CHAPTER 63-114

HOUSE BILL NO. 180

AN ACT RELATING TO DEPOSITS OF MONEY OF THE STATE
OR ANY MUNICIPALITY IN THE BANKS OF THE STATE;
AMENDING SECTION 18.10, FLORIDA STATUTES, BY ADDING
THERETO A NEW SUBSECTION TO BE DESIGNATED SUBSECTION
(4); PROVIDING THAT MUNICIPAL OFFICERS AND STATE
OFFICERS MAY HOLD STOCK OR BE AN OFFICER OR DIRECTOR
OF A BANK WITHOUT DISQUALIFYING SUCH BANK AS A DE-
POSITORY OF MUNICIPAL FUNDS OR STATE FUNDS; AND PRO-
VIDING AN EFFECTIVE DATE.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA:

Section 1. Section 18.10, Florida Statutes, is amended

by adding thereto a new subsection which shall be designated Sub-

section (4), and which new subsection shall read:

18.10 DEPOSITS OF MONEY IN THE BANKS OF THE STATE,

(4) The fact that a municipal officer or a state officer,

including an officer of any municipal or state agency, board,

bureau, commission, institution and department, is a stockholder

or an officer or director of a bank will not bar such bank from

being a depository of funds coming under the jurisdiction of any

such municipal officer or state officer, provided it shall appear

in the records of the municipal or state office that the governing

body of such municipality or state agency has investigated and

r determined that such municipal or state officer is not favoring

such bank over other qualified banks.

Section 2. This act shall take effect immediately

upon becoming a law.
