with ample room off the pavement, and whip a lure onto the water while other drivers going no place snicker derisive- ly until a big one mistakes itself for a pelican. Keep that tarpon on your hook for a few takeoff jumps, and the crowd on the road belongs to you. Right, you've never seen anyone fishing there. If you saw one guy one time, that might have been me. I'm sel- dom on the Palmetto or any of the other roads mentioned without a rod and reel or two aboard my pickup. I don't always have time to stop, but when I have it, I do it. Even if there's no time to fish, I often swing off my route to investigate waters that I pass or cross, so I'll know if I want to go back when I do have time. I favor canals that have wide access areas along the banks. In most places, those were established by the South Florida Water Management District or as easements for electric power lines. There aren't any signs saying "Private Property - Keep Out," but that's all right. Fish there anyway. I find those places with the help of a good street map. Rand McNally's maps of Metro Miami and Fort Lauderdale are my favorites because they trace the canals in scale (not just a fine blue line) and you can see whether a street crosses a canal or dead-ends there. The maps don't point out public lands, but they're easy to locate. My newest favorite is the canal that runs alongside Flamingo Road's southbound lanes, near C.B. Smith Park in western Broward County. I finally tried fishing it while running an errand in April. As soon as I parked, I noticed a rock cavern near the surface. A big largemouth emerged and swam away. Ten minutes later I looked again and it was back. And five minutes after that I lifted it out of the water, unhooked and turned it loose: a five-pounder, easy. Considering all the industrial, commercial and resi- dential growth in that area, it's surprising how good the fishing can be. Since that day of the big bass, every time I've stopped by that canal a different place each time - I've seen largemouth, peacock, small exotics and garfish, everything except other people fishing. For one, he lament- ed the end of the era when sailors could be flogged and keelhauled, as he thought such things were part of a simpler and better time. This brings to mind the reprint of the 1879 book, "The Seaman's Friend" by Richard Henry Dana, Jr. You might recall that Mr. Dana was the author of the mar- itime classic, 'Two Years Before The Mast," a semi-autobiography of life at sea when America's merchant sailing ships were the pride of the nation. What youmay not know is that Dana also became a high- ly successful admiralty attorney who helped establish a large Boston law firm that still bears his name today. In "The Seaman's Friend," Dana offers a pragmatic treatise for 19th century merchant mariners at sea, and intriguingly it actually contains a section devoted to maritime legal matters. I found this section to be quite instructive. On the whole, it confirmed my historical perspective that maritime law has remained remarkably consistent through the generations. One example of this is the idea that coastal trade in the U.S. should generally be restricted to vessels under a U.S. reg- istry that were built in the United States. While some believe this concept came about just after Word War I with the ratifi- cation of the Jones Act, the doctrine appar- ently precedes the act by several decades. However, there are a few things that have changed over the years. In Dana's time, the master of the vessel could not issue a lien against the vessel regarding wages, since it was the philosophy that a merchant captain always stood in the shoes of the owner. This has since changed I'm sure much to the relief of many captains. Generally though, to this day a mer- chant captain still cannot seek the same punitive damages for nonpayment of wages that another crewmember might otherwise be entitled, So, part of the old. philosophy of a master's duty to an owner does remain in place after all. Of course, the time-honored right of seaman to receive maintenance and cure was well established before the 19th cen- tury. And the right to it even included the vessel's master! But a seaman's right to sue a vessel owner before a jury for negligence was not determined at the time of Dana's treatise. That would have to wait until the ratifica- tion of the Jones Act. (I'm sure you guessed that!) Now, as to the punishment of crewmembers, I'm afraid that I have sad news for grizzled boatswain's mates every- where. The American merchant service of the mid-19th century while harsh by modem standards was in the context of -its time a "warm and fuzzy" service. Indeed, Dana's treatise even goes so far as to say, "The authority of the master, being in its nature parental, must be exercised with a due regard for the rights and inter- ests of all parties." In some ways, it makes sense when you think about it. By the time Dana had published his first edition of "The Seaman's Friend" in 1841, it had been 25 years since the end of the War of 1812. The war had been fought, in part, to pre- vent American seamen from being com- mandeered from U.S. vessels and forced to serve on British warships known for their brutal treatment of crewmembers. In fact, the revised edition of Dana's treatise noted that Congress passed legislation in 1850 stating that: "The flogging in the navy, and on board vessels of com- merce, be, and the same herby is, abolished, from and after the passage of this act." Although Dana points out that a master could discipline crewmembers (including putting them in irons for sufficient cause), it had to be done as a mode of correction, and with- out exercising cruelty or unnecessary severity. Moreover, if a master's punishment "exceeds the bounds of moderation," the master would have been treated as a "trespasser," and liable for damages: ' In the end, it's probably a good thing that my father's zealous boatswain's mate never read "The Seaman's Friend." He would have come to the realization that seamen have had certain rights for a consistentlylong period of time. HAWKINS Waterfront news Writer Sol Spiegel doesn't hesitate a moment when asked what has kept him going for 100 years. "It's boating. It's been a mutual love affair for many, many years. It's been good to me and I've been good to it." Spiegel, of Hillsboro Beach, celebrated his centenni- al birthday on May 6. The Coast Guard Auxiliary Flotilla 3-2 in Fort Lauderdale later honored him on May 22 with a dinner party and a skit detailing his marine adventures., He joined the auxiliary in 1967 shortly after moving to South Florida from New Jersey. "I've always loved boats," said Spiegel, whose first craft was a small canoe that he used to paddle on the Hudson River at age 14. Many other vessels followed, the largest a 32-foot powerboat. Two years ago, Spiegel sold his last boat. "I miss it," he said, recalling how every day he would leave his condo and walk down to his nearby dock to check out the craft. "He got a lot of pleasure going to the boat every day," said his wife, Betty. "Boating has been a big part of both of our lives and when I held his 100th birthday party, it had to be on a boat," she said. The guest list numbered 100. Born in Austria, Spiegel immigrated with his parents to the U.S. in 1907 at age 3. After first living in New York City, they moved to Newark, NJ where as a young man his keen business sense led to his opening a necktie factory. Eventually he opened Spiegel Neckwear in a number of U.S. cities. But Spiegel's love of the water always had him sneak- ing away from the office to his boat. He joined the Coast Guard as a volunteer in New Jersey in 1939. During World War II, the Coast Guard officially became a reserve unit and it included Spiegel. "I tried to join the Navy, but was too short." Spiegel is 5 foot 3 inches tall and the minimum height was 5 foot 4 inches. But that didn't stop him from supporting the war effort. His plants produced U.S. Army neckties while Spiegel patrolled the New Jersey coast for the Coast Guard. S.A. When friends moved to Fort Lauderdale years later, Spiegel followed them. In 1952, he became a licensed charter boat captain and spent nearly 50 years taking fishing charters out of Bahia Mar in Fort Lauderdale. In 1967 he relocated permanently to Florida, eventu- ally settling in Hillsboro Beach where he has lived for the last 28 years and met and married his current wife, Betty, in 1994. Spiegel's first wife had died a year earlier. The couple had one son and Spiegel today has three grand- children and six great-grandchildren. Today his memories take the form of awards, letters, newspaper clippings and pictures. In 1999 he was given the Coast Guard's highest civilian award: the Distinguished Service Medal. He's also been honored with the Bunzel Safe Boating Award for 50 years of safe boating and has a special letter from President George Bush citing the honor. "I've had a good life," he said. "But the most enjoy- ment has been my time on the water." In 1997, he served on a Coast Guard volunteer crew aboard the historic USS Constitution, also known as "Old Ironsides." The event marked the first time in 116 years that the warship, launched in 1797, sailed in Boston Harbor. "I may miss being on a boat now at my age, but I have lots of wonderful memories," he said. HAWKINS Waterfront News Writer Beachgoers heading to John U. Lloyd Beach State Park's miles of sandy waterfront better bring their own shade. SThe state park is being stripped nearly bare of most of its tall trees under a Florida environmental improvement effort to remove trash vegetation. While hundreds of new trees have been planted to take their place, it will be years before they offer much escape from the sun. "It does look a lot different, but I think people under- stand what we are doing and will be patient with us," said Jim Higgins, assistant parks manager. With a $300,000 budget, the state is clearing 70 acres of wooded lands inside the park including about 2.5 miles of beach. The park has left some tall pines for shade during the transition, but most of the waterfront is bare. Picnic areas on the north end of the park have new wooden pavilions to allow for visitors to escape the sun. S"Our focus has been in the southern area of the beach and that beach section has been closed while the tree removal is under way," Higgins said. There is currently no set timetable to reopen the area to the public. Visitors continue to crowd the park, which ranked fifth out of 160 state parks in attendance. Last year, 600,000 year-round visitors were recorded. The ecosystem restoration project calls for removing all Australian pines, a non-native species considered a nui- sance. "The pines and other trees, like the Brazilian pepper, are ones that we need to remove," said Kathalyn Gaither, spokesperson for the Florida Department of Environmental Protection, which is overseeing the statewide effort. "The pines have a poor root system, which allows them to blow over easily in high winds and storms," contributing to beach erosion, she said. The pines also drop needles that cover the ground and kill off vegetation that offers ground cover and shelter for small animals. "We want to replace these non-native trees with more natural plantings, like palms, mangroves, sea grapes and others," Gaither said. Higgins said complaints about the project have been min- imal. "In the long run, we are protecting the park grounds." Sabal palms and other trees now being planted will replace the Austrian pines, but it will be years before they're tall enough to be valuable for shade. Other state lands are also undergoing natural habitat changes. They include Hugh Taylor Birch in Fort Lauderdale, the county-run Secret Woods Nature Center, and the South Fork of the New River in Dania Beach. I -W A T E R F R N I-N WS (0 Foreign-flagged recreation vessel ruling now being enforced While U.S.-flagged recreation vessels are exempt from filing a 96-hour ANOA, it doesn't change the requirement for U.S. citizens who are returning from a foreign country, to declare themselves to a U.S. Customs and Immigration offi- cer, Watson said. "The customs and immigration process is something that is done after arriving," he said. The U.S. Coast Guard was given authority in 2001 to enforce the 96-hour ANOA regulations. The ruling has not been enforced for foreign-flagged recreation vessels until May, Watson said. "We needed to get ourselves set up to receive notices," he said.
