RECOMMENDATION: It is recommended that the Board of Directors provide direction to Authority
staff regarding possible modifications of SWFWMD's proposed Minimum Flows and Levels, including
the following issues: (1) Change the "Sunset" provision from October 1, 1999 to October 1, 2010; (2)
Include the Recovery Strategy as part of the Minimum Flows and Levels Rule Chapter 40D-8; (3)
Specify clearly that Minimum Flows and Levels have "no regulatory effect" on existing permittees until
the Recovery Strategy is adopted, or while a permitted is in compliance with the Recovery Strategy; and
(4) Specify that the Authority shall develop and submit for District approval a wellfield operations plan
for the eleven affected wellfields which will optimize wellfield management and resource protection.

DISCUSSION: At the Emergency Meeting on September 15, 1997, the Board of Directors authorized
a request for Peer Review of the Minimum Flows and Levels which SWFWMD is seeking to establish,
and also authorized a request for a public hearing. A copy of the Authority's request for Peer Review is
attached for your information. The first opportunity for the Authority to request a public hearing is on
the date of publication of the MFL proposed rule in the Florida Administrative Weekly. This will occur
on Friday, September 19th, and a copy of the Authority's request for a public hearing will be provided to
the Board at our meeting on Monday, September 22nd.
As discussed at the Emergency Meeting, SWFWMD is seeking additional input on the establishment of
Minimum Flows and Levels, and intends to further revise the proposed MFL rule. The Peer Review
process will allow the scientific basis, methodology, and data used in establishing MFLs to be reviewed.
However, there are other issues presented in these proposed rules (sunset, recovery strategy, regulatory
effect, and development of a wellfield operations plan) that are not subject to Peer Review. The
Authority has an opportunity to provide input on these additional issues through the public hearing
process. In order to provide direction to Authority staff and to determine the Authority's position on
these issues, there will be an opportunity for discussion of these issues at our Board meeting. Following
that discussion, the Board is requested to provide direction and determine the Authority's position on
these issues for purposes of further discussions with SWFWMD on the proposed MFL rule, as well as
for purposes of the public hearing that SWFWMD will hold on this matter.
