Proposal

Recharge and Deep Well Injection


Problem: Section 373.106 provides that no construction may be
begun involving artificial recharge or the intentional
introduction of water into any underground formation
(other than in connection with oil and gas) without the
written permission of the governing board of a WMD.
This causes confusion.








Proposed Solution:


Amend the statute to grant DER the exclusive authority to

regulate deep well injection for disposal purposes; grant WMD the

exclusive authority to regulate artificial recharge; continue the

authority to regulate related oil and gas activities by DNR in

Chapter 377.

Make it clear that land spreading, stormwater catch basins, etc.

are not artificial recharge activities, per se.
