SWFWMD Hiring Procedures

Yesterday Clint Schultz asked us to advise him on whete r or
not the District could pay the moving expenses of a new
employee. This would be the Ground Water fy4roloigist. i It seems
that they have located a man that they would like to hire but
this has become one of the considerations.

The Comptroller's office has issued regulations in the
of General Accounting Division Operational Proced4iesa
provide that moving expenses may be paid by state agepn
when such expenses are approved by the State Personael
and the move is for the direct and sole benefit of the
This seems to be directed to the situations where pw
is already in the employment of the state and is transj
from one location to another.

The District, not being a state agency, as such, would
be specifically governed by this since they do not sub
the jurisdiction of the State Personnel Boa"d. "iteho
submit to the jurisdiction of the State Budget Commiss

Salaries for employees of the District are qet by Boaro
with the Director appearing to have very broad di'scretj
this matter.

I can find no specific Statutory authority at~w Siing
payment but neither do I find Statutory authority proh:
it.

Clint tells me that he has talked to the auditor in Ta:
who would audit the District books who has also rcite
when they run across this in any of their audits they i
notation that they find no statutory provision for it i
condemning it.

I advised Clint that I concurred in this position, having
been unable to find any reference to this matter by Stitute
or applicable rule or regulation and suggested that if they
felt that it was Amportant enough that these expenses e paid
they should do so only with the concurrence of the Chaarmani
of the Board and further that they seek ratification by the
fu Board at its next meeting.
