3 A bill to be entitled
4 An Act relating to flood control,

5 recreational planning .and development;
6 amending section 378.16(3), Florida

7 Statutes, by deleting certain restrictions
8 on the power of eminent domain; providing

9 an effective date.
10 Be It Enacted by the Legislature of the State of

11 Florida:

12 Section 1. Subsection (3) of section 378.16,

13 Florida Statutes, is amended to read:
14 378.16 Providing for district works.--

15 (3) Recreational planning and development
16 within the area of the district may be undertaken at

17 the discretion of the governing board; provided,
18 however, no such planning or development shall effect

19 any public lodging establishment, as defined in

20 chapter 509. The use of the power of eminent domain

21 for recreational planning and development shall be

22 limited to the provision of recreational use of lands

23 that are adjacent to and connected with lands also
24 necessary for water storage management purposes.

25 Section 2. This act shall take effect upon
26 becoming a law.
