Re: Unemployment Compensation Assessment for Late Filing

letter proposed to be sent to the Unemployment Compensation Bureau
contesting the assessment of penalties against the District.

Re: Debit Memorandum Account No. 975519

Gentlemen:

Reference is made to your Debit Memorandum of June 24, 1975 charging the
Southwest Florida Water Management District Interest and Penalties for
late filing the first through the fourth quarters report for 1974.

It is our position that the District is not responsible for the amount
being charged because of our contest of the application of Chapter 443,
Florida Statutes, to the District. The District never received an adjudica-
tion on this point. Also, reports and responses have been made by the
District only because the Governing Board directed employees be protected
without admitting coverage of the law to the District. It is further
contended that the District, as a state agency, and as is all state
entities immune from penalties and fines such as are attempting to be
assessed by your recent correspondence. We call your attention to the
provisions of Section 443.08(5)(b), Florida Statutes, restricting the
application of reimbursement payments only as far as practicable with
the respect to the State.

Accordingly, I would appreciate your reviewing the above and advising me
of your findings.
