RE: COMMENTS TO 20-YEAR PERMIT LANGUAGE, AMENDMENTS TO
ALTERNATIVE DEP PROPOSAL MFLS, COMMENTS TO DRAFT
CONSOLIDATED RECOMMENDATIONS


I. Comments to 20-year permit language

A. Consumptive use permits with a 20-year duration are too
long in areas where water withdrawals are causing adverse
environmental impacts, and the respective governing
boards should have the discretion to set shorter permit
durations based on environmental conditions.

B. If the 20-year language is adopted, the 5-year reviews
should consider not only adverse impacts on existing
legal users or water sources unanticipated when the
permit was originally issued, but should also consider
environmental impacts caused due to the permitted
withdrawals.

II. Amendments to Alternative DEP Proposal minimum flows and
levels

A. Please see attached memo dated January 30, 1997. The
comments therein are equally applicable to this draft of
the Alternative DEP Proposal. Reference is specifically
made paragraph III of that memo, entitled "Exemption to
Legislation."

III. Draft Consolidated Recommendations

A. Page 2, line 3, between "Coast" and "are" insert "and
Hillsborough, Pinellas, and Pasco counties"

B. Page 7, line 38, new paragraph d. to read "Those priority
areas and waters in Hillsborough, Pasco and Pinellas
counties identified pursuant to Sec. 373.042(2), Fla.
Stat. (1996 Supp.) shall be exempted from this law 's
operation and effect so that no delay results in the
implementation of minimum flows and levels in these
priority areas and waters".

C. Page 9 Striking paragraph 37 in its entirety is
preferable. If the paragraph remains, Page 9, line 26,
after "water resources", strike the semicolon, insert a

comma, and add "and any environmental impacts which may
be occurring as a result of the permitted withdrawals."
