16 amended by creating a new section numbe-red 378.152

18 3-'-83-m52 Declaration ofwater shortage;
19 emergency orders.--
20 (1) The governing board of the district may
21 by order declare that a water shortage exists within
22 all or part of the district when insufficient ground ,
23 or surface water is available to meet th.e needs of
24 the users, or when conditions are such as to require
25 temporary reduction in total use within the area to -- .,<
26 protect water resources from serious harm.
27 (2) The governing board may impos-e such
28 restrictions on one or more users of th], water
29 resource as may be necessary to protect the water
30 resources of-the area from serious h.arm,
31 1 1 .

1 (3) When a water shortage is declared, the
2 governing board shall cause notice thereof to be
3 published in a prominent place within a newspaper of
4 general circulation throughout the area. Such notice
5 shall be published each day for the first week of the
6 shortage and once a week thereafter until t-he
7 declaration is rescinded. Publication of such
8 notice shall serve as notice to all users in the area
9 of the condition of water shortage.
10 (4) If an emergency condition exists due to
11 a water shortage within any area of the district,
12 and if the executive director of the district with
13 the concurrence of the governing board, finds that.
14 the exercise of powers under this section are not
15 sufficient to protect the public health, safety, or
16 welfare, or the health of animals, fish or aquatic
17 life,.or a-public water supply, or recreational,
18 commercial, industrial, agricultural, or other
19 reasonable uses, he may pursuant to the provisions of
20 Chapter 120, Florida Statutes, issue emergency orders
21 reciting the existence of such an emergency and
22 requiring that such action, including but not limited
23 to apportioning, rotating, limiting or prohibiting
24 the use of the water resources of.the district, be '
25 taken as the executive director with the concurrence e
26 of the governing board deems necessary to meet the
27 emergency.
28 (5) The department of natural resources shall
29 review and may rescind, modify or approve any policy
30 rule, regulation or order of a water management
31 district authorized by this section.

1 Section 2. This act shall take effect on
2 December 1, 1972 and shall automatically be
3 repealed on July 1, 1973.
