1 A bill to be entitled

2 An act relating to water and sewer systems;

3 creating s. 367.065, Florida Statutes;

4 providing that the Public Service Commission

7 to the issuance, extension or amendment of a

9 utility to provide service; prohibiting the

Ic 17 Be It Enacted by the Legislature of the State of Florida:

S19 Section 1. Section 367.065, Florida Statutes, is

11 2 created to read:

S21 367.065 Local government comprehensive plans.--

S22 (1) If the commission receives written objection to

S23 the issuance, extension or amendment of a certificate to a

S24 utility from any person having standing to object, alleging

25 that the issuance, extension or amendment of the certificate

26 will authorize the provision of water or sewer service in a

27 manner inconsistent with the general sanitary sewer, solid

28 waste, drainage, and potable water element or the land use
29 element of the comprehensive plan of a county or municipality,

30 the commission shall consider the comprehensive plan of the

1 county or municipality and the alleged inconsistency prior to

2 making its final determination. 1.16

3 (2) The commission shall not issue, extend or amend a 1.17

4 certificate in any case where the provision of service by the 1.18

5 utility is inconsistent with the general sanitary sewer, solid

6 waste, drainage, and potable water element or the land use 1.19

7 element of the comprehensive plan of a county or municipality. 1.20

8 Section 2. Each section within chapter 367, Florida 1.21

9 Statutes, which is added or amended by this act, is repealed 1.22

10 on October 1, 1989, and shall be reviewed by the Legislature

11 pursuant to s. 11.61, Florida Statutes. 1.23

12 Section 3. This act shall take effect October 1, 1983. 1.24
