AMENDMENT TO CODE OF FAIR COMPETITION
FOR THE

PAPER DISTRIBUTING TRADE

As Approved on September 25, 1934


ORDER

APPROVING AMENDMENT TO CODE OF FAIR COMPETITION FOR THE
PAPER DISTRIBUTING TRADE
An application having been duly made pursuant to and in full
compliance with the provisions of Title I of the National Industrial
Recovery Act, approved June 16, 1933, for approval of an amend-
ment to a Code of Fair Competition for the Paper Distributing
Trade, and due notice and opportunity to be heard having been
given thereon and the annexed report on said amendment con-
taining findings with respect thereto having been made and directed
to the President:
NOW, THEREFORE, on behalf of the President of the United
States, I, Hugh S. Johnson, Administrator for Industrial Recov-
ery, pursuant to authority vested in me by Executive Orders of the
President, including Executive Order No. 6543-A, dated December
30, 1933, and otherwise; do hereby incorporate by reference, said
annexed report and do find that said amendment and the Code as
constituted after being amended comply in all respects with the
pertinent provisions and will promote the policy and purposes of
said Title of said Act, and do hereby order that said amendment
be and it is hereby approved, and that the previous approval of said
Code is hereby amended to include an approval of said Code in its
entirety as amended.

REPORT TO THE PRESIDENT


The PRESIDENT,
The White House.
SIR: This is a report on an amendment to the Code of Fair Com-
petition for the Paper Distributing Trade which was apprwled by
you December 23, 1933.
The effect of this amendment will protect the members of the Code
Authority against liability in their own activities on behalf of
the Trade.
The Deputy Administrator in his final report to me on said
amendlim.bt, to said Code having found as herein set forth and on
the basis of all the pr..-i.'.lii. gs in this matter;
I find that:
(a) The amendment to said Code and the Code as amended are
well designed to promote e he policies and purposes of Title I of the
National Industrial Recovery Act including the removal of obstruc-
tions to the free flow of interstate and foreign commerce which tend
to diminish the aniniirn thereof, and will provide for the general
welfare by promoting the organlizati.:ii of industry for the purpo-o
of cooperative action of labor and mi; laigement under a i,.uate gov-
ernmental sanction and supervision, by elimini ;ting uiiinfir competi-
tive practices, by promoting the fullest p' ibi ,' utilization of the
present productive capacity of industries, by avoiding undue re-
.-ti' tion of production (except as may be temporarily required),
by in.ni a-;ing the consumption of industrial and nagiw-iiltural prod-
uets through increasing purchasingt power, by reducing and relieving
unemployrn-rit, by improving standard, 1 of labor, and by otlerwii~e
rehabilitating ind ustry.
(b) The Code as amended complies in all r'plcts with the
pertinent prn'vi-ions of said Title of said A.t, including without
limitation sub-section (a) of Section 3, sub-section (a) of Section
7 and sub-section (b) of Section 10 thereof.
(c) The Code emplwerl the Code Authority to propose the
aiii.'idment on behalf of the Trade as a whole.
(d) The aniie.,dment and the Code as amended are not de-igned
to and will not permit monopolies or monopolistic practices.
(e) The amendment and the Code as amended are not de-igned
to and will not elimIinlate or oppress small enterprises and will not
operate to ( (f) Those engaged in other steps of the economic process have
not been deprived of the right to be heard prior to approval of said
amendment.
For these reasons this amendimi'le-nt has been approved.

AMENDMENT TO CODE OF FAIR COMPETITION FOR
THE PAPER DISTRIBUTING TRADE

Article IV of the Code of Fair Compejitiion for the Paper Dis-
tributing Trade shall be amended by including therein an additional
Section to knowSectio t e o s section 8, and shall provide as follows:
SECTION 8. Nothing contained in this C(de shall constitute any
of the members of the Codle Authority or of :1ny regional co,,mmitteo
appointed under the promvisions, of Section 5 of Ariiticl: IV thereof,
partners for any purpose. No member of the iCodt' Authority or of
any regional committee Ihall be liable in any manner to anyone for
the act. of any member, officer. a-gent (,r employee of the Cod-e Au-
thority or of ainy regional coliluittee perfin.iimed pursinant.t to the
provisions of the Code. No menllber of the ('Coe Authority or any
regional committeee, exerci-ing in the c ionduct of Ii., dutlies under the
Code reasonable diligence, shall be liable to anyone for any action or
omIission to act under the Code. Nothing i-herein contained shall
relieve any member of thle ('ode Autlority or of any O regional com-
mittee from du(tie-i or repoiisibilities iMipod u:i pin him by the
Code, minor shall it alfect the powers granite'd to tihe Codle Authority
by the Code.
