RE: Title to SWFWMD lands purchased with WRDA funds not
required to be transferred to TIITF


The District recently received letter from DNR asking for an
early reply as to whether or not the lands purchased with WRDA
funds would be required to be transferred to the TIITF pursuant
to Section 253.03, Florida Statutes.

The Department of Administration has been directed by Section
28 of the General Appropriations Act to require transfer of
title no later than December 31, 1972, otherwise to withhold
further release of appropriated funds after that date.

I have researched this thoroughly and there is no question in
my mind but SWFWMD lands acquired with the use of WRDA funds
are clearly excluded from the application of this section.

f Section 378.04 relating to Water Resources Development Account
states

"...there shall be available to any...water
management district...out of state water resources
development account...sums of money...for the
acquisition of lands for water storage areas....
Said sum...may be a grant to said districts."

Section 253.03(1) states

"The Board of Trustees of the Internal Improvement
Trust Fund of the state is vested and charged with
the acquisition, administration, management, control,
supervision, conservation, protection, and disposition
of all lands owned by, or which may hereafter inure to,
the State or any of its agencies, departments, boards
or commissions, excluding lands...title to which is
vested or may be come vested in any...water management
district....lands vested in the Board of Trustees of
Internal Improvement Trust Fund shall be deemed to be:

^ (g) all lands which have accrued...to the State
from any source whatever, excluding...land
title to which is vested or may become vested
in any...water management district...."

SWFWMD acquires sums of money from WRDA in the form of grants
which constitute assistance from the state to the governing
board for acquisition of lands for water storage areas as
authorized under Chapter 378.
