.Jl you requested, I investigated the State Retirement Law under Chapter 121
..- aMended by Chapters 74-302 and 74-376, Laws of Florida. The amendments
t t change the contributions to 9% of the gross salary for the regular
gp g yees which is now to be paid by the employer. Another change increased
7 -.iW rate from 6% to 8% as the contribution for special risk members. Also,
S',the law requires units like SWFWMD to assume the total contribution to the
stB' a.t s of October 1, 1975.
L *t...the question as to whether SWFWMD can withdraw from the Florida Retirement -
c twe f and go on its own plan, I find the law does not permit it. The
S0I=Wmrnt system under Section 121.051(a) F.S., is a compulsory participation.
STltla, once a unit elects to join the system, it is locked in for life. I have
ivwtflad this finding with Keith Pafford, Legal Advisor with the Division of
S tirement in the Florida Department of Administration. .
