Along with the previously announced Publix Super Markets Inc. anchor store, the center will include OrangeTheory Fitness. More tenants will be announced as development continues, Regency said in a news release. Construction has begun at the southeast Atlantic Boulevard and Hendricks Avenue site and is slated to continue until mid-2022. Jacksonville-based Regency Centers said the two-story Publix will occupy 60,000 square feet of grocery, retail, and essential ser vices in Jacksonville’s historic San Marco neighborhood. BY MIKE MENDENHALL STAFF WRITER When the Jacksonville City Council approved a plan in June 2019 to combat blight in Arlington with new commercial property design standards, it started a six-year clock for businesses to come into compliance. According to the city Office of Economic Development, six commercial properties have filed initial applications for the Renew Arlington Mandatory Compliance Grant seeking public financial assistance to meet the new standards. They are among 125 commercial properties the city estimates will need to be brought into compliance by the May 1, 2025, deadline. Husband and wife hair stylists Aaron and LaVonia Gipson own and operate Hair Formations Salon at 7435 Merrill Road and filed an initial Renew Arlington grant application in August. The company could not be reached for comment. Kimley-Horn and Associates is the civil engineer and landscape architect on the project. A Wells Fargo bank branch sits on the block between the town house site and the East San Marco development. It is across Arcadia Place from Fletcher Park.PulteGroup to build Wildlight Del Webb community PulteGroup announced Feb. 15 it will build its third Northeast Florida Del Webb community on 226 acres in Wildlight. Wildlight is the master-planned 2,900-acre community in Nassau County along Florida 200 between Interstate 95 and U.S. 17. Raydient Places + Properties is the developer. Del Webb is designed for active adults age 55 and older, the news release said. Model homes are expected to open in early 2022. The development will be along Curiosity Avenue adjacent to Wildlight Elementary School. “We just identied Nassau County as a perfect place for active adults to retire to whether they’re Florida locals or coming in from out of state,” said Tony Nason, vice president of operations for PulteGroup’s North Florida division. Pulte plans up to 660 single-family homes. It will oer 16 oor plans from 1,343 to 3,339 square feet. Homes prices will start in the $200,000s. Walmart plans two more health clinicsWalmart wants to build two more health clinics in Jacksonville in addition to the rst two planned in West Jack sonville and another in Middleburg. The city is reviewing permit applications submitted Feb. 15 for the retailer to add the clinics to its Supercenters at 11900 Atlantic Blvd. and 4250 Philips Highway. Each carries an estimated construction cost of $350,000 for the 6,510-square-foot additions. However, the Jacksonvillebased company is remaining cautious in its outlook in case a “reverse-course” scenario forces closures again in 2021. “Despite a rise in cases in most markets and increased restrictions in some, we have been encouraged by continued improvement in our operating results and this is driven by further meaningful progress on rent collections,” CEO Lisa Palmer said last week during Regency’s quarterly conference call with analysts. Regency reported fourthquarter funds from operations of 76 cents a share, down from $1 the previous year. That was an improvement from its FFO of 61 cents in the second quarter and 60 cents in the third quarter of 2020 as the impact of the pandemic affected its tenants. The results beat the consensus forecast of 72 cents by analysts surveyed by Zacks Investment Research. FFO measures earnings excluding certain noncash charges and is a commonly used analytic for evaluating the performance of real estate investment companies. Regency had collected 92% of fourth-quarter rents as of Feb. 8 at its 411 properties across the country, many of which are grocery-anchored shopping centers. “The hardest hit categories however, especially in the more restricted markets, are still lagging,” Palmer said. “Many entertainment, fitness, sit-down restaurants, and personal service centers are still either not allowed to open or are operating with severe capacity restrictions. This has had the greatest impact on our local small shop operators,” she said. Regency’s properties were 92.3% leased at the end of 2020. All but two of its 19 properties in the Jacksonville market exceeded 90% occupancy. The exceptions were the Mandarin Landing center anchored by Whole Foods in South Jacksonville at 89.1% and the South Beach Regional center anchored by Home Depot and Trader Joe’s in Jacksonville Beach at 85.8%. A Stein Mart store in the Jacksonville Beach center on Florida A1A north of Butler Boulevard closed in October as that Jacksonville-based retailer went out of business. Office Depot closed its store in Mandarin Landing on San Jose Boulevard north of Inter state 295 in November. Regency also reported its planned East San Marco center anchored by a Publix supermarket is 74% leased as construction begins on the property at 2039 Hendricks Ave. It announced Feb. 16 that OrangeTheory Fitness also will lease there but did not name any others. The company’s report said it expects to start collecting rents from East San Marco in the second half of 2022. Regency is projecting 2021 funds from operations of $2.96 to $3.14 a share, up from $2.95 in 2020 but still below 2019’s $3.89. The company is looking at three possible scenarios for this year’s earnings: The reverse course scenario in which the pandemic forces a return to business shutdowns and restrictions; a status quo scenario; and a continued improvement scenario in which restrictions are lifted and more government stimulus helps business. “While we do have a greater sense of optimism and that is inherent in our continued improvement scenario, it is still too early in the year to eliminate our reverse course scenario,” Palmer said. “As we do move through the year, we will have a lot more clarity and visibility and we will refine our expectations accordingly.”Pandemic attens growth at FISFidelity National Information Services Inc., or FIS, said organic revenue growth was flat in the fourth quarter as the pandemic affected consumer spending trends. The Jacksonville-based financial technology company expects better growth in 2021. FIS reported adjusted earnings of $1.62 a share in the fourth quarter, 5 cents higher than the previous year, with revenue little changed at $3.3 billion. Earnings were 6 cents higher than the consensus forecast of analysts, according to Zacks. Revenue for all of 2020 rose 21% to $12.552 billion, mainly because of the company’s acquisition of Worldpay Inc. in mid-2019. FIS said excluding the impact of acquisitions and for eign currency exchange rates, revenue fell 1% organically. The company projects 2021 revenue at $13.5 billion to $13.7 billion with adjusted earnings of $6.20 to $6.40 a share, up from $5.46 in 2020. “Once we lap the COVID pandemic comps in late Q1, we expect revenue growth to accelerate materially, beginning with the second quarter and driving us to our full year expectations,” Chief Financial Officer James Woodall said during the company’s confer ence call with analysts last week. FIS reported growth in its banking and capital markets solutions businesses last year. However, that was offset by an organic decline in its mer chant division, which includes the payments technology business of Worldpay. The drop in consumer spending affects that business.CSX Corp. raises dividend againCSX Corp. said last week it is raising its quarterly dividend payments by 2 cents a share, from 26 cents to 28 cents. This is the fifth straight year CSX’s board of directors has raised the quarterly dividend by 2 cents. It left the dividend unchanged throughout 2016.Kraft Heinz mum on Maxwell HouseThe Kraft Heinz Co. agreed last week to sell its Planters nuts business to Hormel Foods Corp., the food company’s second big divestiture in the last six months. But two years after reports surfaced that Kraft Heinz was considering selling its Maxwell House coffee business, the company remains quiet about that division. As Kraft Heinz reported fourth-quarter earnings last week, it gave no information on its coffee business at all. The lone remaining U.S. Maxwell House plant is the Downtown Jacksonville facility at 735 E. Bay St., which employs about 200 people. The plant has been operating at that site since 1924. The company announced the $3.35 billion sale of its nuts business as it announced earnings. It said the sale includes two Planters production facilities and one Corn Nuts plant and employees will continue to operate as usual under Hor mel’s ownership. “Strategically, this will sharpen our focus and investment on parts of our portfolio with greater growth prospects and competitive advantage,” Chief Financial Officer Paulo Basilio said during Kraft Heinz’s quarterly conference call, according to a transcript posted by the company. “Also, recall that we announced the divestiture of our Natural Cheese business last September. Taken together, these two divestitures improve our mix and growth trajectory,” he said. Kraft Heinz said the nuts businesses produced about $1.1 billion in sales last year. Total sales for the company were $26.2 billion.Consulting Solutions continues growthJacksonville-based Consulting Solutions continued its growth with the acquisition last week of TEK Connexion, a Chicago-based provider of technology services and work force solutions. This is the sixth acquisition for the technology staffing and solutions company since it was acquired by investment firm White Wolf Capital LLC in 2016. As a private company, Consulting Solutions does not publicly report financial data and it did not disclose details of the TEK acquisition. The company said in November it was included in a ranking of the fasting grow ing staffing firms by Staff ing Industry Analysts, a list covering firms that generated at least $100 million in annual U.S. staffing revenue. However, Consulting Solutions did not say where it ranked and Staffing Industry Analysts did not publicly release its full list. West Jacksonville is the region’s largest submarket for industrial space, roughly 49 million square feet, with a tight vacancy rate below 5%, according to fourth-quarter reports by area commercial real estate companies. Peter Anderson, Pattillo vice president, said the speculative buildings are planned on the parcel next to the BMW regional parts distribution center. Building 2 is a proposed 169,400-square-foot multitenant center at 6040 Imeson Road. It is designed for multiple office fronts to divide into units of 40,000 to 80,000 square feet. The cost to build it to a shell condition is $10 million. Building 3 is a proposed 297,979-square-foot warehouse at 5800 Imeson Road. The shell cost is $13 million. It is targeted for a single tenant but could be split into two spaces if required. The projects are planned west along Imeson Road between Forshee Drive and Moncrief Road. “We are proceeding with design and permit application and will start construction of the multitenant building immediately upon approval,” Anderson said. He said the larger building will be developed as the market demands. “The Jacksonville Industrial market has maintained low vacancy rates and we expect the economy to improve in 2021, thus we have confidence the project will be successful,” he said. The property is near Westside Industrial Park, which Pattillo affiliate Stone Mountain Industrial Park developed. Atlanta-based Stone Mountain Industrial Park owns the property where the two structures will be developed. North Jacksonville is the area’s second-largest industrial market. Based on four commercial year-end industry reports, North Jacksonville has about 31 million square of industrial space at an average vacancy rate of 10.5%. While I was an undergraduate, I interned for my local U.S. representative. I learned that I enjoyed the process of the law and government and that I enjoyed helping people. I regularly elded telephone calls from constituents asking questions about legislative initiatives and providing their input or concern. I enjoyed hearing their dierent perspectives, and realized how greatly the law can impact people’s lives. Later I learned that a law degree would allow me to assist people struggling with legal matters in a way I never could have before. Someone who inspires me: My brother. He might be younger than I am, but he is a testament to the fact that tremendous things can be achieved by giving 100%. How do you relate your undergraduate degree to your practice of law? My undergraduate degree is in history. Law in the U.S. often is created by precedent from prior cases. To understand the law and identify legal principles that apply today, lawyers look at previous legal decisions, some more than a century old. Reviewing those cases provides a glimpse into history, not just about the particular area of law you are studying, but also at important issues being addressed at that moment in history. How did you decide your practice area? During law school, I learned that I enjoy the courtroom environment and the quick thinking required to present an argument in court. While my business litigation practice spans many industries, one that I focus on is wine and spirits, a family business for me. My grandfather owned a liquor store outside of Washington, D.C.; my father works for a wine and spirits distribution company; and my brother works for a winery in California. I like to think of my eort to cultivate a wine and spirits legal practice as my own connection to the industry my family has worked in for generations. If I could change anything in the legal system, I would ... Discovery in civil litigation has become too onerous as a result of corporate data and information being stored electronically. Reducing the burden of electronic discovery would make the legal process more eective and aordable to litigants. What community service have you pursued and why that? I am a board member of the Rotary Club of Riverside Jacksonville. In that capacity, I am heavily involved in our club’s annual Riverside Craft Beer Festival, which raises funds for the Rotary Foundation and Community PedsCare. I also am on the board of ImpactJAX, JAX Chamber’s young professionals group. I have met many great friends in both organizations, and each provides outstanding opportunities to give back to the community. What’s your advice for new lawyers? Finding a mentor is key. My mentors not only make me a better lawyer, they also make the practice of law more enjoyable. Steve Walker, regional director at Publix, said the location “will give Publix the opportunity to continue providing legendary service to our loyal customers.” District City Council member LeAnna Cumber said having a Publix as well as other stores and restaurants in the heart of San Marco “will continue to enhance the quality of life for all residents in the San Marco area including new residents on Philips Highway and along the South Bank.” Regency Centers is a national owner, operator and developer of shopping centers. The city issued four permits Feb. 9 for J. Raymond Construction Corp. to build the retail center at total construction costs of $9.7 million. The development cost will be higher when other work, including interior build-out, is approved. East San Marco is at 2039 Hendricks Ave. The city issued the horizontal work permit in December for the 3.25acre site. Permits issued Feb. 9 show: A two-story building totaling 76,588 square feet, topped by a 39,000-square-foot Publix on the top floor and parking on the bottom at a cost of $7 million. A two-story retail building totaling 8,665 square feet at $1.25 million. A one-story retail building of 9,951 square feet at $1.2 million. A one-story 1,430-square-foot Publix Liquors store at $250,000. The site also has surface parking. Regency Centers and England-Thims & Miller Inc. submitted civil engineer ing plans to the city and St. Johns River Water Management District in May for the project. Initial discussions surfaced in 2002 about a Publix and mixed-use devel opment on the site. In 2006, Regency Centers and The St. Joe Co. announced the project, including Publix and condominiums. The project was delayed by several factors, including the recession and a residential development partnerthat pulled out of the deal in 2017. The city approved previous designs that included apartments and town houses. In 2018, Regency Centers Chairman and CEO Martin E. “Hap” Stein Jr. said the project would continue but with just the shopping center. There will be far fewer residences than approved in 2014. Luxury builder Toll Brothers filed plans Feb. 9 for a 27-unit town house community on 1.03 acres one block east of the East San Marco shopping center development. McKinley said Nov. 11 construction on the Publix should be completed by summer 2022. He told the San Mar co Merchants Association quarterly meeting via Zoom that Publix could open 30 to 60 days later after it outfits and prepares the space. So I would say we’re no further ahead than we were back in August,” he said. According to the economic development office, no compliance grant money has been awarded as of Feb. 16 and no project application has been approved.THE OVERLAYCommunity stakeholders and commercial business owners in the Renew Arlington Community Redevelopment Area debated design standards for the zoning overlay with district Council member Joyce Morgan and the Renew Arlington Advisory Committee for years before they were approved. The updated landscaping, signage, parking and fencing standards aim to increase commercial property values and encourage more business investment in three major business corridors: University Boulevard from the Arlington Expressway to Fort Caroline Road. Merrill Road from University Boulevard to Interstate 295. A section of Arlington Road from University Boulevard to Rogero Road. The Council voted 19-0 in February 2020 to add the reimbursement grant program for landscaping, fencing and signage to the zoning overlay ordinance. Kirk Wendland, executive director of city economic development, said in a Feb. 16 email that the COVID-19 pandemic “modified priorities” and impacted the pace at which the city is processing the applications and businesses are filing. “There is also a fair amount of analysis and potentially permitting approvals that go into the review process,” Wendland said. “So some applications may move very quickly and others may take several iterations. No two will be exactly alike.” Wendland said the program could exceed the city’s $7.33 million cost estimate, but officials expect the money to be there to pay for it. The grant money comes from property tax dollars collected for the Renew Arlington Community Redevelopment Area Fund. In February 2020, the city projected 5% revenue growth in the fund through fiscal year 2024-25, which would bring the balance to an estimated $8.96 million. “Revenues are coming in above the projected levels so we still feel confident there will be adequate funds to cover the cost of the program,” Wendland said. The grant reimburses commer cial business owners 100% up to minimum overlay standards for the removal and replacement of fencing and existing signage to bring the property into compliance. The grant program also reimburses some costs associated with landscaping and creating larger buffers to separate proper ties from the street and from resi dential and adjacent commercial sites. According to Wendland, the city does not provide direct aid for costs upfront. Applications pass through the Renew Arlington design review process to ensure the plans can pass the city’s 10-set review process.COLLEGE PARKCollege Park, the former Town & Country Shopping Center, is the largest commercial property in the Renew Arlington Zoning Overlay. The 18.27-acre center is the only applicant as of Feb. 16 to provide the city preliminary project costs. In paperwork submitted June 22, JWB Real Estate Capital President and College Park project title manager Alex Sifakis estimates it will cost about $1.4 million to bring College Park’s landscaping, buffers and fencing into compliance. Costs include construction, engineering, permitting and installation of landscape buffers and screening, trees, irrigation, sod and other expenses. JWB plans to remodel and expand the 200,000-squarefoot center with a shipping container food court and park, two apartment buildings, public open space and a potential Ellianos coffee shop. Sifakis said Feb. 12 the overlay standards, coupled with the compliance grant, will improve aesthetics and will bring long-term benefits to Arlington’s business corridor. Sifakis said Feb. 17 that because College Park’s compliance costs are preliminary, he did not want to estimate how much of the costs the grant will cover. The program rules state that any mandatory compliance grant exceeding $100,000 needs approval from the Renew Arlington Agency board, which manages the CRA. “It’s enabling us to do a much better project,” Sifakis said. “I think the overlay will make the whole neighborhood a more attractive and pedestrian-friend ly corridor.” SMALL BUSINESS CHOICESFor small business owners in the overlay, the application process and paying for the compliance work upfront can be a challenge. The Gipsons purchased their Arlington store in 2007 for $115,000 after launching Hair Formations in 1999. Aaron Gipson said Feb. 15 the couple invested $160,000 to convert the 1,296-square-foot house and 0.19-acre property for their salon. The Gipsons said they are unsure how much it will cost to bring their property into compliance. The Hair Formations property is zoned Planned Unit Development and the Gipsons said city officials told them the property needs to be rezoned to qualify for grant funding. The rezoning could cost about $2,000. The business could have had the rezoning costs waived last year through a city COVID-19 relief program that temporar ily suspended some city fees for developers, but Gipson said they were not aware of the waiver. “What it boils down to is that in order for us to even be a candidate for the grant, we would have to go ahead and resolve the rezoning from our own pocket because we missed the deadline,” he said. Council approved $30,435 and the economic development office hired landscape architect Brian Wheeler of GGI-Tapestry LLC to provide business owners with free draft designs for compliance upgrades. The Gipsons said Wheeler has inspected their property, which needs new fencing and tree buf fers. An unused driveway apron also must be brought level with the sidewalk. If the property were to remain zoned PUD, Gipson said they also would have to remove several feet of concrete behind their building for hard surface compliance standards. Wheeler recommended the rezoning. “He said, ‘Mr. Gipson, you have to weigh it out. It’s probably going to be cheaper for you to do the rezoning, pay the $2,000,’” Gipson said. At 58 and 50 years old, respectively, Aaron and LaVonia Gipson are weighing whether the cost of compliance outweighs potentially selling their business before the May 2025 deadline.
