3 373.223(2), Florida Statutes, providing that

4 the governing board of a water management

5 district and the Department of Environmental

S14 Be It Enacted by the.Legislature of the State of Florida:

- 16 Section 1. Subsection (2) of section 373.223, Florida
S17 Statutes, is amended to read:

S18 373.223 Conditions for a permit.--

S19 (2) The governing board and or the department may
20 authorize the holder of a use permit to transport and use

_21 ground or surface water beyond overlying land, across county
S22 boundaries, or outside the watershed from which it is taken if

S23 the governing board and er department determine debeemines
24 that such transport and use is consistent with the overall

251 public interest, that no adverse environmental impact will
6 result on the withdrawal area due to said transport, that just

271 compensation is provided to the withdrawal area by the

l permitholder, and that all alternative sources of water,

29 including desalinization and reverse osmosis, have been

30 evaluated and shown to be economically unattainable, and No

local government shall adopt or enforce any law, ordinance,

rule, regulation, or order to the contrary.

Section 2. This act shall take effect October 1, 1983.




HOUSE SUMMARY

Provides that the governing board of the water management
district and the Department of Environmental Regulation
together, rather than either one alone, may authorize the
holder of a consumptive water use permit to transport and
use ground or surface water beyond overlying land, across
county boundaries, or outside the watershed from which it
is taken if no adverse environmental impact will result
on the withdrawal area, if just compensation is provided
to the withdrawal area, and if all alternative sources of
water, including desalinization and reverse osmosis, have
been evaluated and shown to be economically unattainable.
