17-20.001 Introduction; Definitions.
(1) Introduction The purpose of these rules
and regulations is to implement Sections 373.323,
373.326, and 373329, Florida Statutes, that
require in pan that every person who wishes to
engage in business as a water well contractor shall
obtain a license to conduct such a business. The
license required may be obtained from any Water
Management District and shall be recognized as
valid credentials for the person obtaining such
license to conduct business as a water well
contractor in any and all geographical areas of
Florida, including the securing of necessary permits
to conduct such business. Any individual who is
issued a state water well contractor's license
pursuant to this Chapter should be aware that many
local governments also have laws and regulations
which may require a local license or permit to be
obtained before a water well is constructed or
repaired in their jurisdictions. Section
373.323(1)(b), Florida Statutes, states in pan that
the Department of Environmental Regulation may
adopt and from time to time amend rules and
regulations governing applications for water well
contractor's licenses. Section 373.323(1 )(g), Florida
Statutes, requires that the Department, no later
than October 1, 1984, delegate to the water
management districts the powers and duties relating
to processing and issuing water well contractor
licenses.
(2) Definitions as used in this part The
following words and phrases, when used in these
rules and regulations, shall have the following
meanings, except where the context clearly
indicates a different meaning.
(a) "Department" means the Department of
Environmental Regulation, or its successor agency
or agencies
(b) "District" means any Water Management
District as described in Section 373069. Florida
Statutes.
(c) "Drilling Equipment" means a dnlling rig
consisting of the machinery necessary to construct a
well.
(d) "Consiructiin of Waler Wells" means all

wells, including the location and excavation of the
well, but excluding the installation of pumps and
pumping equipment
(e) "Repair" means any action which involves
the physical alteration or replacement of any pan of
a well, but does not include the alteration or
replacement of an) portion of a well which is above
ground surface.
() "Sand-point Well" means any device which
is driven into place and which consists of a pipe with
an attached perforated metal tube or screen
designed to permit the passage of water.
(g) "Water Well Contractor" means any
person, firm or corporation engaged in the business
of construction of waler wells.

17-20.020 Licensing of Water Well
Contractors.
(I) Application requirements Beginning
October 1, 1984, the Water Management Districts
shall accept applications and renewal requests for
licensing as a water well contractor from any person
who is an adult for all legal purposes, has
knowledge of those rules and regulations adopted by
the Department of Environmental Regulation, and
the Water Management District which deal with
the regulation of water wells, has had not less than
two (2) years experience in the work for which he is
applying for a license, and whose application meets
all the following conditions:
(a) Each application shall be submitted on forms
provided by the District, and shall be accompanied
by the required fees.
(b) Each application shall contain proof of
experience as listed by Rule 17-20 020(3).
(c) Each application shall include a request for
the water well contractor examination described by
Rule 17-20.030
(d) The application is not complete until the
applicant passes the required examination. The
District cannot schedule an applicant to take the
required examination until his application has been
reviewed and the applicant has met all other
conditions for licensure.
(e) A license shall not be issued until the
applicant successfully passes the required
examination
(2) Exemption from Examination
Requirements Examinations will not be
required for those persons making proper
application before April I, 1985, who otherwise
fulfill the requirements of these rules and
regulations and who show satisfactory proof they
were engaged in business as a sandpoint water well
driller for two years immediately prior to July I,
1983
(31 Proof of Experience Satisfactory proof of
two years experience in the water well construction
business, shall consist of any one of the method' (a,

certificate of tnmpelenc or certificate of
registration as a water well driller for the last past
24 months.
(b) A list of at least ten (10) wells, together with
their locations, major use, and approximate depth
and diameter, that the applicant has helped to
construct within the last two years. This list must
S show the name and address of the owner or owners
of each well, and the approximate date the
construction of each well was completed.
Completion dates of the ten wells must be
distributed over a 24 month time period. In
addition, the applicant must provide letters certified
as true from three persons attesting to the length of
time the applicant has been working in the water
well construction business as a major activity.
(c) In lieu of the methods described above,
satisfactory proof of equivalent value may be
presented to the District and at the District's option,
accepted on an individual basis.
(4) Renewals Licenses issued pursuant to this
section are not transferable and shall expire on July
1 of each year. A license may be renewed without
examination for an ensuing year by making
S application to the licensing District not later than 30
days after the expiration date and paying the
application fee. Such application shall have the
effect of extending the validity of the current license
until a new license is received or the applicant is
notified by the District that it has taken action to
suspend, revoke or deny renewal of the requested
license. After July 31 of each year, a license will be
renewed only upon application and payment of the
application fee plus a penalty of $50. Pursuant to
Rule 17-20.050, no application for a renewal will be
considered if the applicant's license is suspended or
revoked until the period for such suspension or
revocation has expired.
(5) Application Fees The following fees are
required:
(a) New License: A fee of100 shall accompany
each new application for a license.
(b) License Renewal. A fee of $25 shall
accompany each new application for a renewal of
license.
(c) Late License Renewal: After July 31 of each
year, a penalty fee of 150 shall accompany each
application for license renewal, in addition to the
normal license renewal fee.
(6) Exemptions from Fees- Regular employees
of a political subdivision or governmental entity
engaged in well drilling shall be licensed under this
part but shall be exempt from paying the license fees
S; for the drilling done for the political subdivision or
governmental entity.

17-20.030 Eaminations.
(1) Content of Water Well Contractor
Examinataminations Examinations shall be
comprehensive and standardized statewide and
shall consist of any combination of written, oral


and/or practical work. The standardized
examinations shall be prepared through a combined
effort of Districts in consultation with the
Department, and shall be designed to determine the
applicant's knowledge contcrning well construction
and applicable rules and regulations.
(2) Reports on Examinations A grade on the
examination of seventy percent or more shall be
passing. Results of the examination shall be
reported as either passing or failing. Each applicant
is entitled to review the graded examination in the
district office under staff supervision. Graded
examinations are confidential and shall not be
revealed to persons other than the applicant who
completed the examination. Examinations or copies
of examinations shall not be released to applicants
or to the public and shall be retained by the Districts
in a secured location.
(3) Dates of Examinations Examinations
shall be given by the District as scheduled by the
District.
(4) Location of Examinations --Examinations
shall be conducted at the Water Management
District in which the applicant resides or in which
his principal place of business is located.
Examinations for out of state applicants shall be
conducted in the District where the initial
application was received and processed.

17-20.050 Suspension, Revocation or Denial
of License. The Department or Water
Management District may suspend or revoke the
license or deny license renewal of any water well
contractor upon a determination that the holder of
such license has violated any provision of Part Il of
Chapter 373, Florida Statutes, or this Chapter, or
any rule or regulation of a Water Management
District adopted pursuant thereto or any rules and
regulations of the Department which deal with
water wells. Administrative proceedings for
suspension, revocation or denial of license renewal
shall be governed by Section 120.60(6), Florida
Statutes, and appropriate administrative
procedures of the Water Management District. A
person whose license has been revoked cannot
re-apply for a license within one year after
revocation. Suspension may be for periods less than
a year, depending on the severity of the violation.

contractor shall be assigned a permanent license
number and shall be issued a certificate showing
that license number. License numbers are not
transferable and shall not be used by another
contractor.
(2) Display of License Number The license
number shall be continuously displayed in a
conspicuous place on both sides of,each piece of
drilling equipment owned, leased or operated by the
contractor The number shall beeasily readable by a
person with normal vision and shall be in a color
which will contrast with its background. It shall be
presented in numerals not less than two inches high.
No drilling rig shall be placed in operation without
the contractor's license number displayed on it as
described above.
(3) Drilling Equipment Registration The
licensed water well contractor shall register with the
District, at the time of licensure or annual renewal,
each piece of drilling equipment he owns, leases or
operates. No drilling rig shall be placed in operation
without the license number displayed on it as
described above. All water well contractors will
inform the District by letter within fifteen (15) days
of the purchasing or leasing of any drilling
equipment which is not already described on the
application forms or renewal forms for his Florida
water well contractor's license. .
(4) Notification of Employed Drillers Each
licensed water well contractor shall annually, upon
renewal, notify the District in which his principal
place of business is located of all registered drillers
in his employ. Additionally, each licensed
contractor shall notify such District within 30 days
if a registered driller ceases to be an employee.

17-20.070 Official Licee List. A copy of the
official list of licensed water well contractors and
their addresses shall be maintained by each District.

It shall be the contractor's responsibility to inform
the District within 15 days of any change in. his
official address. Each District shall notify the
Department and the other Districts of address
changes and any change in licensure status of water
well contractors, by the fifteenth day of the month
following said changes. The Department shall
maintain an official State list of licensed water well
contractors and shall provide a copy of this list to
each District on a quarterly basis.

17-20.080 Notification of Changes in Rules
and Reguations. Notification to Water Well
Contractors The Department may from time to
time amend its rules and regulations governing
water well contractors. The Department will notify
each water well contractor on the Department's
official State list of licensed water well contractors of
any changes in the Department's rules and
regulations prior to the effective date of the changes
This notification, or lack thereof, will in no way
affect the effective date of the changes in the rules
and regulations.

17-20.090 Penalties. Any person who violates
any provision of Part III of Chapter 373, Florida
Statutes, or this Chapter, or any rule or regulation
of a Water Management District adopted pursuant
thereto, or any rules and regulations of the
Department which deal with water wells, is subject
to the penalty provision in Section 373.336, Florida
Statutes.
