Williams escapes death penalty

vided free to the community, and
cover such topics as use of the
Employ Florida Web site and
Daytime workshops will be
held on Mondays from 3:15 to
4:15 p.m., Wednesdays from 10
to 11 a.m. and Fridays from 10 to
11 a.m. as well as 3:15 to 4:15

All classes will be held at the
One Stop Center on U.S.
Highway 90. All topics will
rotate per session.
For those individuals unable to
attend day workshops, there will

Circuit Court Judge William Wright ruled Thursday.
that Wesley John Williams, convicted Oct. 2 of four mur-
ders, won't face the death penalty.
The judge has yet to sentence Williams, but issued a
ruling stating death was not a possible penalty in
Williams' case.
The jury found Williams guilty of four counts of first
degree murder, and three counts of aggravated child abuse
in the deaths of his former girlfriend,,Danielle Baker, and
three of her children: three-week-old Aaron, one-year-old
Amarion and Ahmaad, nearly four years old. Williams
fathered the two oldest children.
Baker was shot to death, while the three boys had been
suffocated. The murder occurred in March 2005.
The judge stated in his ruling Thursday that, while the
details of the crimes "were meticulously proven and it
was proven that the defendant was present during the
crimes," his actual participation was not proven to the
.level required for the imposition of the death penalty.
The state had built a largely circumstantial case against
,Williams as either the killer or as a primary participant in
the slaying. Wright had warned he would, have to see
compelling arguments to.justify the death penalty. The
judge apparently did not find enough of that in the argu-
ments filed by the prosecution early last month.
Sentencing will occur at a hearing yet to be scheduled.
State Attorney Glenn Hess said Thursday he anticipates
Wright will order four life sentences without the possibil-'
ity of parole. He said he has no quarrel with the judge's
rejection of the death penalty, given the circumstances.
"The judge did a masterful piece of judicial work in
analyzing the facts and the requirements of the case, and

comed DCF Secretary George H. Sheldon
and other dignitaries to share in the moment,
as hospital staffers celebrated receiving
accreditation from the international
Commission on Accreditation of
Rehabilitation Facilities.
According to James, CARF accreditation is
a voluntary effort and the goal isn't easy to
achieve. In fact, FSH is the only Florida hos-
pital of its kind to have attained it. It is con-
sidered the highest level of accreditation
available to a mental health treatment facility.
The hospital staff members worked toward
the goal for nearly a year, honing and adding
programs for the clients they serve, and
aggressively identifying and correcting prob-
lems or weaknesses that could keep them
from gaining this gold-standard recognition.
The staff charted progress toward their
goals, and on Thursday posted detailed dis-
plays showing how the process worked.
They were rewarded for all their hard work
with certification on their first try, something
not all applicants can claim. Typically, CARF
will ask an entity to come back and try again
armed with recommendations, after the orga-

mary participant."
Defense attorney Walter Smith saw the judge's decision
as a mixed blessing.
"I suppose we have to see this as some kind of victory;
I'm sure Wesley will be glad to know he's not bound for'
death row," Smith said. "But I thought we had our best.
prospects under review by the Florida Supreme Court,
which would have been automatic with a death penalty."
Instead of the Supreme Court, Wesley's case will now
go to the District Court of Appeals, which reviews cases
largely in search of judicial error, rather than scrutinizing
the conviction itself.,
The Supreme Court, Smith theorized, would have taken
a much closer look at the entire case than the District
Court of Appeals will likely undertake.,
Smith will not handle the appeal portion of the
Williams case. He thinks Williams' best hope there is that
the appeals court might find Wright erred in not granting
the motion for a new trial Smith filed after the jury found
his client guilty.
, Wright, acting in the capacity of "an additional juror"
to determine whether the evidence supported the decision
of the 12-member jury, issued.his denial a few days after
the trial.
In it, Wright said that in applying the appropriate stan-
dards to the question,-he found "it is clear that the weight'
of the evidence does support the jury's verdict of guilty as
charged on all counts."

Stolen truck

found at

travel center
The Jackson County Sheriff's
Office recovered a stolen truck
Wednesday that had been missing
for two months. The truck was
found parked at the Pilot Travel
Center on State Road 71 at the
Interstate 10 interchange.
Law enforcement is asking for
the' public'.s help in finding the
person who stole it.
The 1994 white Ford L8000
truck, valued at $34,000, was
identified after it was towed.
According to a news release from
the sheriff's office, Pilot Travel
Center staff said the vehicle had
been parked in the rear parking
lot for several weeks.
When the wrecker company'
made a routine report to the sher-
iff's office, the license plate on
the truck was checked out by the
Florida Crime" Investigation
Center. The plate showed the
vehicle had been reported stolen
on Oct. 6 to the Jackson County

Employab FSH ets recognition

Car catches fire

This Honda Accord caught fire around 8 a.m. Thursday morning on Blue Springs Road, and fire-
fighters quickly extinguished the blaze. A passerby called 911 on behalf of owner/driver Vincy
Porter to report the incident at 8:05, according to information from Jackson County Fire Rescue.
Porter was having mechanical trouble with the car and pulled off the road. After she did so, the
engine started smoking and the fire ignited under the hood. She was not injured in the incident.

Humanity's first Christmas
Habitat volunteers have
been busy arranging and
displaying numerous holi-
day decorations donated to
the thrift store over the
course of several years.

trees and checking lights.

items to gently used trees

month are being "screened
out" and not forwarded for

steps to better protect chil-
dren and vulnerable adults
who are the subject of hot-
line calls.
In a meeting with The
Herald's Editorial Board on
Wednesday, DCF Secretary
George Sheldon said his
agency- will continue to
monitor the screening of
calls, as well as the preven-
tion program, both internal-
ly and by a group of outside
task forces he appointed to
help improve child safety.

kids than ever.
"The Herald article may
have left an impression
about the way we operate
the hot line," Sheldon
wrote. "None of the calls
cited were 'turned away' or
'rejected' or 'unheeded."'

investigation of the case.
McKeithen testified at trial that
Williams .said "he was present at
the scene of the crime, knew who
committed the crime and that he
could be charged with criminal
activity," Wright noted in his
order denying a retrial.

Smith, in cross-examining
McKeithen at trial, attempted to
erode the impact of that inter-
view by pointing out to the jury
Williams' statement had not
been taped.
In his denial of a new trial,
Wright pointed out Williams had
requested an attorney shortly
after making his initial untaped
statement to McKeithen, some-
thing the jury was not allowed to
know about. The court supported
a defense motion to suppress at
trial "anything after the defen-

dant's request for an attorney."
That suppression, Wright said,
"effectively negates trial coun-
sel's cross-examination about the
failure of law enforcement to
record defendant's statement.
Thus, the court finds that the tes-
timony of ... McKeithen was
credible and reliable."
Smith said Thursday he does-
n't really hold out much hope for
a reversal at. the appellate court
level. That court could, however,
ask the Supreme Court for an
opinion. In the event the appeals
court upholds the conviction, the
appeals attorney could ask for a
Supreme Court review.

prove anything other than that he
was in the area.
In the state's petition seeking
the death penalty, Assistant State
Attorney Larry Basford argued
for it in part on the grounds that
a friend of Williams testified at
trial that Williams confessed he
shot Baker and wrapped the chil-
dren with duct tape.

That friend had at first told
police he didn't have any knowl-
edge that might implicate
Williams in the case.
In ruling out the death penalty
Thursday, Wright pointed out the
jurors were not required to
,decide .whether Williams was
guilty of that particular killing
or to determine his specific level
of involvement in any aspect of
the crime. The judge said he was
therefore left to "speculate as to
what exactly the jury found."
If the judge had believed and
ruled based on the friend's testi-
mony; Smith speculated it would
have provided sufficient justifi-
cation for the death penalty, and
Wright would not have had to
weigh several other matters relat-
ing to William's personal respon-

guilty of all charges, "to receive
the death penalty, the defendant's
level of participation must be
directly established to .a very
high level," adding that "the
defendant's actual participation
was not sufficiently proven to the
level required to sentence him to
death under applicable law."

Grand Ridge loses to Chipley Rouhlac

The Grand Ridge Middle School boys
basketball team hosted a tough Chipley
Rouhlac Tigers team Monday, and the
Indians fell in both games. The "B" team
lost 39-19, while the "A" fell 37-17.

In the "B" team game, the Indians fell
behind early, trailing 14-3 after just six
minutes of play. The Tigers continued to
expand their lead in the second period, and
led 22-7 at the half.
The Indians jump started their offense in
the third quarter, posting seven points. But
it proved to be too little, too late for the

young team. At the end of the third period,
Grand Ridge trailed 27-14.
- Blake Johnson and Gavin Pittman led
the Indians in scoring with five points each,
followed by Brian Cox with four points.
The "A" team fell behind in the first
quarter 12-4, and trailed 19-8 at the half.
The Indian offense continued to struggle,

posting four points again in the third quar-
ter, falling behind 27-12.
Dustin Pittman led.the Indians in double
digits with 13 points, followed by Reggie
Creal with four points.
The Indians were scheduled to play
Thursday evening. Results of those games
were not available at press time.

There are risks and-costs to a program of action. But
they are far less than the long-range risks and"costs of
comfortable inaction.

Going through these very difficult economic times, con-
trolling cost is one of the major things that you can do to
really help your bottom line.
Now is the time to renegotiate everything from rent to
cost of goods sold.
So many of your vendors are having such trouble with
falling sales that they are now willing to take significant
price reductions, but you must ask for them. Your suppli-
ers need to retain you as a customer now more than ever,
and they should be willing to do most anything that is rea-
sonable to keep your business.
We were helping a firm that purchased over $5 million
a year from its. primary suppliers. These suppliers' had
quickly passed along their cost increases-particularly
transportation costs-to this business. Now that sales were
falling off, the company needed some relief if it was going
to survive. �
When asked why they had not requested a price break
before, the comment was, "Our purchasing agent just does
not feel comfortable in asking for these." As you can
imagine, I went livid and asked the owner if a savings of
$1 million (20% of $5 million) was worth asking for.
He finally got the point that now things had changed and
that unless he was willing to demand price reductions
from his suppliers, he might not be around much longer.
He was able to get his purchasing agent to buy in by giv-
ing him a percentage of the savings from the cost reduc-
tions they secured and by very clearly demonstrating how
to. ask vendors for price breaks..
At first, the purchasing agent just wanted the vendor to
give them a better price: The owner, however, mandated
that the purchasing agent start off asking for a 20% price
reduction from those suppliers that they knew had nice
profit margins and could afford it. Starting with a number
established an expectation that was reasonable rather than
just asking for any type of price break.
When asking for price reductions, nothing should be off
limits. Whether it is consultants' salaries or office sup-
plies, you must demand price reductions in these, market
conditions. You must ensure that your company has a cost
structure that is workable in today's economy. Youi via-
bility depends on this. I '.
Even if you have signed a contract for service, these
should be renegotiated as well. A recent study found that
six out of every ten chief information officers are renego-
tiating existing contractual agreements. When renegotiat-
ing, your leverage is that these contracts will have to be
renewed in the future, and your willingness to renew is
going to be a function of this renegotiation process.
Now go out and initiate a process of renegotiating each
and every one of your purchase contracts. This just cannot
wait. It must be done as quickly as possible to'get the ben-
efits flowing into your company.
