WATERFRONT O CT O B E R 2 0 0 3 Year 20 Issue 7 National powerboat race accelerates into Ft. Lauderdale Open slot brings Grand Prix to local waters BY BETH FEINSTEIN-BARTL Waterfront News Writer Do you feed on speed? If so, the first-ever Fort Lauderdale Offshore Gran Prix could make your heart race. Some 25,000 people are expected to watch about 80 catamarans and vee bottoms compete on Oct. 3 and 4 off Fort Lauderdale beach, said Michelle May-Schmidt, race promoter. Fans can expect the race to "officially become the largest fleet to hit the shores of South Florida in the power boating industry," she said. The city will be the next to last stop on the APBA Offshore Powerboat Racing's national tour. The series will have its finale Oct. 16 to 18 in St. Petersburg. The upcoming competition was originally to be a south- east divisional event for APBA Offshore Powerboat Racing, the entity that sanctions events nationwide. "We were going to go national next year," Schmidt said. But an open slot was created when the North American Championships for the Grand Bahamas was moved from Sept. 27 to 30 to April 16 to 18. The space needed to be filled and the APBA looked to Fort Lauderdale, said Schmidt, who has worked on the event since November, 2002. Schmidt intends to build the race into a major annual showcase for the sport and the city. Next year, she plans to expand the race from two to four days. In other areas of the country, national pro series races have drawn large crowds. In places such as Sarasota and Savannah, up to 200,000 spectators attend a four to five day event. "My plan is to have it grow to the extent of the air and sea show," Schmidt said, referring to the massive display of mili- tary might that is held on Fort Lauderdale beach each May. Randy Hegwood, national operations manager for APBA Powerboat Racing, said the organization made the right choice when picking Fort Lauderdale to fill the open slot "It's such a great area for power boating:' he said. "It's a natural." With shorter courses and being closer to the beach, fans will be able to see the entire race, Hegwood said. Available from Commercial Nev Spectators on land can view competition free from Radisson Bahia Mar Resort and Yachting Center, along the beachfront to just south of Sunrise Boulevard. Spectator boats will have their own zone, marked by yellow buoys. Area will be patrolled to keep spectator boats apart from the racers. Testing will be conducted on the course, 9 a.m. to 3 p.m., Oct. 3. The following day, Oct. 4, racing will begin at 10:30 a.m. First in Saturday's lineup will be the Performance Extreme Class with boats traveling in access of 200 mph, followed by the Super Cats, which can boast speeds in excess of'140 miles per hour. Next will be the vee bot- toms, followed by the Performance Speed Bracket com- petition, along with a Battle of the Bats between winged one-design competitors that literally fly over the water, Schmidt said. Thunder Row race pits will be at the Radisson Bahia Mar. Pit passes cost $10 per day, or $15 for Friday and WPowerboat Racing knt Fort Lauderdale will be W included on the APBA vs Providers"4 OffshorePowerboat Racing's national tour, MOct. 3-4. Pictured is the Reliable Carriers Super Cat Team which recently donated $10.000 to the Old ViUage School in Northille, Mich. Saturday. Kids ages 12 and younger can enter at no charge. The resort will also feature exotic cars, the latest plea- sure boats, racing and boating apparel and pit parties. Gerardo Santiago, a world champion powerboat racer and pediatric dentist from Naples, said he is looking forward to attending the competition. As part of the festivities, Santiago will give rides to chil- dren from Kids in Distress on his boat. "Most of us are very excited about race the being in Fort Lauderdale," he said. "I think it will be super for all racers from Florida and for the City of Fort Lauderdale." Santiago had high praise for the city and its amenities. "They have one of best boat shows in the world and plenty of waterways'" he said. "It's just a given that the race should be there. It's about time." Higher number of marine patrol officers in Florida's future Newly allocated funds to increase manpower By ARNOLD MARKOWITZ Waterfront News Writer In the coming years, it should become riskier for scofflaw skippers to get gaffed for speeding in manatee protection zones, prop-chopping sea grasses, violating wake restrictions, hoarding undersize fish and scooting around drunk. Half of the 10 new marine patrol officers hired next year the first ones paid for with marine fuel tax rev- enue will be posted to Florida's southwest coastal zone. Two will patrol Lee County waters and one each will go to Manatee, Collier and Charlotte Counties, the chief of enforcement for the Fish and Wildlife Conservation Commission told the Waterfront News. Of the five others, one will be assigned to Broward County and two each to Duval and Brevard. This is the start of a five-year plan to add 29 enforce- ment positions to the agency formerly called the Florida Marine Patrol, those gray-clad water cops there never seem to be enough of. "Next [fiscal] year we plan, pending any substantial changes, 'to add one officer each to Palm Beach, Lee, Brevard, Volusia, Indian River, Hillsborough, and Pinellas," said Fish & Wildlife's Maj. Jim Brown. That would put 17 new officers in 12 of the state's 34 coastal counties in a two-year period. In case you're wondering, Why there? Why not here? Here's Brown's answer: "The criteria used to place the officers were historical - boat-related manatee deaths, vessel accident rates and illegal net-related activity," Brown said. "The priorities were set based on today's needs. We purposely did not project beyond year two, based on the possibility of change, and we want to be able to adapt if our needs change." Right now, the only plan downstream after the second year is to add four officers, somewhere, in each of the next lMi-amo]lm See the e online edition of the Waterfront News @ wwwwaterfront-news.com I ON BOARD IN OCTOBER Classifieds Commentary w- 0 Event Calendar Galley Tide Tables Q- Old Florida landmark to celebrate 75th birthday ...page 10 I - " I~ I I R0NT-NE Summerfield Boat Works A 1500 SW 17th Street Ft. Spectators continue to discover Columbus Regatta By BETH FEINSTEIN-BARTL Waterfront News Writer The Columbus Day Regatta, a long time popular tradi- tion in South Florida's boating community, will set sail on Oct. 11 and 12 for its annual race through Biscayne Bay. The competition begins at 10 a.m. each day. Yachts will start in the vicinity of the Rickenbacker Causeway on Oct. 11 and race down the bay, toward the East Featherbed Bank at Biscayne National Park. The following day, participants will leave the East Featherbed Bank and head back toward the Rickenbacker Causeway, according to the race committee's web site. Race officials were unavailable for comment. Boaters have until Oct. 4 to register. No entries will be accepted after that date. The cost is $75 if registering by Sept. 28. The fee then rises to $90. USSA members, who provide a copy of their membership cards, will receive a $7.50 discount. A skipper's.meeting will be held 7 p.m. on Oct. 10 at the Coral Reef Yacht Club, 2484 S. Bayshore Dr. in Miami. Participants can register in one of six classes - PHRF, one design, assigned rating, multihull, gunkhole and family cruiser. The five yachts in each division with 10 or more entrants will receive trophies. Trophies will be awarded to the top three finishers in classes with less than 10'entrants. Awards will be presented on Oct. 18 at the Coral Reef Yacht Club, where there will be music, food and a cash bar. The race, now entering its 49th year, is billed as the state's "oldest sporting event afloat." Prior to Hurricane Andrew in 1992, the competition drew around 700 entries. But because the storm destroyed a lot of boats and damaged marinas, those numbers have decreased, according to race committee members. In 2001, the race attracted 170 boats. Last year, orga- nizers said they were expecting some 200 entries. Still, the race is very well received and much antici- pated event, say organizers. Although the number of participants has dropped over the years, the regatta has continued to draw thousands of spectator boats, which anchor overnight at Biscayne National Park. But race committee members have gone to great lengths to disassociate themselves from spectators. They have claimed these boaters and their guests come out to party, not to watch or root for the entries. The spectators have been known to create a rowdy atmosphere. To provide for the safety of park visitors and resources, special measures are again being undertaken by park rangers, such as the additional presence of several law enforcement agencies including the U.S. Coast Guard, Florida Marine Patrol and the Miami-Dade Marine Patrol being out in full force, Gonshor said. Officers will conduct such activities as BWI check- points and boat safety checks. Idle speed will also be enforced throughout the Intracoastal Waterway, she said. Other measures being taken that weekend will be an anchorage area set up near Elliot Key, along with an infor- mation barge manned by park staff. The barge will double as a lost swimmers area. "If people are lost, then they can wait on the barge until someone in their party comes to get them," Gonshor said. Rangers also want visitors to take note not to relocate their boats after dark, she said. "Because the three fatalities that occurred last year happened in the evening, we are advising people not to move their boats after sunset," Gonshor said. I s oscar-time: Fishin fo records It's oscar-time: Fishing for fame by breaking records By ARNOLD MARKOWLTZ Waterfront News Writer "How would you like to set a world record?" Martin Arostegui asked. "Oh boy! Who do I have to kill?" No, that is what I would have said if I were clever. What I did say was something like, "uh...okay, I guess." We were fishing on a Miami-Dade drainage canal, a stretch with only half a mile of navigability between Tamiami Trail and West Flagler Street, where a low culvert blocks the way north. It runs alongside a busy suburban avenue, near the town of Sweetwater. If stopped in traffic there, you might wish for a fishing rod, but on second look you'd think, nah, there can't be anything fit to fish for. You would be wrong. Right there, on Thursday morning, March 27, Arostegui broke one of his own six world records - each in a different leader tippet class, for oscars caught on a fly rod. All those records were vacant until Arostegui began fishing for oscars last year. There was a seventh record, a vacant one waiting for someone to claim it That's the one Marty offered me, the one that's mine now. I've stalled writing about it while waiting for the International Game Fish Association to certify the catch. You know how it goes: brag prematurely and someone's sure to beat your feat before it's even listed in the record book. My oscar, and a record Arostegui set the same day, were listed in the September-October number of the IGFA's semi-monthly International Angler. If you're a saltwater purist, you may not know the mighty oscar, and so can scarcely appreciate the singularity of this remarkable catch: Weight, a pound-and-a-quarter. Leader, 20-pound-test. If anybody ever did that on purpose before, he kept quiet about it, probably to avoid groupies, tabloid photographers and inappropriate product endorsements the sordid down- sides of celebrity. Freshwater anglers, seeking largemouth bass or butterfly peacock, catch oscars by accident and consider them nui- sances. Using heavy bait casting or spinning rods with the flexibility of a dock piling, they can't know how game a fish oscar is. K Air Conditioning Air Purifications Systems Boat Odors? If a fish had a rig like that, it could reel you in. Not that a 20-pound leader is a huge challenge. Or the six-weight fly rod that Arostegui handed me. It's a short stick, its seven and-a-half foot length ideal for the narrow canals, like our oscar place. For that kind of fishing, you want a compact cast. Our record-setting day began at 8 a.m., opening time at Antonio Maceo Park in the 5100 block of Northwest Seventh Street, on the Blue Lagoon group of lakes near Miami International Airport. It was Thursday, so we didn't have to pay the $6 weekend fee to use the launching ramp. The lakes are drained by the Tamiami Canal network. Arostegui's favorite freshwater guide, butterfly peacock spe- cialist Alan Zaremba, ran his bass boat west by'southwest, made a right turn beneath the Palmetto Expressway and headed further west, parallel to Tamiami Trail. I joined Arostegui on the foredeck, peering into the water like Indian scouts reading trail signs. The water there is usually clear, even when the main canal is turbid with mud, the roiling of flood-control water releases and gunk-removal projects. Brazenly, we violated the fishing' admonition that warns, "if you can see the fish, the fish can see you." Stalking oscars, you can be bold. They are either too proud or too dumb to be scared off by the sight of people on a boat. "There," Arostegui said, pointing toward the canal's shallow eastern edge, behind a house with a concrete block seawall and overhanging deck, topped by a chain-link fence. A few broken blocks lay on the bottom debris to you, cover to a fish. Zaremba backed the boat off a few yards, far enough to lay down a cast, close enough to keep the fish in sight To the 20-pound leader, Marty already had tied a small, lightly weighted epoxy-head fly the color of root beer with a sparse white tail feather. "This is a bonefish fly," I declared. Nobody argued. Marty had added to it a weed guard made of stiff monofila- ment line, to prevent snagging if it fell on one of those cement blocks. First, he demonstrated the casting technique he had mas- tered: A short throw, slack-free, with the fly alighting right above the visible fish and sinking close to its face. He point- ed the rod tip down to the water surface. With the other hand he twitched the line, not the rod, to make the fly look alive. Easy for him to do, not so easy to copy. After seven or eight inaccurate casts, I lost count. Most were wide left or wide right, some too short and a few too long, hooking the chain-link fence. The coaching was persistent: "A little to the left. Not that far. Again. Let it drop. Now strip." I kept my pants on. In fly fishing, stripping is retrieving line in strokes with your non-casting hand. For oscars, the strokes are short and slow enough for the fish to catch the fly from behind without much effort. They don't chase a fast- moving fly. I missed a strike, then another. In any sort of fly fishing, timing is crucial. When is the right moment to set the hook? Before the fish realizes it's being fooled. It's good to remind yourself that the fish's reac- tion time is faster than yours. "When you see him go for it, set," Alan Zaremba said. "If you wait to feel the bite, it's too late. He's spit it out already." It seemed to me that the oscar saw the bonefish fly as a trespasser and was satisfied to dart after it just enough to shoo it away. Zaremba said it was becoming suspicious of the fly by degrees: "The fish becomes harder to catch, because it's not going to hold the fly very long." ;,When you keep casting and keep missing, there's a ten- dency to get impatient, which makes you careless. Your casts get worse instead of better. Arm-weary, I stopped a couple of times to settle myself down. Persistence paid off, though. I hooked one, too small to meet the IGFA's one-pound minimum. Then I hooked a big- ger one. The oscar put a respectable bend in Marty's fly rod, and in his skilledeye too. He predicted it would weigh more than a pound. Once I got it out of the water, he moved quickly with his tape measure. We wanted to release the fish alive. "Twelve!" he called out for the length. Inches, you know. "Ten!" That was the girth. To weigh it, he used a Boga-Grip, a pricey device that grabs a fish by the lip without causing injury and contains a scale that meets IGFA's strict standards of accuracy. Arostegui has the thing certified annually. "One pound, four ounces," he called out. We high-fived. "I have another record on my boat!" Zaremba shouted. Next,-I had to climb off-the boat onto the canal bank to verify the weight and pose for a picture with the fish still sus- Up close Like tournament competition, fishing for records isn't for everyone. Some may find the paperwork onerous, or the quest inconsistent with the intangible motives for fish- ing. Still, if most of your fishing is for a few species, it's worth knowing what the records are. It's no trouble to rig your tackle fly, spinning, trolling, whatever to IGFA specifications and follow the other rules. That way, just in case you catch a record-size fish, it will be qualified-if you decide to submit it. You can find record applications.and IGFA rules for every type of tackle on the website, www.igfa.org. Only, a pended from the scale. Why not do that on the boat? IGFA rules say you have to be standing on firm ground. "If you're out on a boat with 12-foot seas, the weight of a fish will change by two or three pounds as the boat goes.up and down," Marty explained. "You have to weigh it on land. When I'm fishing for records at Flamingo, we look for shal- low water, so I'm standing on land even if it's under water." Arostegui knows the IGFA rules probably as well as anyone. Last time I looked up his scores, in mid-September, there were so many Arostegui entries they could have been mistaken for misprints. Marty at that time held 25 IGFA records, his wife, Roberta and daughter, Danielle, 11 each, and son Martini, 9. They're not all oscars, either. Dad's records include a 76- pound tiger shark caught on a 12-pound fly leader in 2001. If you spend any time at Bass Pro Outdoor World's fly shop, you'll notice a photo of a man and a fish posted behind the counter. That's Arostegui with a swordfish he caught on a fly last year. When it was his turn to fish for a record oscar, I was ready to be impressed. Not so much by the size of the fish - a two-pounder would be an exceptional specimen but by the brilliance of Arostegui's technique. He was trying to break his own record for a leader tip of six-pound test. If no-catch casts could be weighed, Marty made a ton of them, probably near as many as I did. The biggest difference? Where most of mine had been off-target, nearly all of his were close to the threshold of his chosen fish's patience, but it seemed indifferent. m II --I-- YACHT HAVIN PARK AND MARINA AIFrIFIINT]r ICI IFIILS! That's off Anglers Avenue (Ravenswood Road) between the Stirling and Griffin Road interchanges of 1-95, or more precisely. 300 Gulf Stream Way, Dania Beach. "Now he's seen it," Zaremba would say, and the oscar seemed to sneer. This happened many times. Once, Marty thought he had it hooked but a yellow plastic bag got in the way and the fish escaped. At last, he scored. He caught one that weighed a pound and-a-half for another record. A couple of weeks later we took another ride together, to IGFA headquarters in Dania Beach. We brought our flies, leaders and an inch of fly line with the leader still knotted on to Doug Blodgett, who's in charge of investigating and certifying record applications. We brought our application forms, witnessed by one another and by Zaremba. We brought prints of the photos. Blodgett repeated what Arostegui had already told me, that the process would take five.or six months. Three days and three weeks after we set our dual records, Arostegui was back on the canal with Zaremba and broke two more of his own oscar records for fly.rod. Each fish weighed a pound-and-a half, one caught on an eight- pound leader tip and the other on 16-pound. And two days after that, fishing near Flamingo with guide Eric Herstedt, he caught another fly rod record a 26-pound whaler shark on six-pound tippet. Arostegui, the first to learn that the catches were certi- fied, notified me at once. I think that you have to catch a bigger one now," he wrote by e-mail. "Can't rest on past accomplishments." VHF's Autopilots I WAT R F~INT- FW ( 0 OCTOBER 2003 I & TER 0NT- W S. Admiralty Law Seamen are wai of the court By MARK ERCOLIN Waterfront News Columnist Early in the 19th century, the famed U.S. Supreme Court Justice Joseph Story first referred to seamen as the wards of the admiralty, (i.e., "wards of the court"). The good judge bestowed this title on seamen for a number of reasons. Here's how he phrased it in the 1823 landmark case of Harden vs. Gordon: "Seamen are by the peculiarity of their lives liable to sudden sickness from change of climate, exposure to perils, and exhaust- ing labour. They are generally poor and friendless, and acquire habits of gross indulgence, carelessness, and improvi- dence. If some provision be not made for them in sickness at the expense of the ship, they must often in foreign ports suffer the accumulated evils of disease and poverty ... "Their common earnings in many instances are wholly inadequate to provide for the expense of sickness; and if liable be so applied, the great motives for good behaviour might be ordinarily taken away by pledging their future as well as past. wages for the redemption of the debt." As we can see, Story considered sea- men's work difficult and tedious, and that it gave way to a lifestyle that made those who worked on ships ill-equipped to deal with sophisticated business matters. So, when issues of sickness and/or injury were a concern, the judge ruled that they were a charge to be placed upon the ship and its owners based partially on the following analysis: "...these expenses are a charge upon the ship, the interest of the owner will be immediately connected with that of the seaman. The master will watch over their health with vigilance and fidelity. He will take the best methods, as well as to prevent diseases, as to ensure speedy recovery from them. He will never be tempted to Cities have no legal basis to prohibit anchoring abandon the sick to their forlorn fate; but his duty, combining with that of the owner, will lead him to succor their distress..." Then, the justice further reasoned: "Beyond this is the great public policy of preserving this important class of citi- zens for the commercial service and mar- itime defence of the nation... Even the merchant himself derives an ultimate ben- efit from what may seem at first an oner- ous charge. It encourages seamen to engage in perilous voyages with more promptitude and at lower wages. It dimin- ishes the temptation to plunderage upon the approaches of sickness and urges the seaman to encounter hazards in the ships service from which they might otherwise be disposed to withdraw." In. 1823, Story eloquently reiterated that the ancient doctrine of a seaman's right to maintenance and cure was the tenet law in the United States and that the nation's courts would be the protector and champion of the "poor and friendless" sea- men. In general theory, little has changed concerning the pronouncements of that 19th century case. To this day, seamen remain the wards of the court and cannot contract their rights away under maintenance and cure. So, what are these rights? As presently interpreted, a boat owner is required -to provide for the medical needs of a seamen working in the service of a vessel (this often includes temporary employment) for virtually any injury or ill- ness incurred, or that becomes known, or is exacerbated while the seaman is employed by the vessel or working in the service of the vessel whether or not such injury or illness even originated on the vessel. Moreover, the boat owner is also gen- , .iIE i. = To the Editor: The town of Stuart, Florida has just passed a law that prohibits boaters from anchoring or living aboard their boats on the Intracoastal Waterway. They must take a mooring at the city anchorage, which in itself is deceiving. All waterways belong to the federal government and are entrusted to the states for the use and enjoyment of the public. Maritime law includes the right to anchor. If the federal law has set no time limit for the right to navigate, what gives these towns the right to do so? From town to town, the right of navigation is defined as 24, 48, 72 or 96 hours. This is called "shooting from the hip"- making it up as they go without anything upon which to base their decisions. The waterways belong to the American public and not to these small town commissioners. It is a common per- ception by these commissioners that boaters who don't pay dockage or moor- ing fees are freeloaders. What they fail to take into account is that most boaters, while anchored off a town or city, con- tribute to the economy by spending money on provisions, in restaurants, hardware stores, boat supply stores, bars and local points of interest. Ordinances should not be enacted out of fear. Passing this ordinance means that if a homeowner/tax payer lives and pays taxes in the city of Stuart but cannot afford to pay the high cost of dockage or mooring fees, he or she may be forced to sell their boat. This is fundamentally wrong. People with limited incomes have as much right to enjoy the waterways as those with money. If people who buy homes on a water- way don't want to see boats, maybe they should consider living inland. I am trying to get all boaters who care about their rights to anchor on the waterways of the United States to band together and help support this fight. Thomas R. Gill Boaters for Waterway Rights Stuart Acquire land near Lake Okeechobee for Everglades' water storage To the Editor: The many environmental and public safety threats caused by high levels in Lake Okeechobee are again in the news. The question is where to move the sur- plus water without creating other prob- lems. Our long-range answer is to put it south of the lake. That's where it used to go before the Everglades was disrupted by a massive drainage project that con- verted a half million aces of wetlands into the Everglades Agricultural Area (E.A.A). Government should begin working on this solution now. This area, mostly in sugar cane, soon will go-out-of-productior-because-the-soil - is disappearing.: It is peat and muck, which always erodes when drained. The U.S. Geological Survey predicts the remainder will be gone "within decades." Then the area will go to urban develop- ment unless government takes the oppor- tunity to acquire it for water storage and Everglades' restoration. The basic principles of maintenance and cure include: That the obligation of the vessel owner to provide maintenance and cure is to be a broad and inclusive duty, free of uncertainty, complexity and administrative burdens. Any doubts as to entitlement, defenses, necessity of medical treatment, and the attainment of maximum cure is to be resolved in favor of the seaman. That the undertaking to achieve maximum cure also includes entitlement to therapeutic treatments. As you can see, a vessel owner's obligations to, a sea- man can appear as onerous today as 200 years ago. Perhaps even more so, since medicine has become far more sophis- ticated and expensive than it was in the days of sail. The modem vessel owner (which, by the way, also includes own- ers of recreational yachts with a crew) might also argue that the system assumes an unsophisticated employee and is an anachronism. And yet, is it really that much different for the seaman? Despite modem appurtenances on a vessel, the sea remains the sea and is the same harsh taskmaster it always was. And, how many out there will truly argue that going to sea is ever a choice for the wise? Before I attended law school, I worked as a crewmem- ber for a now forgotten cruise line. Even though I was in one of the more comfortable positions, working on a vessel has its own rhythm and ways and can put you in unique dangers. Nothing on land compares to it. Even though I was a "sophisticated" college graduate at the time, I knew nothing about my rights as a seaman or that I was part of a "special class of citizens." Of course, now that I'm a lawyer I'm not special at all! The lesson here is simple: Seamen should know their rights, and vessel owners need to know their obligations to seamen. Justice Joseph Story would want it that way! SMark Ercolin is a maritime attorney based in Fort Lauderdale. The information offered in this column is summary in nature and should not be applied in specif- ic cases or situations. Lake Okeechobee land should be acquired alternative than the one now proposed: attempt to store Everglades water in 333 underground wells using high cost, energy consuming technology never tried before on such a scale. Friends of the Everglades and other environmental organizations, including the Everglades Coalition, long have proposed the purchase solution. (Florida Senator Bob Graham has suggested that government look into pur- chasing development rights to avoid the catastrophe of seeing a city rise in the heart of the Everglades.) Reflooding would enable the area to serve as a natural treatment marsh for the polluted lake water. Further, the area could begin to restore itself as the headwaters of the River of Grass. Sending the water where it used to go is the best solu- tion to the Lake Okeechobee problem and would be a giant step toward true Everglades Restoration. HAWKINS Waterfront News Writer This is one in a series of articles about landmarks and places of interest along South Florida's waterways. This month's feature explores Cap's Place restaurant. If she had her way, Talle Hasis would call her historic family restaurant Club Unique, its original name when it opened in 1929. "Nothing has really changed here in all these years and that, in itself, says something," said Hasis, a co- owner. As it approaches its 75th year, the name that's on all the maps, in local history books and on the menu itself, is Cap's Place. Long waiting lists of hungry patrons boat to the restaurant, taking a temporary step back into old Florida. Accessible only by water from a dock next to the Lighthouse Point Yacht Basin & Marina, at 2765 NE 28th Court, Cap's Place draws not only locals and tourists, but also plenty of rich and famous patrons looking for an interesting place to dine. "People come here because it's so special and like no place else, but we also have great food and we're proud of both, said Hasis. The restaurant is on Cap's Island, in the Intracoastal, channel marker 69, north of the Hillsboro Inlet in Lighthouse Point. It was 74 years ago when two men who shared the common bond of having run away from home as kids, met and built a business now run by a second generation. Eugene Theodore "Cap" Knight was a master seaman who sailed big steamers between New York and New Orleans. He settled in Hillsboro Beach where he operated a successful sideline smuggling liquor from the Bahamas during Prohibition. His brother, a lighthouse keeper, would signal when the coast was clear to bring in the haul, which was wrapped in burlap bags and sunk in Lake Placid. In 1926, Knight met Al Hasis, a young man who had Years of Quality Equipment & Serve TECHNICOLDY Refrigeration Systems Air Conditioning Systems Service Center & Showroom 201 SW 7th Avenue Fort Lauderdale FL 33312 Phone (954) 764-6192 Fax (954) 764-7259 RICH BEERS MARINE INC. Cap moved his illegal liquor business inland to a peninsula bordered by the Intracoastal on the east and Lake Placid on the west. Two years later the two men secured an old barge, used by Henry Flagler to build his Florida East Coast Railroad, that was beached at the site. Using Dade County pine and scraps they collected here and there, the two created Club Unique, which they opened in 1929. 4S.A. Business flourished and drew the likes of celebrities and mobsters like Meyer Lansky, who made regular visits to collect his "share" of the win- nings. But there were others who visited Cap's Place over the years. British Prime Minister Winston Churchill and President Franklin Roosevelt ate there in 1942 during a series of secret meetings held at a Hillsboro Beach estate. Over the years, she adopted the space by taking care of it on a regular basis keeping it clear of debris and water- ing the plants. Eventually a bench was placed near the river with a great view of passing boat traffic. A year ago, neighbor Joe Bellavance, touched by Murray's efforts, prompted her friends and the groups she was involved in to write letters of support to name the park for her. Last January, the city agreed and ceremonies were held and a sign erected in her honor. On hand for the event was Mayor Jim Naugle, whom Murray had babysat for when he was a kid. "It was my 80th birthday gift," Murray said, as she explained how her kids arranged to have the dedication cer- emonies take place on her birthday. "Boy what a gift and was I surprised." In the first year, the new Boating and Waterways law reserves $700,000 of new funding specifically for enforcement of manatee protection rules in the three coun- ties with the most boat-caused manatee deaths and injuries. Brown said Lee and Brevard are the top two consis- tently. With two officers added in each, marine patrol expansion is likely to be noticed there first. Third place varies; right now Indian River County holds it. Elsewhere on Florida's vast coastline, saltwater boaters might not notice a difference so quickly, but they can still celebrate delivery of what they've demanded for years. Finally, tax money the state collects on marine fuel sales is being used for marine purposes including research, safety, public education, waterway markers and public launching sites. Also, there will be more police to enforce laws that may have relied too much on voluntary compliance, which seems to work better when there are cops around. Until enactment of the Boating and Waterways law, Until enactment of the Boating and Waterways law, nearly all the money that Florida collected from fuel taxes was spent on road construction. nearly all the money that Florida collected from fuel taxes was spent on road construction. Boaters and organizations like the Marine Industries Association finally convinced the state legislature that it wasn't fair. The portion of fuel tax money going to. Fish and Wildlife starts with $2.5 million in the fiscal year that began Oct. 1. Then it scales upward to $13.4 million in the fifth fiscal year, and levels off at that rate annually. That is not a lionfish's share of the money the state earns by taxing marine fuel, but it's a stout piece of the estimated $37.9 million in taxes attributed to gasoline and diesel sold at marinas alone in just-ended fiscal year 2002-03. A new fiscal year began on Oct. 1, and that's the peri- od in which the first 10 new officers will be put to work. Training is scheduled to start next April, with graduation the following November. In their first 12 weeks on duty, rookies work alongside experienced officers, so real- world expansion of the patrol won't begin until February 2005. Staffing has been rising even Without fuel tax revenue from 237 officers statewide in 1999 to 394 now, Brown said. "With funding provided by the governor and legisla- ture over the past couple of years, we have gained posi-, tions during a budget' eight period," he said. "I think this shows their commitment towards resource protection and boating safety." The southeast area sharedin that growth. Brown said that since 1999, staffing has increased from 14 officers to 31 in Palm Beach County, from 14 to 21 in Broward, 18 to 22 in Miami-Dade and 33 to 40 in Monroe, the Florida Keys. Fish and Wildlife also is training a team of officers, called the Special Operations Group, to dash to wherever a crisis arises. Brown said their assignments would range from resource protection and boating safety to domestic security and disaster response. . Meanwhile, at closing time, the restaurant's door was locked, Hasis said. The walls of Cap's are covered with photos and news- paper clippings publicizing famous visitors and the spot's colorful history. The rambling, one-story wooden building has been placed on the National Register of Historic Places because of its link to Florida history. "Not much has changed here in all these years," Hasis repeated. Rustic charm is reflected in the uneven outdoor wood- en sidewalks. Inside the restaurant are old wooden tables, uneven floorboards and nautical gear hanging from the walls and rafters. Knight died in 1964 and the Hasis family eventually assumed ownership, which continues today with Al's chil- dren Tom, Ted and Talle as co-owners. The dining spot is the oldest continuous one in Broward County. "We have no plans to change a thing," said Hasis. Our parts inventory is inexhaustible, and the Ward's team of world-class ABYC certified electricians continue to set new standards of technical proficiency. (0 OCTOBER 2003 Uncrowded waters, reliable fall winds make for good sailing By TERRY CONWAY Waterfront News Writer Legend has it that a stately cypress tree once grew smack in the middle of Edenton's harbor long before the first English colonists set foot in the Albemarle region of North Carolina. Whenever a trade ship arrived at Edenton, it was code of conduct for the captain to leave a bottle of the best Jamaican rum in a hollow spot of the cypress' trunk. When a ship pulled up anchor, the vessel's crew would pay its respects to the Dram Tree by hoisting a drink to a safe voyage. Ships whose crews skipped a drink of the Dram Tree or, even worse, failed to place a bottle there when entering port, were said to be doomed to disaster. The tree is said to have survived until the spring of 1918, when a tremendous ice floe vanquished the land- mark. Today, sailing out of Edenton Bay into the Albemarle Sound the largest fresh water sound in America one crosses over the site where that cypress once sprouted. It's easy to note the unspoiled shoreline while gliding up the Chowan River, or east towards Roanoke Island. Uncrowded waters and reliable fall winds create some of the best sailing in northeastern North Carolina. The first European visitors to the Albemarle region were probably members of Sir Walter Raleigh's expedi- tion in the 1580s. Today, the Albemerle mainland towns that line the rivers and estuaries are a microcosm of American history. From the first exploration by English colonists in 1584, to residents who protested British tyran- ny in 1774 to invasion by the Union Army during the Civil War, the Albemarle has played a pivotal role in just about every major event in American history. North Carolinians have long considered Edenton the jewel in the crown of Albemarle. One of the prettiest towns in the South, it flanks the beautiful open waterfront of Edenton Bay. About 5,200 people reside in the area that boasts architectural treasures, scores of well-tended gardens and some of the earliest settlements in North Carolina. Edenton's three block long business district is lined with shops and businesses and its waterfront has been given over to parks and stunning vistas across Edenton Bay and North Carolinians have long considered Edenton the jewel in the crown of Albemarle. the Albemarle Sound. It is not uncommon for residents of the gracious old homes that line the shaded streets to invite newcomers to come in for tea. Visitors can explore the rich history and architectural diversity of Edenton during a comprehensive 45-minute trolley tour through the, historic district. The Cupola House is just one of the many unique and beautifully pre- served homes in Edenton.
