RE: Harmon Shields Letter to You of October 15, 1974
Proposed Interagency Agreement between DNR and
Pollution Control

Dear Don:


I have reviewed Mr. Shields letter and the proposed interagency
agreement and urge you to proceed slowly on this.

Section 373.106 (1) provides that no construction may
begin on a project involving artificial recharge or the
intentional introduction of water into any underground
formation without the written permission of the Governing
board of any water management district within which the
construction will take place. (Activities relating to oil and
gas production are excluded.)

The proposed agreement is not consistent with the statute and
as best I can figure, it is not consistent with the flow
chart attached to the proposed agreement.

I urge you and members of the staff to proceed carefully in
preparing a response to this for fear of giving up one of the
means necessary in order for the District to properly meet its
responsibility relating to the water resources within the
District.
