.7 WHEREAS, the Legislature during the 1986 Legislative
.8 Session created the Environmental Efficiency Study Commission
.9 and charged the commission to submit a report to the
!0 Legislature by February 1, 1987, with recommendations that
!1 would eliminate duplication and promote the efficient
t2 enforcement and administration of environmental and public
!3 health laws, and
:4 WHEREAS, the Environmental Efficiency Study Commission,
!5 after listening to extensive testimony and conducting
!6 workshops to arrive at solutions to environmental regulatory
!7 inefficiencies, has determined that more time is needed to
:8 complete its legislative mandate,
!9 WHEREAS, the members of the Environmental Efficiency
10 Study Commission have volunteered to serve for an additional
11 period and have requested that the life of the commission be

2 extended in order to more thoroughly evaluate the information
3 collected and formulate recommendations, NOW, THEREFORE,
4

5 Be It Enacted by the Legislature of the State of Florida:
6
7 Section 1. Section 62 of chapter 86-186, Laws of

8 Florida, is amended to read:

9 Section 62. (1) This section may be cited as the
10 "Environmental Efficiency Act of 1986."
11 (2) There is created the Environmental Efficiency

12 Study Commission consisting of 15 members. The Governor, the
13 President of the Senate, and the Speaker of the House of

14 Representatives shall each appoint five members.
15 (3) Each member shall be entitled to receive per diem

16 and expenses for travel, as provided in s. 112.061, Florida
17 Statutes, while carrying out official business of the

18 commission.

19 (4) The commission shall be staffed by an executive
20 director and other personnel who shall be appointed by the

21 commission and who shall be exempt from the provisions of part
22 II of chapter 110, Florida Statutes, relating to the Career

23 Service System.
24 (5) The commission shall be assigned, for
25 administrative purposes, to the Joint Legislative Management

26 Committee and shall be subject to the established policies and
27 procedures of the Administrative Services Division of the

28 Joint Leoislative Manaament Committee. The Joint Legislative

29 Management Committee and each state agency shall provide
30 assistance when requested by the commission. Additionally,
31 the commission is authorized to employ staff and consultants

2 as necessary to fulfill its responsibilities. However, the

3 employment of staff and consultants, the budget of the

4 commission, and any transfer of funds by budget amendment must

5 be approved in advance by the President of the Senate and the

6 Speaker of the House of Reoresentatives.

7 (6) Appointments shall be made as soon as possible

8 after the effective date of this act and the commission shall

9 continue to exist and appointed members shall continue to

10 sere until June 1. 1988 July-3t:7-967. A chairperson shall

11 be elected by majority vote of the other members.

12 (7) The Environmental Efficiency Study Commission

13 shall:

2 2. Recommended staff transfers and deletions, shown on

3 organizational charts. to implement the legislation.
4 (8) The Department of Environmental Regulation, the

5 Department of Natural Resources, the Department of Community

6 Affairs, the Department of Agriculture and Consumer Services,
7 the Department of Health and Rehabilitative Services, the

8 Florida Game and Fresh Water Fish Commission, and each of the
9 water management districts and regional planning councils
10 shall:

11 (a) By September 1, 1986, submit a written report to

12 the Environmental Efficiency Study Commission which identifies
13 the specific programs, activities, or regulations the agency
14 administers which duplicate the programs, activities, and

15 regulations of another state or regional agency. The report
16 shall also address the sufficiency of enforcement programs and
17 point out weaknesses and needs as well as unnecessary

18 duplications in enforcement practices. The report shall also

19 contain an identification of any program, activity, or
20 regulation which is administered by more than one division,

21 bureau, section, subsection, office, or program office of such
22 agency.

23 (b) By December 1, 1986, submit a written report to
24 the commission making specific recommendations as to how the

25 duplication cte

28 identifies duplication and inefficiencies in administering

29 environmental regulations and in imnlementinA state
30 environmental policy. The report shall also address changes

13 are hereby repealed.

14 Section 3. There is hereby anorooriated the sum Of
15 S60.000 froa the General Revenu Fund to the Joint Leaislative
16 ManaaeMnt committee for administration of the costs of the
17 Environmental Bfficienc Study Commission for fiscal year

18 1987-1988.

19 Section 4. This act shall take effect upon becoming a
20 law.
