Mr. Elkins has informed me of his telephone conversations
late Tuesday afternoon with Messrs. McAteer, Dunbar and Clint
Brown and his prior telephone conversations since March with Mr.
James Leavengood, Mcr. Carl Linn, Mr. Pick Talley and Mr. McAteer.
I believe it is understood by all concerned that it is SCL's pur-
pose, in the event authority is obtained from Interstate Commerce
Commission to abandon the track between Trilby and Chemical, to
retain ownership of the right of way for possible reconstruction
of track to serve future industrial developments in the area. We
desire to cooperate with those having an interest in obtaining
water from the proposed well field areas in Pasco County for
which the proposed water main along the track right of way would
be required but, understandably, we wish to avoid becoming in-
volved in a controversy and the possibility of litigation.

It has been suggested on several occasions that the inter-
ested public authorities endeavor to reconcile their differences
by designating the recipient of an easement for installation of
the water main for mutual use by the public authorities. Appar-
ently the interested public authorities have not agreed upon that
disposition which we consider to be most desirable.

Mr. John W. Weldon, our General Solicitor, and Mr. Elkins

representatives in Jacksonville to see if we cannot agree upon a
disposition of this matter acceptable to all concerned. I suggest

Mr. Rice has referred to me the letters dated June 25 and
June 26 he received from IMr. Dunlap and Mr. Larry D. Brown in re-
gard to request under threat of condemnation that the City of St.
Petersburg and Pinellas County be granted an easement for in-
stallation of a water main along SCL's main track right of way
between Trilby and Chemical, Florida. I have also received letter
dated June 14 from Mr. Feaster to Mr. E. H. Spence requesting that
Sou-thwest Florida Water Management District be granted an easement
for installation of water main along this right of way between
Mile Post 840 and Mile Post 852 and letter dated June 25 from Mr.
Dunbar to Mr. B. B. Vaughan, requesting -that Pasco County be
given priority in use of the right of way.
