Dear Mr. Zethmayr:
Upon receipt of your letter of February 28, 1975, the District staff
has investigated the matter.

It appears that the repeal of said act would be advisable.
has found there are some areas of fill dikes and dwellings
constructed thereon in apparent reliance upon said act.

The District has also found that some of the work has been done in total
disregard of this District permitting requirements. In addition, I find
that said Futch Act is inconsistent with the District's Rules and Regulations
on placing fill within the mean annual flood plain of a lake (16J-1.06(4)(a) ).
Accordingly, the District in the past recommended in concurrence with the
Oklawaha River Basin that the Futch Act be repealed. It appears that the
Act's repeal is advisable but the legal.ramifications will only be resolved
through the courts.
