Enforcement


Problem: There is insufficient compliance monitoring and
enforcement as well as an undetermined role for the
Attorney General in environmental enforcement.

Explanation:

Enforcement and monitoring ensure that conditions placed on
permits, compliance schedules and mitigation are performed.
Onsite inspections are necessary. Enforcement against
activities performed without required permits necessitates
S ongoing surveillance of jurisdictional areas.

Settlements are the result of negotiations and are
accomplished after much staff intervention. Administrative
fines are a non-negotiated remedy which provide for a set
