MEMORANDUM

TO: Jake Van

SUBJECT: Report of Land Plan Review Task Force

Our group met Thursday, August 11 to review the current draft of the DCA's Land Use Plan.

We make the following recommendation to the BBE:

BBE should withhold any support of the current document and should instead call for the repeal of
the requirement in Section 186.021(4). F.S. for preparation of a State Land Development Plan, In
addition, the following portions of Chapter 380: 380.06(12)(a)1: 380.06 (14)(a);380.061(3)(a) 7;
380.07 (3),; 380.031(17), F.S. also should be repealed .

Our task force feels this plan is unnecessary for the regulation of DRIs because these developments
are adequately regulated by current statutes s well as DCA's rules. If these issues are to be addressed
otherwise, they should be pat of the comprehensive 1996 legislative consideration of changes to the
State Comprehensive Plan. However, we do not feel these proposed policies should be added to that
plan either.

In addition, we believe the listing of Resources and Facilities of State Significance" found in
Appendix A is overly broad and tends to elevate many locally or possibly regionally significant
resources/facilities to a status of a facility or resource of statewide significance. A case in point is the
listing of al"public access points to public lands and beaches." Only the legislature has the power to
create such a list Certainly the DCA does not have the legal authority to promulgate a lis of this
nature.

Others of our task force not present at the meeting also advised us they found many problems with the
document including an overall comment that the document is poorly written and many "goals" or
"policies" are stated in too absolute terms In the initial report, no sources were listed for many of the
facts used to support the DCA positions present After criticism about this shortcoming the DCA
added "sources" throughout the document. The problem with this is that many ofthese sources are
either DCA documents, notes from workshops held in various regions of the state as well as
unpublished research.
