Dear Dale:
This relates to the escrow deposits matter which has no yet
been concluded.; -
I again discussed these land and easement purchases with Mr.
SMyron Gibbons, Attorney for your Board.

Myron made a suggestion that I consider excellent and believe
will %e acceptable from all angles. I relate this suggestion
with additions by your accounting department and myself as
S a recommendation for our future procedure.
1. Checks paying for rights-of-way, easements, and land
purchases handled by our land acquisition department and
attorney will be made out to the seller and Myron Gibbons,
Attorney for S.W.F.W.M.D.
2. In many cases such as where the purchase of improved
property is made but possession is temporarily retained
-by the seller, two checks could be prepared, the smaller
to be retained until title and possession are complete.
3. In all cases the possession of these checks will remain in
the hands of representatives of the District until Myron
decides the conditions of the purchase and sale have been
met. Myron will then endorse and deliver the check or
checks. It will, of course, require endorsement by all
payees before any of these checks can be cashed.
4. Under this procedure no escrow deposit will be needed and .
therefore no bank fees or attorney's fidelity bond fees
will be incurred. ...

In order to help our attorney keep track of closing costs, I
further recommend that we open accounts in the name of the
District with the Sheriff and Clerk of the Circuit Court in
counties in which we are active, and ask our attorney to
charge these direct accounts for fees and costs of these
officers for official services, recording and the like. These
officers can credit a governmental agency but not an individual
or firm
