3 A bill to be entitled |
^ An Act relating to flood control, flood
5 1 hazard areas; amending Chapter 378, Florida

6 Statutes, by adding a new section authorizing

7 delineation and regulation of flood hazard
8 areas; providing an effective date.

9 Be It Enacted by the Legislature of the State of
10 Florida:

11 Section 1. Chapter 378, Florida Statutes,

12 is amended by adding a new section 378.162 to read: S

13 378.162 Local regulation of flood hazard areas:- i
14 (1) The governing board shall have the |

15 authority to delineate and regulate areas subject
16 to recurrent flooding for the purposes of preventing [

17 and alleviating flood losses and for promoting the |
18 most suitable use of such lands,

19 (2) Such delineation and regulation shall be.

20 based upon sound studies and may include, but shall j

21 not be limited to: I

22 (a). Regulations for uses including agricul-

23 tural uses, which may obstruct flood flows or other-
24 wise threaten public health, safety, or general i.

25 welfare. !

26 (b) Regulations which establishminimum .

27 flood protection elevations and flood damage preven-

28 tion requirements for use, structures and facilities |

29 such as streets, sewers, and water systems which i

30 are vulnerable to flood damage.

31 (3) Wherever possible, regulations adopted

I undec this section shall be in accordance with

2 comprehensive land use plans and ordinances of local

3 governmental units.

4 (4) Appropriate conditions to effectuate

5 the purposes of this section, may be attached to

6 permits or permission for use or development of

7 flood hazard areas.
8 Section 2. This act shall take effect

9 immediately upon becoming a law.
