RE: SWFWMD Providing Accidental Death and Dismemberment j
Section 373.079(3), F.S., provides that the chairman and
members of the board shall receive no compensation for
such services, but while officially on work for the
district shall receive their actual traveling expenses
and subsistence and lodging, not to exceed the statutory
amount paid officers and employees, and other expenses
in the actual amount incurred therefore.
It is my opinion that insurance premiums to provide coverage
for accidental death and dismemberment of board members
while on board business would be an unauthorized use of
Jay Ahern has sent you a copy of a 1960 opinion from the
attorney general substantiating this position, but
bear in mind that it is now 15 years old.
Bob Martinez said that the school board provides some
kind of coverage. It might be appropriate to check with
Crosby Few and see what authority they have. You may fin
that this coverage is actually paid for by the individual .
themselves and they just come under the larger group with
no contributions coming from public funds. I think it is
worth a call to Crosby Few.
