RESOLUTION NO. 268
WATER' REGULATORY DISTRICT
WHEREAS, the SOUTiHWEST FLORIDA WATER MANAGEMENT DISTRICT, pursuant
to'.,Chapter 373, Florida Statutes, after investigation, did by proper
resolution adopted July 10, 1968, determine that the necessity existed
for the conduct of a public hearing to determine whether or not a Water i
.gulatory District should be established; and
WHERPEAS, proper notice of such hearing was given as provided by Sec-
tion 373.151, Florida Statutes; and
WHEREAS, on August 30, 1968, such public hearing was held at the i
official office of the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT near
Brooksville, Florida, during which all members of the Board of Governors
of the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT did hear and receive
all testimony and evidence offered for the purpose of determining the
necessity for creating a Water Regulatory District under the authority
of Section 373.142, Florida Statutes; and
WHER.EAS, an accurate record of the proceedings had and all evidence
introduced at. said hearing offered by the numerous witnesses-both in the
form of oral and written testimony as to lake levels, ground water and
surface water conditions as well as other related factors existing in or
affecting the area encompassed by the SOUTHWEST FLORIDA WATER MANAGEMENT

near Brooksville, Florida;
0 NOW, THEREFORE, BE IT RESOLVED by the SOUTHWEST FLORIDA WATER
MANAGEMENT DISTRICT, as follows:
1. The members of the Board of Governors of the SOUTHWEST FLORIDA
WATER MANAGE.MENT DISTRICT, presided over by the Chairman of said Board
sitting as hearing officer over a public hearing held at the official
office of said SOUTH!;.EST FLORIDA WATER MANAGEMENT DISTRICT on August 30,
1968, do find as facts, established'by a preponderance of the evidence
offered at said hearing, the following:
a. There has been a rapid growth of population in the area com-
prising the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT.
Sb. There has been a continuous increase in the amount of ground
water used in said area for domestic, agricultural and industrial pur-
poses; the need for ground water for such purposes in the future is ex-
pected to continue to increase rapidly.
c.- There have been long-term declines of ground water levels in
the area comprising the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT and
These declines have been increasing progressively. "
d. There is a connection between the ground waters and the sur-
face waters in such area and in many instances, there have been detri-

mental effects on the surface waters as a result of ground water use.

e. There have been increasing diversions of water within the area of
the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT which have result-
ed in salt water encroachment and threatens to render large portions of the ground-
water resource unfit for continued municipal, industrial and agricultural use.
f. Wasteful and unreasonable uses of water resources are occurring.
g. The area comprising the SOUTHWEST FLORIDA WATER MANAGE-
MENT DISTRICT is a hydrologically controllable area based on ground water and
recharge area with appropriate consideration for surface water.
2. Proper regulations are needed to effect the maximum beneficial utiliza-
.tion, development and conservation of the water resources of the area comprising
the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT so as to be in the
best interests of all people and to prevent waste and unreasonable use of said wa-
ter resources.
3. There is a necessity for the creation of a Water Regulatory District as
authorized by Chapter 373, Florida Statutes.
4. A Water Regulatory District is hereby created under and pursuant to
Chapter 373, Florida Statutes, embracing the same area which comprises the
SOUTHWEST FLORIDA WATER,.MANAGEMENT DISTRICT, which said area is
more particular described in Exhibit A attached hereto.
5. Said Water Regulatory District shall be known as the "SOUTHWEST

6. The governing board of the SOUTHWEST FLORIDA WATER MANAGE-
SMENT DISTRICT (REGULATORY) shall consist of the members of the Board
Of Governors of the SOUTHWEST FLORIDA WATER MANAGEMENT DISTRICT.
PASSED and ADOPTED this 30th day of OCTOBER 1968.
