State Attorney Glenn Hess has deter-
mined that Marianna police officer Bliss
Moreau was justified in the fatal shooting
of Mark Anthony Daniels three months
ago.
Daniels, 31, died as the result of a single
gunshot wound to the torso.
A standard Florida Department of Law
Enforcement investigation was initiated
after the officer-involved shooting. That
agency presented its report to Hess
Tuesday.
Hess said he found that Bliss was clear-
ly justified on both of the two circum-
stances in which officers are allowed to
use deadly force.
Under Florida statute,. officers can use
lethal force if they are trying to capture 'a
felon fleeing from justice, or if they are
using reasonable means to protect them-
selves.
'The FDLE report details many facts
that would lead any reasonable person to

conclude that the officer's actions were
necessitated by the actions with which he,
was faced," Hess said.
The shooting occurred during an
attempted traffic stop in which Daniels
had' fled pursuing, officer Christopher
Allen. Moreau had come to assist.
After Moreau had blocked Daniels' path
on Oak Street, Moreau got out of his cruis-
er aid started walking toward the Chevy
Suburban Daniels was driving.

The report goes on to detail the ensuing
events.
With his weapon drawn, M6reau
ordered Daniels to turn the vehicle off.
When he didn't comply, Moreau tried to
reach inside the SUV and turn the engine
off.
At that, point, Daniels stated "I'm not ...


going to jail," according to the FDLE
report.
Daniels then pushed Moreau's arm from
the steering console and "turned the steer-
ing wheel of the Suburban in Moreau's

their own home, a Habitat-built
house, Tuesday night ... just in
time for Christmas.
"I'm so happy I don't even
know what to say sometimes. It's
like I can't believe it actually
happened. I got a house for'
Christmas," Dunston said.
To celebrate, Habitat members
and the Dunston family gathered
at the new home Tuesday for a ' " -
dedication ceremony.
Habitat provides up-front fund-
ing for the homes it builds, but
homeowners must pay the money
back. They must also invest 500
hours of "sweat equity" in the
process, according to Leslie
Fuqua, executive director of
Jackson County Habitat branch.
In order for Dunston to be eli-
gible for her new home, Habitat
required the same 500 hour
"sweat equity" commitment like

Search still on for

missing hunter's body

The search area was expand-
ed Wednesday in a multi-
agency, attempt to find the
body of a duck hunter who is
believed to have died on the
Apalachicola River Sunday.
. John Mark.Slappcy, 34, was
hunting on Lake Seminole in a
float tube when he drifted into
the current at Jim Woodruff
dam and was swept through
the locks and into the river.
The .search area has been
expanded to an. area roughly
10 miles downstream from the
dam, according to Stan
Kirkland of the Florida Fish


and Wildlife Commission.
The hunt for Slappey was
early on characterized as a
recovery effort. The high
water, cold temperatures and
other factors made it clear his
chances of survival were
extremely low.
Employees at the dam, see-
ing Slappey's dilemma before
he .went through the lock on
Sunday, had tossed him a.life
ring. He was able to grab it but
could not keep his grip.
People from numerous
agencies, including the
Jackson County Sheriff's
Office, joined in the search for

Sneads passes amended noise ordinance

The doors will stay open and the music will con-
tinue to play at Landing Bar and Grille in Sneads, at
least for now.
Sneads town council members decided Tuesday
to amend an ordinance that would have stopped all
amplified music at any establishment that serves
alcohol. The Landing Bar and Grille, owned and
operated by Jason Milsapp,.is the only establish-
ment of that type in Sneads.
Instead, council members passed an ordinance
banning any establishment that serves alcohol from
playing any music that can be heard 30 feet outside
the building.
"This is it. I am of tired of hearing about it,"
council member Jimmy Wright said at Tuesday's
meting. "If this don't work, then I am voting to shut
(the bar) down."
The original ordinance was in response to numer-
ous complaints from some residents about the noise
level emanating from the bar. For months, the town
has been dealing with residents' complaints, with
some residents calling the council members at
home late at night to complain the music at the bar.
was .too loud.


The council has attempted different solutions,
each failing to alleviate the problem. During its last
meeting, the council decided to enact an ordinance
to ban amplified music, which had been tabled at a
previous meeting because the situation was improv-
ing.
Not wanting to wait until the meeting in January,
the council had scheduled a special meeting
Tuesday to meet and approve the ordinance.
The Tuesday meeting was standing room-only as
supporters of the bar and supporters of the home-
owners came to make their voices heard. Mike .
Weeks, the president of the council, began the meet-
ing by reading rules of order and stating anyone
who did not obey the rules would be escorted out by
police.
Supporters of the bar told the council that
Milsapp was a small business owner whose busi-
ness was being threatened by a few residents.
"Those people have been allowed to stir contro-
versy. All he has attempted to do was cooperate
with the city council," resident Sandra Jeter said.
Many people brought up how the bar is the source
of income for 23 families who spend money in the
community. If the bar is forced to close, those peo-

Extension office welcomes new 4-H agent


SPECIAL TO THE FLORIDAN
As of Dec. 11, Ben Knowles is the
new 4-H agent at the Jackson County
Extension Office, a position formerly
filled by Heather Kent.
Kent is now the regional 4-H spe-
cialized agent for north Florida.
"As a youth, my involvement with
4-H was very rewarding and provided
me with many valuable learning
experiences, as well,.as a lot of fun


memories. As the county 4-H agent,
it is my desire to help volunteers and
community leaders provide Jackson
County youth with learning experi-
ences that are meaningful and fun,"
Knowles said.
Knowles is from Perry, and a grad-
uate of Florida State University. He
earned a B.Sc. degree in biological
sciences in 2007 and an M.Sc. degree
in secondary science teaching the fol-
lowing year. During graduate school,


Knowles completed student teaching
internships at Leon High School and
Swift Creek Middle School in
Tallahassee.
4-H is the youth development pro-
gram of Florida Cooperative
Extension, a part of the University of
Florida Institute of Food and
Agricultural Sciences.

ing Moreau, (he) retreated by run-
ning backwards.
"Moreau observed the Suburban

discharged his weapon at a tire. on
the left side of the Suburban to dis-
able it. The Suburban then struck
Officer Moreau's patrol car,

The Suburban's engine was
revving as if Daniels was trying to

"Moreau moved around the rear
of the Suburban in an attempt to
apprehend Daniels," the FDLE
report stated.
As it did so, Moreau slipped and
fell to one knee.

or so complaints to the police
department, only four have been

tion. Moreau said the Suburban
was free of the patrol car at that
point.
"Moreau stated as he felt his life
was in danger, he discharged his
weapon at the rear of the
Suburban. The Suburban then
started moving forward,. east on
Oak Street, and then south on
Orange," the report stated.
Moreau maintained his position
on Oak Street while Allen pursued
the Suburban. It crashed into a pole
near the intersection of South and
Orange streets. Allen found
Daniels slumped over and unre-
sponsive. Daniels was pronounced
dead at the hospital.
The state attorney said it was
clear to him that Daniels intended

DJs and even radios, Weeks sug-
gested changing the ordinance to
prohibit any. noise that can be
heard 30 feet from the building.
"The bar can stay open, and the
residents can enjoy their homes,"
Weeks said.
With the new ordinance, if the
music could be heard more than 30
feet away, a warning will be'
issued. If it continued, then the
violator would have to appear in
court. If still continued, the viola-
tor could be taken to jail.
Other council members agreed
to the change, but cautioned
Milsapp that if this did not solve
the problem, then the bar would be
shut down.
Milsapp said he is still worried
that his bar is in jeopardy, however,
only time will tell.

Mrs. Lydia Estelle Rea,
98, of Marianna passed
away on Tuesday, Dec. 22,
2009, at the Chipola Nurs-
ing Pavilion.
Mrs. Rea had been a resi-
dent of Marianna for the
past eight years, coming
from Tavares, and was a
member of the Methodist
church.
At an early age, Estelle
discovered her love of fly-
ing and as a hobby, be-
came a pilot. She also en-
joyed playing bridge and
fishing. She was an avid
gardener who loved her
grandchildren.
Mrs. Rea is the grand-
mother of Kelly
Swearingen and her hus-'
band Danny, of Marianna.
The graveside service for
Mrs. Rea will be at 11 a.m.
EST Monday, Dec. 28, in
the Forest Hill Memorial
Park Cemetery in Elberton,
Ga.

GHS girls bounce back

The Graceville Lady Tigers took a 56-53 victory over
St. Petersburg High on Monday, on the first day of the
Lyman High School Christmas Tournament in
Longwood.
The Lady Tigers took the seven-hour bus trip and
arrived just moments before they had to play. .,
It showed, as St. Petersburg jumped out to a 12-7 first-
quarter lead, and a 23-20 halftime advantage.
Graceville got its legs in the third period, however,
outscoring St. Petersburg 18-13 to take a 38-36 edge into
the fourth. A pair of free throws by Shankia Jones put the
Lady Tigers up by five early in the fourth. But St.
Petersburg rallied back to take the lead with three minutes
to play. Mychea Williams found Xaviera Henderson for a
hook shot to put Graceville back up one. Williams drove
the lane moments later for a bucket to put the Lady Tigers
up three.
St. Petersburg had one last chance to tie, but a 3-point
attempt was off the mark as time expired.
Graceville improved to 12-1 with the win.
Jessica McClendon led the Lady Tigers with 14 points,
with Wynterra Pittman adding 12, Williams 11, and Jones
nine. Tiara Sorey scored seven.
Kamika Idom led St. Petersburg and all scorers with 30'
points..
"It: was back and forth right down to the wire,"
Graceville coach Jon Habali said after the game. "We
were a little tired at the start and it showed.
"But I loved the heart and hustle we showed. That's
something we were lacking at moments at the start of the
game, but we finished strong. That's been a problem for
us, but we finished. That's the most important thing."
Finishing strong was a rallying cry for Graceville, after
giving up a 21-point second-half lead to South Walton in
a 62-59 loss Dec. 17.
"The girls showed a lot of heart to finish that game after
what happened in the South Walton game," Habali said.
"(St. Peteisburg) is 6A, and they were 10-2 going into the
game.
"We had two freshman on the court at the end (Jones
and Henderson) and they hustled after it and rebounded
down the stretch. It's a big win, a confidence-booster. It
shows how much finishing means."
The Lady Tigers came back on Tuesday night to beat
Clay 40-39, and were set to face Ocala Vanguard
Wednesday night in the final game of the tournament.

Tigers trounce Ponce De Leon 82-46

After a heartbreaking loss in
their previous game, the
Graceville Tigers bounced back
Monday night with an 82-46
beatdown of Ponce De Leon in
Graceville..
The Tigers .suffered a bitter
defeat Dec. 18 against the rival
Cottondale Hornets, giving up a
17-1 run to finish the game in a
57-50 Cottondale victory.
But the Tigers were able to get
back on the winning side
Monday, dominating the second
and third periods by a combined
score of 58-22.
The win improved the Tigers'
record to 5-4 on the season.
Graceville is 4-1 in district play.
The Tigers trailed 15-5 after
one quarter. First-year Tigers
coach Thomas Register said there
were some lingering effects from'
the Cottondale loss early on
against Ponce.
"We just didn't come to play at
the start. I kind of expected it,"
the coach said. "A part of it was
the Cottondale game. It was a big
emotional loss for them, and they
seemed to lose sight that we had
more games to play after that.
You could just tell by our
demeanor before the game.
"We lost an 11-point lead to a
big rival, and we were still down
about it. We didn't take PDL seri-
ous, and their coach had them
ready to play. After that, (the


players) did everything I asked
them to do and played hard."
The Tigers seized control of
the game in the second period,
outscoring PDL 29-5 to take a
34-20 halftime advantage.
Graceville put up 29 more
points in the third quarter, to
extend to a 63-37 advantage
going into the fourth. "
"In the middle two quarters, we
came out and pressed them, and
we were able to turn them over,"
Register said. "We were able to
trap hard and stay with the basics
of the press. We trusted each
other for one of the first times
this year. We did a good job with
it, and that got us some easy shots
off of steals."

with 17 points. Leander Ford
added 12 points and 10 rebounds.
Cameron Dozier had 13 points,
10 assists and seven steals. Byron
Laster led the Tigers with 15
rebounds. Dozier was recently
diagnosed with "turf toe," a con-
dition that causes pain at the base
of the big toe.
Register said Dozier has been
playing through the pain for the
past few weeks, and his doctor
said that the injury typically takes
about six weeks to fully heal.
Dozier will have some time to
rest, with the Tigers off until Jan.

Registration for youth
ages 5-13 will be held
Jan. 7 from 8 a.m. to 4
p.m. at the Marianna
Educational and
Recreational Expo locat-
ed at 3625 Caverns Rd.
in Marianna.
The registration fee for
basketball is $30 for
those who live inside of
the Marianna city limits,
and $45 for those outside
the city limits.
The fee must be paid

the time, but they got to the
line 33 times in the second
half. That was one of the
big difference-makers."
Another big difference
was the aggressiveness of
the Hornets' perimeter traps
on Dozier, who scored 17
points in the first half but
only five in the second half.
"It was good for us to go
ahead and see that so we
can make adjustments,"
Register said. "I have to
