For boaters living inFortLauderdale's.
Coral Ridge Isles, just nine extra inches
will make access in and out of their
neighborhood much easier.
That's what will be added to the
vertical height of the new Northeast 62nd
Street Bridge. Browvard County workers
are scheduled to begin replacing, the
existing structure, which now has a
clearance at high tide of six feet, this fall.
That's good news to Tom Ne\\ man,
who led a lobbying campaign for a taller

Ridge Isles Homeowners Association. "A
foot or more would have been better. But
this is a good compromise."
Newman believes improvements
should also be made to bridges in other
parts of the city. As a member of the Fort
Lauderdale Marine Advisory Board, he
started aboard-approved research project
last spring to determine how many more
local structures need raising.
But Newman won'tbe working alone.
He will join forces with the Greater Fort
Lauderdale Chamber of Commerce,
which has its own bridge committee.
That task force was formed two years
and has about 25 members. It is chaired by
Frank Herhold, executive director of the
Marine Industries Association of South
Their quest is to target bridges that
are scheduled for renovations or
replacement, then determine whether the
construction plans can include an increase
in vertical height.
The group is currently in the fact-

talks with the state Department of

messy fish to clean

This is the first in an ongoing series of
articles about fun things to do on or near the
water in South Florida.
Michael Ketchum is putting some
muscle into his movementsnow. Straining
and pulling, he senses that the fish is
almost within his grasp.
This is it. It's coming. The Big One.
But the dolphin doesn't break the
surface. Instead, it slips away. But
Ketchum isn't perturbed.
He simply walks up to the bar, plunks
down another dollar and is ready to try
again. That's how it goes with virtual
reality fishing, where folks can reel in
their catch without ever setting foot inside
a boat or standing on a bank.
Of course, these game fish can't be
eaten or mounted. Then again, it doesn't
seem to bother the folks who pay for a
chance to try their luck at Shirttail
Charlie's, a longtime waterfrontrestaurant
andcbar on Fort Lauderdale's New River.
The machine, called King Fisher, was
introduced to patrons in May and is

quickly becoming a popular attraction,
said David Jackson, one of the eatery's co-

Ketchum, who works as a yard
foreman at the neighboring Riverfront
Marina, said the game is as close as it gets
to the real thing.
"The only difference is that in the bar,
you have a time limit," said Ketchum, an
avid fisherman. "On a boat, you don't."
Here's how it works: The game
consists of one television set that is
mounted over the bar and a VCR. There is
also a rod and reel and a black box that
tugs and pulls on the line.
After paying one buck for two tries,
the player gets to select a video tape
depicting close-up underwater views of
four different types of fish. They can
choose between freshwater bass, salmon,
dolphin or sailfish.
Once the tape is rolling and the bait is
taken, the battle gets underway. Players
have three minutes to reel in their catch.
They can watch their progress on the TV
as the fish fights to be set free.
"You can actually feel it pulling,"
Ketchum said. "Even if you don't like
fishing, this is good exercise."
The restaurant's owners are not
surprised that folks are being lured into
testing their skills. They knew from the
start that the game would be a big draw,
"We first saw the machine being
displayed at a boat show in Fort
Lauderdale and thought it was a cute
idea," he said.
Bill Beattie, general manager at
Shirttail Charlie's, said it was hard not to
get hooked on King Fisher.
"Being that we're on the water, it's the
perfect tie-in," he said.
Since opening in 1983, Shirttail
Charlie's has been a favorite destination
for hungry boaters and landlubbers alike.
The 250-seat restaurant, at 400 SW Third
Ave., has two stories. Upstairs is an
enclosed upscale dining area with large
glass windows overlooking the river. The
lower floor offers more casual dining.
Dockage is available for diners. The
eatery also owns a 26-passenger launch
vessel that provides free evening cruises
to customers including theatergoers who

A whodunit for the books
Fishing for admiralty jurisdiction

This one from the police files in
Lighthouse Pointhas me wonderinghow
some of you "high-falutin" boat types
got all that money in the first place.
We'll refer to the involved boat
captain as "The Skipper."
We'll call his mate "Gilligan."
Seems The Skipper and Gilligan
shortly after 12
a.m. during a
night in May.

its owner, who
we'll call "Mrs. Howell."
The pair arrived back atthe boat
around 8:30 the next morning. It was
then they discovered that two VCRs, a
nightscope, a Toshiba laptop computer,
a G.P.S., and $10,700 in cash that
belonged to The SkipperiGilligan and
Mrs. Howell, were missing.
Gilligan shrieked something to the
effect of "We wuz robbed."
The Skipper called the cops.
And when the cops arrived, they
searched the boat for clues that might
lead them to the proverbial whodunit.
"They didn't secure the door nor
activate the alarm system," the police
officer documented in his report. "I
checked the vessel and found that the
suspect apparently entered the vessel
via the unlocked front door."
Meaning of course that when the
Skipper and his little buddy left the boat
the previous night, they apparently
forgot to lock up. They also apparently
forgot to turn on the alarm system.
Or did they?
Since stumbling on the report, I've
surveyed four different boat captain
pals to find out if it's a common practice
for a captain to leave the ship at night
without locking up or activating the
boat's alarm system. All four admitted
to occasionally leaving their vessels of
employment unlocked at night. Two of
the captains say they'll turn on the
alarm whether they lock the doors or

and ripe for the picking without as much
as a chance of a squeak from the alarm
system, two emphatically agreed that
it's a pretty stupid thing to do while the
third, a real close pal who ought to have
his own TV show, yanked off his hat
and swatted me a couple of times for
insulting his salty intelligence.
"How much did they leave out?"
the fourth captain asked.
The Skipper left $6,000 in the boat's
lower bridge. Gilligan, bless his little
green heart, left two grand in the
starboard cabin. And then there was the
$2,700 left in the master cabin by Mrs.
"That was nice of them," he said.
"And I suppose the owner had to leave
:the money out because the safe was all
The police report didn't mention
the yacht's safe. The officer did state
that "other expensive items were passed
up." The officer added: "It looks as
though items were handed down to a
second subject waiting in a boat."
SThen the report goes on to state that
a "neighbor's son may have seen
.I .kow I smell something fishier
than your normal, run-of-the-mill cat
burglars. For starters, skippers are early-
to-bed, early-to-rise types who only
workpast sundown if the fish are biting.
The Gilligans of the world, they'djump
overboard if The Skipper told them to.
As for yacht owners like the Howells,
they didn't become millionaires by
leaving cash laying around.

.Let's say that one fine Sunday
morning "Billy-Bob" and "Clem"s take
their individual rowboats on Lake
Okeechobee where they plan to do some
serious bass fishing.
Just five minutes after he puts his
pole in the water, Clem hooks "Old
Moe"- the "big one!" But he's too busy
with his catch to notice that Billy-Bob's
boat is on a
his own boat.

Billy-Bob!" yells Clem, "you done broke
my boat. And, what's more, I lost 'Old
Moe.' I believe you've done at least
$20,000 worth of damage!" (Obviously,
Clem has a very high opinion of his
rowboat or perhaps "Old Moe").
"That's hogwaller, Clem!" snorts
Billy-Bob. "You never had a snowball's
chance of catching that stupid fish. And
besides, it's only a rickety old rowboat.
You can't make a federal case out ofit!"
In fact, Billy-Bob is wrong. While it
may be impractical, Clem probably can
make a federal case out of it. Here's how
a lawyer might "fish" forthe answer.
It boils down to subject matter
jurisdiction; or, in other words, whether
a particular court is competent to hear
the case. If Clem can establish thathis
case is under admiralty jurisdiction, it
can be brought into federal court. This is
because the U.S. Constitution gave the
federal courts control over "all cases of
admiralty and maritimejurisdiction." So,
the question becomes, does Clem and his
rickety old rowboat have a case in
Well, let's see. About 25 years ago,
the Supreme Court developed a test to
determine whether or not an accident on
the water is under admiralty jurisdiction.
First, it must be known if the parties were
engaged in a "traditional maritime
activity," and next, whether the incident
occurred on "navigable waters."
A "traditional maritime activity" is
pretty much anything having to do with
boats or travel over the water (travel over
the high seas by airplanes has sometimes
been included,but notjust "incidentally"
flying over a lake or a river). So, Clem's
claim would be on good footing for the
maritime activity portion of the test.
Now, we have to determine if Clem
and Billy-Bob were on "navigable
waters." The Supreme Court has
basically determined that a navigable
water is one that is capable of being used
for interstate commerce.
Lake Okeechobee has a canal system
which gives boats access to both the
Atlantic Ocean and the Gulf of Mexico
(and, if you ever have the time, I
understand it's a really fun trip to take).
This ocean access allows vessels to travel
to other states therefore Lake
Okeechobee is a "navigable water."
When it comes to admiralty
jurisdiction, other navigable waters
include inland lakes that border other
states (Lake Tahoe, between Nevada and
California, for example), as well as rivers
and estuaries which allow for practical
ocean access or travel to another state by
a boat which can be used in commerce.
This means that even if you're willing to
duck under some drain pipes, the type of
lake where you can make it to the ocean
by canoe would not be considered a
navigable water for this discussion.
But since Clem and Billy-Bob were
engaged in a traditional maritime activity,
and they were on the navigable waters of
Lake Okeechobee, it seems our two
fishermen may have a real (or is that
"reel") federal case on their hands if
they want it. Sure, Clem might be able to
take Billy-Bob to federal court, but that
doesn't mean he can't take him to state
court instead (quite probably to the relief
of some federal judge, who would
undoubtedly wonder why he's hearing a

Depending on the case, state courts are considered
competent to hear many maritime issues and can
sometimes be more affordable and possibly less time
consuming than the federal alternative. Such decisions
must be weighed carefully, and shouldn't be made
before having a long serious discussion with a legal
counsel who is knowledgeable in maritime matters.
Of course, in the end, it's quite possible that Clem
will realize that Billy-Bob was right that his rowboat
isn't worth that much, and they'll make a deal. Billy-Bob
will go to the fish market in Clewiston, buy the biggest
bass he can find so Clem can take it home, and tell
everyone how he caught "Old Moe."
Solving a jurisdiction question can be like fishing. It
requires time and patience; and it's a great feeling when
you've got it "hooked."

Northeast 62nd Street Bridge involves no extra fees
other than buying materials, said Bill Fowler, a project
manager with the county's engineering division.
"It wasn't expensive in this case," he said, of the
$323,684 project. "Then again, this is a fairly small

increase the width of bridges on the Intracoastal
Waterway. Last year, the U.S. Coast Guard revised its
bridge construction policy, from a minimum required
width of 90 to 125 feet.
The changes mean that all new and renovated
bridges will now stretch across the entire span of the
Intracoastal, he said.
Although the navigation district has no jurisdiction
over canals, Roach would like to see.fixed bridges get
the same boost.
It doesn't make any sense for the structures to
remain the same size as boats grow bigger, he said.
